RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO
ORDER THE VACATION OF A PORTION OF PICO AVENUE BETWEEN 5TH STREET AND SPRUCE
STREET, AND RESERVING AN EASEMENT FOR SANITARY SEWER AND APPURTENANT FA-
CILITIES AND AN EASEMENT FOR PUBLIC UTILITIES THEREIN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
That the
Mayor and Common Council of the City of San
SECTION 1.
Bernardino hereQy declare their
intention to order the vacation of a portion
8 of Pico Avenue, lying between 5th Street and Spruce Street, described as

follows:
The West 26.2 feet of the South 276.6 feet of Paddock
Subdivision, as per plat thereof recorded in Book 16 of
Maps, Page 32, in the office of the County Recorder of
said County.
SECTION 2.
That the Mayor and Common Counci I of the City of San
14 Bernardino, in vacftUng the above described portion of sftid street, elect to
15 proceed under and in accordance with the provisions of the "Public Streets,
16 Highways and Services Vacation Law", beinl'( Division 9 Part :" of the Streets
17 and Highways Code of the State of California.
18 SECTION 3. That the hour of 10:00 A.M. on the 19th day of October
19 1992, in the Council Chamber of the City Hall, San Bernardino, California,
20 be, and the same hereby is fixed as the time and place when and where all
21 persons interested in or objecting to the proposed vacation may appear be-
22 fore said Mayor and Common COllilcil and offer evidence in relation thereto.
23 For further particulars as to the proposed vacation of the hereinbefore
24 described portion of said street, reference is made to that map marked "Plan
25 No. R733" approved June 15, 1992, on file in the office of the City Clerk of
26 said City.
27 SECTION 4. Nothing in this Resolution shall in any way affect or
28 disturb any existing easements for pllbl ic uti! ity purposes belonging either

1 to the City of San Bernardino or to any public utility and there is further
2 reserved for present and future general public utility purposes, and fnr
3 this City, an easement reasonably necessary to locate sanitary sewer and
4 appurtenant facilities in, over, under and across the entire area of the
5 proposed vacation, along with the right to construct, use, install, main-
6 tain, repair, replace or renew such facilities. There is also specifically
7 reserved for Southern California Gas Company, over the Easterly 5.00 feet of
8 the Southerly 120.00 feet of the area proposed for vacation, an easement and
9 right at any time, or from time to time to construct, maintain, operate,
10 replace and renew one or more pipe] ines "nd appurtenances thereto for the

12 ingress and egress thereto.
13 SECTION 5. That tlw City Engineer' of the City of San Hernardino
