SUBJECT: Appeal of the Planning Commission's denial of a request
for a one-year Extension of Time for Conditional Use
Permit No. 90-32, an application to establish a vehicle
recycling yard on 9.5 acres located on the south side of
Walnut street, approximately 380 feet east of Muscott
street.

BACKGROUND
On June 15, 1992, the Mayor and Common Council heard the appeal of
the Extension of Time request for Conditional Use Permit No. 90-32.,
During the hearing, several environmental concerns were raised in
regarding the project. Among those concerns were adequate
screening through height of wall and landscaping, noise, and use of
public address systems. As a result of these concerns, the Mayor
and Common Council continued the appeal to July 6, 1992 and
directed staff to investigate the concerns and return with
Conditions of Approval to mitigate them.
ANALYSIS
Staff has reviewed the'proposal in regard to the concerns raised at
the Mayor and Common Council Meeting on June 15, 1992. New
Conditions of Approval and Standard Requirements for the proposal
have been provided and are included as Exhibit A. The Conditions
and Standard Requirements in Exhibit A fall into two groups, those
that are proposed to be added to the project under the Extension of
Time request and those that were imposed on the original
Conditional Use Permit. Conditions proposed under the extension
are referred to by the prefix "EOT" and then the condition number
(eg. EOT-1). Conditions imposed by the original Conditional Use
Permit are referred to by number only. Condition of Approval EOT-9
requires that all of the original Conditions of Approval and
Standard Requirements of Conditional Use Permit No. 90-32 shall
apply, and that should there be conflict between the time extension
conditions and the original project conditions, the time extension"
conditions shall apply.
Several of the concerns and their mitigation are discussed below.

Condition EOT-6 requires an 6 foot decorative concrete block wall
around the perimeter of the project site. The block wall is to be
placed on top of a 2 foot berm in the areas along Walnut street for
additional height and screening. Condition EOT-IO requires a Type
A landscape screening to include an evergreen climbing vine on the
6 foot wall, and large 25 inch box evergreen trees (Mondale Pines)
planted at 30 foot intervals. The exact placement of the trees
will be determined by the Planning Division and Parks and
Recreation Department during landscape plan review to optimize the
screening of the yard. Condition EOT-11 prohibits the stacking of
vehicles, parts or equipment above the height of the 6 foot wall.

Concern was also expressed that the landscaping may not be properly
maintained, reducing its effectiveness as a screen, or that the
vehicles would be stacked over the height of the wall in violation
of conditions of approval.
Condition EOT-6 requires the installation of an automatic
irrigation system adequate to ensure landscaping viability.
Condition EOT-5 requires the landowner to file a maintenance
agreement or covenant and easement to enter and maintain the
property prior to the issuance of a Certificate of Occupancy. The
aqreement, covenant or easement to enter and maintain shall ensure
that if the landowner or subsequent landowner(s} fail to maintain
the required/installed improvements, the City may enter the
property to accomplish the required maintenance and then file an
appropriate lien(s} against the property to pay for the
maintenance. The agreement, covenant or easement shall also ensure
that if the landowner or subsequent landowner(s} fail to comply
with the conditions of approval regarding business operation
(vehicle stacking, storage of liquid containers, drainage of fluids
from vehicles stored/recycled, etc.), the City will be able to file
the appropriate lien(s} against the property and to enter and
ensure compliance and clean up environmental damage to the site
resulting from such non-compliance.

Concern was expressed regardinq the potential use of a public
address (PA) system on the site creating noise and impacting
adjoining properties. Condition EOT-12 prohibits the use of a PA
system or the playing of loud music at any time. The required

reduce any noise resulting from operation of the business from
impacting adjoining residences.

Bnforc_ent
staff was directed to develop a means of enforcing the mitigation
for the concerns. The required agreement, covenant or easement
required by EOT-5 provides a significant means of enforcing
property maintenance and compliance with conditions of approval
regarding business operation. However, there is concern that
frequent violation may require frequent Code Enforcement action by
the city. Condition EOT-13 has been added requiring immediate
Conditional Use Permit revocation proceedings following 3 citations
resulting from code enforcement violations.
CONCLUSION
The Conditions of Approval contained in Exhibit A will ensure that
the proposed vehicle recycling facility will not present a blighted
appearance and that the facility will be compatible with the
surrounding land uses.
OPTIONS AVAILABLE TO THE MAYOR AND COUNCIL
The Mayor and Council may deny the appeal and deny the Extension of
Time request for Conditional Use Permit No. 90-32, or the Mayor and
Common Council may uphold the appeal and approve a one-year
Extension of Time, until January 8, 1993 for Conditional Use Permit
No. 90-32.
RECOMMENDATION
Staff recommends that the Mayor and Council uphold the appeal and
approve a one-year Extension of Time, until January 8, 1993, for
Conditional Use Permit No. 90-32, subject to the Findings of Fact
contained in the Planning Commission staff report of March 3, 1992,
and the attached Conditions of Approval and Standard Requirements
(Exhibit A).

