Klein rrom 433 Borth "B" Street The Agency currently has plans to proceed with the demolition of the Pussycat Theatre and Office Annex adjacent to the theatre and located at 423 - 435 North "E" Street, in order to make way for the proposed development on the site. At this time, it is necessary to relocate Dr. William Klein, the one (1) existing tenant still occupying 433 North "E" Street. Pursuant to the City's General Relocation Plan, Section 7260 - 7277 of the State Government Code, Chapter 4 Article 9 of the Health and Safety Code and the Uniform Relocation Act, Dr. Klein is eligible for relocation benefits and assistance due to the displacement of his business as a direct result of a project undertaken by a public entity. The Agency has provided Dr. Klein with advisory assistance, such as referrals to suitable replacement locations, information regarding relocation assistance options available, help in preparing claim forms for a relocation payment, and other assistance to minimize the impact of the move. After reviewing all relocation options carefully, Dr. Klein has decided to submit a Claim for Fixed Payment in Lieu of Payment for Actual Moving and Related Expenses. Pursuant to Section l16(b) of our General Relocation Plan, Dr. Klein is eligible to receive a fixed payment in an amount equal to the average annual net earnings of the business up to a maximum of $20,000. Mr. Klein has provided staff with income documentation to substantiate his claim for the full amount of $20,000. At its July 23, 1992 meeting, the Redevelopment Committee recommended that the Community Development Commission approve this relocation claim. A copy of Dr. Klein's claim is provided for your information.
