Recommended motion:
1. That the transfer of $13,800 from Account No. 772-301-57303,
"Street Improvements, AM/PM Station at the northeast corner of
Del Rosa Avenue and Date St., CUP No. 89-20," to Account No.
242-362-57888, "Del Rosa Avenue, N/O Date St.," be approved.
2. Adopt resolution.

STAFF REPORT
Bids for the improvement of Del Rosa Avenue, north of Date
Street, were opened at 2:00 p.m., Tuesday, 7-28-92. The project
consists, in general, of removing and replacing pavement, and
construction of curbs and gutters, and driveway approaches.
A total of lO bids were received, ranging from $40,001.15
to $80,929.75. The low bid of $40,001.15 is 4.9% under the Engi-
neer's Estimate of $42,069.00.
Below is an estimate of the total project cost, based upon
the actual low bid price:
Construction Contract $ 40,001.15
Engineering & Inspection (W.O. #1939) 6,500.00
Sub-Total $ 46,501.15
Contingencies (8%) 3,798.85
TOTAL ESTIMATED PROJECT COST $ 50,300.00
An amount of $50,000 was allocated in the 1991/92 Budget,
under Account No. 242-362-57888, to finance the costs incurred
for this project. Supplemental funds in the amount of $14,000
were allocated in the 1992/93 Budget.
The developer of the AM/PM Market, on the northeast corner
of Date Street and Del Rosa Avenue, paid a fee of $13,800 for
street improvements on 6-3-91, as evidenced by Miscellaneous Cash
Receipt No. 641747. These funds were deposited in Account No.
772-301-57303. It is proposed that these funds be transferred to
the project account, 242-362-57888, in order to help finance the
costs incurred.
We recommend that a contract be awarded to the low bidder.

FROM DATE STREET TO CARPENTER
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Ranco Corporation is the lowest responsible
7 bidder for:
Construction of Street Improvements on Del Rosa
8 Avenue, from Date Street to Carpenter Street, per Plan No. 8575.
9 A contract is awarded accordingly to said bidder for the total
10 amount of $40,001.15, but such award shall be effective only upon
11 the contract being fully executed by both parties. All other
12 bids, therefore, are hereby rejected. The Mayor is hereby
13 authorized and directed to execute said contract on behalf of the
14 City; a copy of the contract is on file in the office of the City
15 Clerk and incorporated herein by reference as fully as though set
16 forth at length.
17 SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements, amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.
