Synopsis of Previous Council action:
Resolution No. 90-452 authorizing the extension of the term of the lease with
the Sedlak Family Trust for that certain office building commonly known as
646 North Sierra Way (SBETA facilities), was duly adopted by the Mayor and
Common Council of the City of San Bernardino at their meeting of November 5,
1990.

STAFF REPORT
On October 2, 1989, the Mayor and Common Council adopted Resolution
No. 89-402, which authorized the execution of a Lease Agreement
with the Sedlak Family Trust for the building located at 646 North
Sierra Way (SBETA Office). The building contains approximately
7225 square feet and is accompanied by a black-topped parking area
that will accommodate approximately 75 vehicles.
This lease was for a period of one year, commencing October 1,
1989, and ending September 30, 1990. The agreed upon monthly
rental fee was $3, 692.04. A two year extension to the Lease
Agreement, was authorized through the adoption of Resolution No.
90-452 by Agreement dated November 8, 1990.
The requested Lease Extension is for a period of two (2) years,
beginning October 1, 1992, and ending September 30, 1994, with an
increase in the monthly rental fee from $3,692.04 to $4,046.00 per
month (approximately 56 cents per square foot).
The building will be used to administer the Job Training
Partnership Act programs, and the rent will be paid with JTPA
federal funds that are made available through the Department of
Labor.
Justifications for the Lease Extension include:
1.
The building is easily accessible to job
seeking clients, with ample parking space and
a nearby public transportation system.
2. The building has a large conference room that
is utilized by the 24 member Private Industry
Council for their meetings.
3. The monthly rental fee of $4,046.00 per month
is reasonable in comparison to the rental fees
for similar commercial buildings wi thin the
area.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AMENDMENT OF LEASE BY AND BETWEEN THE SEDLAK
FAMILY TRUST AND THE CITY OF SAN BERNARDINO. (SBETA)
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor is hereby authorized and directed to
execute on behalf of said City an Amendment of Lease by and
between the Sedlak Family Trust and the City of San Bernardino for
the offices of the San Bernardino Employment and Training Agency.
SECTION 2.
The authorization to execute the above-
referenced agreement is rescinded if the parties to the agreement
fail to execute it within sixty (60) days of the passage of this
resolution.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

1 AMENDMENT OF LEASE
2 THIS AMENDMENT OF LEASE, made and entered into this
3 day of , 1992, by and between the SEDLAK FAMILY
4 TRUST, herein called the Lessor, and the CITY OF SAN BERNARDINO,
5 hereinafter called the Lessee;
6 WITNESSETH:
7 WHEREAS, by written lease dated October 4, 1989, the Lessor
8 did let and lease to the Lessee certain premises fully described
9 in said lease (and briefly described as that certain office
10 building commonly known as 646 North Sierra Way containing
11 approximately 7225 square feet, along with 75 parking spaces) for
12 a term beginning October 1, 1989, and ending September 30, 1990,
13 and
14 WHEREAS, said lease was amended to extend the term thereof
15 by a written amendment dated November 8, 1990, to extend the term
16 to end on September 30, 1992, and to provide for certain
17 improvements to be completed by Lessor, and
18 WHEREAS, the parties desire to further extend the term and
19 adjust the rental of said lease,
20 NOW THEREFORE, the parties hereto agree as follows:
21 1. The term of said lease is extended an additional period
22 of two (2) years, beginning the first day of October, 1992, and
23 ending the 30th day of September, 1994.
24 2. The monthly rental fee shall be increased by 9.6%, to
25 $4,046.00 per month.
26 3. Except as amended herein, said lease, as previouSly
27 amended, shall remain in full force and effect.
