Reauest for remoorarv Use of the Public Enterprise Center
Mildred D, Henry, Ph,D., Professor at California State University, San
Bernardino has requested use of the Agency-owned Public Enterprise
Center (PEC) building to conduct education clssses from September 30,
1992 through December 2, 1992. The classes (6:00 to 10:00 p.m,) will
require the ten-week exclusive use of rooms 2, 3 and 5 and the
conference room each Wednesday for the days of September 30; October 7,
14, 21, 28; November 4, 11, 18, 25; and December 2, 1992. Although
alternative school classroom facilities are not referenced, Dr, Henry
noted in the attached letter requesting use of the building that
"because of the lack of adequate facilities" at the school's
Provisional Accelerated Learning (PAL) Center, the classes cannot be
conducted there.
Last summer Dr. Henry was granted use of the Public Enterprise Center
(PEC) facilities to conduct five weeks of classes at no cost,
Similarly, she had been allowed to use the building for classes
intermittently in previous years, Single event usage of the building
normally has no impact on management of the building. However,
extended uses as proposed should be carefully reviewed in deference to
prudent property management, equal accessibility of building usage,
overhead maintenance costs, deClining revenues and more recent
substantial surcharges (estimated $3 million) legally imposed on the
Agency by the State. Customary management practices would also dictate
the Agency require "riders" on insurance coverage of the tenant in
order to "hold" the Agency harmless from liability or lawsuits. It is
consequently appropriate to consider insurance coversge and charging
long term tenants a fee to defray costs that the Agency would otherwise
have to absorb. During the months of July 1, 1992 to June 30, 1992,
the Agency's disbursement of cash relative to carrying costs for the
Public Enterprise Center building was $128,972, or $10,747 per month, a
figure that is reduced from previous years. Typical charges included,
but were not limited to, electricity, gas, water/sewer, security, air
conditioning repair, general maintenance, and related items.
Arguably staff feels that use of the Public Enterprise Center building
for single event, one or two day community meetings/sessions, is
appropriate. However, a similar case cannot be made for repetitious or
long term usage that in effect becomes an intermittent tenancy without

benefit of tenant payment to reduce wear and tear on the building.
This is especially valid in view of the continuing high maintenance
costs for the building. Correspondingly, longer term usage such as
that herein proposed, should be discouraged and in this case denied.
It is further believed that denial of the request should neither cancel
the class or preclude a benefit to the community. Benefit to the
community, via such classes, can also be measured by how many of the
registered students live in the community and, but for conduct of the
classes in the PEC building, would be unable to attend the class. The
answer is obviously none, inasmuch as location of the classrooms at the
PEC building was unknown by students during class enrollment. Further,
if it is necessary, transport of residents can easily be directed to an
alternative location. Staff see no unique advantages to conducting the
classes in the PEC building nor disadvantages to the students, teachers
or the community.
A second less obvious reason for the recommendation of denial is the
ultimate disposition of the subject property. Although the Chairman,
at the last Community Development Commission meeting cited community
opposition as the primary reason for his recommendation to the
Commission that efforts relating to a potential swap of buildings
between the Agency and the San Bernardino Community College District be
abandoned, staff has attended recent community meetings where
supporters of the proposed trade were vociferous and numerous as those
persons opposing the swap of real property. It is for this reason and
others that have contributed to staff formulating a recommendation for
denial.
Staff recommends adoption of the form motion.

The tutorial/counseling service. Off.red the students this
