connection with 16th of September celebration at

Recommended motion:
That utilization of City crews and equipment-for assisting The Inland
Empire Hispanic Chamber of Commerce, in their 16th of September celebration
at Seccombe Lake Park be authorized; and that the fees in the amount of
$3,750 for use of facilities and equipment and the expenses incurred by the
use of City forces and equipment in providing said assistance be waived.

The Inland Empire Hispanic Chamber of Commerce has
schedule the use of Seccome Lake Park for their Annual
Mexican Independence Day celebration. As part of their
request, they have requested a waiver of the fees and
costs involved for use of the park. (See attached
letter from The Chamber dated Auqust 14, 1992. ) The
Application/Permit for use of the facility alonq with the
Special Conditions, and a list of fees and incidental
manpower and equipment costs in the amount of $3.750
involved for this event are also attached.
Resolution NO. 91-35 allows the Mayor and Common Council
to exempt non-profit corporations and associations,
orqanized primarily for patriotic, civic betterment or
charitable purposes, from the rates and fee schedule for
the use of park and recreation facilities, services and
equipment under the condition that payinq the fees would
create a hardship or if the event is of unusual benefit
to the citizens of San Bernardino. This event is one in
which a larqe seqIDent of the population participates and
which has been attended in the past when held at Nunez
Park by approximately 50,000 over the 3 day period. This
event features entertainment, food and drink.
This activity when held at Nunez Park was extremely
successful in promotinq Hispanic history and culture in
our City. The benefits of the event for all City
inhabitants are such that, as has been done for other
such events, the fees could be waived.
JUSTIFICATION FOR PLACEMENT ON THE SUPPLEMENTAL AGENDA
The Chamber's request for use of City forces and waiver
of fees was not received in time to be placed on the
reqular aqenda. The use of the facility is scheduled for
September 18, 19 & 20, 1992; therefore, it is necessary
that action be taken on this item at the September 7th
meetinq.

The Inland Empire Hispanic Chambec of Commerce is planning it's 35th Annual .16 de
Septiembre- c:elebration, and request the use of Secx:ombe Park on September 18th through
Septembec 20th. Along with this request, we also like to sell beer during this time frame.
Please note the following time schedules for the p..~ activities:
Friday, Septembec 18th, the Carnival, Entertainment, and Food will commence at
5:00 p.m.. and end at 10:00 p.m.. The sale of beer will start at 5:00p.m. until
9:00 p.m..
Satw-dayand Sunday, Septembec 19th and 20th, the festivities will be the same,
except that the hourS of the celebration will be between 12:00 p.m. and 10:00 p.m"
Again, the sale of beer will end at 9:00 p.m. .

~ As in the past, we have hired the D"'Cellsary personnel for security as well as maintaining
the cleanliness of the park. We intend to do the same fer this year.
We sinc:erely hope that this request may be possible; 110 that it will enable us to celebrate our
Hispanic-American heritage in the City of San Bernardino.

PERMITS AND LICENSES

SECURITY AND CROWD CONTROL
Applicant will provide security and crowd control for the
event on a 24 hour basis with a written duty schedule to be
provided to the Parks, Recreation and Community Services
Department and the Police Department. The duty schedule will
provide the name, address and telephone number for the
individual responsible for security alonq with the names and
duty times for each individual workinq as crowd controller
andlor daY/niqht security quard.
CLEANLINESS OF FACILITY AND CLEAN-UP DEPOSIT
Applicant will provide for continuous clean-up durinq the
event. Applicant will make arranqements with City Refuse
Division for provision of trash bins and for the time the
bins are to be emptied. Applicant aqrees to provide person-
nel to empty trash receptacles into the larqe trash bins
prior to scheduled pick-up time by ~he Refuse Division. A
facility Cleaninq Deposit of $~OO:~ is required.

EMERGENCY RESPONSE'
Applicant aqrees that in the event of an emerqency response
by City forces as a result of activities of the event, all
salary and material costs shall be borne by the applicant;
i.e., pluqqed sewer lines, electrical failure, riots, mass
arrests, major crime responses, etc.
ALCOHOLIC BEVERAGE SALES AND/OR CONSUMPTION
Alcoholic beveraqe use for any event on City property must be
approved by the city AdministratoF' In addition, alcoholic
beveraqe sales must be approved by the city Police Depart-
ment and an ABC License must be obtained. Alcohol use fees

In the event that alcoholic beveraqe sale andlor use is
approved for this event, the applicant shall hold the City

premises.

CONTRACTURAL AGREEMENTS
Applicant shall furnish to the Parks, Recreation and Com-
munity Services Department a copy of siqned contracts between
applicant and any vendors or other providers of services for
the event.
INSURANCE REQUIREMENTS
Applicant shall procure and maintain in force durinq the term
of this permit and any extension thereof, at its expense,
public liability insurance in companies and throuqh brokers
approved by City, adequate to protect aqainst liability for
damaqe claims throuqh public use of or arisinq out of acci-
dents occurrinq in or around the premises, in a minimum
amount of $l,OOOrOOO. The City shall be named as additional __
insured in the policy. The Applicant's insurance will be
primary to any coveraqe the City of San Bernardino may have
in effect. Such insurance policies shall provide coveraqe
for City's continqent liability on such claims or losses
resultinq from activities of the permit. An appropriate
certificate of insurance shall be furnished to the Director
of Parks, Recreation and Community Services. Failure to