Construction shall be in substantial conformance with the
planes} approved by the Director, Development Review'-
Committee, Planning Commission or Mayor and Common
Council. Minor modification to the planes} shall be
subject to approval by the Director through a minor
modification permit process. Any modification which
exceeds 10 % of the following allowable measurable
design/site considerations shall require the refiling of
the original application and a subsequent hearing by the
appropriate hearing review authority, if applicable.
1. On-site circulation and parking, loading and
landscaping;
2. Placement and/or height of walls, fences and
structures;
3. Reconfiguration of architectural features,
including colors, and/or modification of finished
materials that do not alter or compromise the
previously approved theme; and,
4. A reduction' in density or intensity of a
development project.
Within one year of development approval, commencement of
construction shall have occurred or the permit/approval
shall become null and void. In addition, if after
commencement of construction, work is discontinued for a
periOd of one year, then the permit/approval shall become
null an void. Projects may be built in phases if
preapproved by the review authority. If a project is
built in preapproved phases, each subsequent phase shall
have one year from the previous phase's date of
construction commencement to have occurred or the permi t/
approval shall become null and void.

The review authority may, upon application being filed 30
days prior to the expiration date and for good cause,
grant one time extension not to exceed 12 months. The
review authority shall ensure that the project complies
with all current Development Code provisions. '
In the event that this approval is legally challenged,
the City will promptly notify the applicant of any claim
or action and will cooperate fully in the defense of the
matter. Once notified, the applicant agrees to defend,
indemnify, and hold harmless the City, its officers,
agents and employees from any claim, action, or
proceeding against the city of San Bernardino. The
applicant further agrees to reimburse the city of any
costs and attorney's fees which the city may be required
by the court to pay as a result of such action, but such
participation shall not relieve the applicant of his
obligation under this condition.
No vacant, relocated, altered, repaired or hereafter
erected structure shall be occupied or no change of use
of land or structure(s) shall be inaugurated, or no new
business commenced as authorized by this permit until a
Certificate of Occupancy has been issued by the
Department. A temporary Certificate of Occupancy may be
issued by the Department subject to the conditions
imposed on the use, provided that a deposit is filed with
the Department of Public Works prior to the issuance of
the Certificate of Occupancy. The deposit or security
shall guarantee the faithful performance and completion
of all terms, conditions and performance standards
imposed on the intended use by this permit.
Prior to the issuance of a Certificate of Occupancy, the
landowner shall file a maintenance agreement or covenant
and easement to enter and maintain, subject to the
approval of the City Attorney. The agreement or covenant
and easement to enter and maintain shall ensure that if
the landowner, or subsequent owner(s); fail to maintain
the required/installed site improvements, the city will
be able to file an appropriate Hen(s) against the
property in order to accomplish the required maintenance.

The agreement, covenant or easement shall also ensure
that if the landowner or subsequent landowner(s) fail to
comply with the conditions of approval regarding business
operation (vehicle stacking, storage of liquid
containers, drainage of fluids from vehicles
stored/recycled, etc.), the City shall have the right to
enter and bring the project into compliance and to file
an appropriate lien(s} against the property to pay for
the compliance measures and clean up of any environmental
damage to the site resulting from such non-compliance.
EOT-6.
The developer is to submit a complete master landscape
and irrigation plan (5 copies) for the entire development
to the Public Works Department with the required fee for
review. The landscape plans will be forwarded to the
Parks, Recreation and Community Services and the Planning
Division for review. No grading permit(s) will be issued
prior to approval of landscape plans. The landscape and
irrigation plans shall comply with the "Procedure and
Policy for Landscape and Irrigation" (available from the
Parks Department), and comply with all applicable
provisions of Chapter 19.28 (Landscaping Standards) of
the Development Code effective on the date of approval of
this permit. Trees are to be inspected by a
representative of the Parks Department prior to planting.
All landscaped areas must be provided with an automatic
irrigation system adequate to insure their Viability.
An 6 foot decorative concrete block wall in a neutral
color to match the proposed buildings, shall be placed
around the perimeter of the entire site. The wall shall
be placed on top of a two foot earthen berm in the areas
along Walnut Street ensuring a total overall height of 8
feet (including the berm).

This permit or approval is subject to all the applicable
provisions of the Development Code in effect at the time
of approval. This includes Chapter 19.20 (Property
Development Standards), and includes: dust and dirt
control during construction and grading activities;
emission control of fumes, vapors, gases and other forms
of air pollution; glare control; exterior lighting design
and control; noise control; odor control; screening;
signs, off-street parking and off-street loading; and
vibration control. Screening and sign regulations
compliance are important considerations to the developer
because they will delay the issuance of a Certificate of
Occupancy until they are complied with. Any exterior
structural equipment, or utility transformers, boxes,
ducts, or meter cabinets shall be architecturally
screened by a wall or structural element, blending with
the building design and include landscaping when on the
ground. A sign program for all new commercial, office
and industrial centers of three or more tenant spaces
shall be approved by the Department prior to the issuance
of a Certificate of Occupancy.
This requirement also includes any applicable Land Use
District Development Standards for residential,
commercial and industrial developments regarding minimum
lot area, minimum lot depth and width, minimum setbacks,
maximum height, maximum lot coverage, etc.
This development shall be required to maintain a minimum
of 45 standard off-street parking spaces as shown
on the approved planes} on file.

All of the Conditions of Approval and Standard
Requirements of the original approval of Conditional Use
Permit No. 90-32 shall apply. Wherever conflict between
the Conditions of this Time Extension and the Conditions
contained in the original approval arise, the condition
of the Time Extension shall apply.
The proposed facility shall be screened on all sides with
Type A landscape screening. The landscape screening
shall include an evergreen climbing vine on the required
6 foot block wall specified in Condition EOT-6, and
large, 25 inch box evergreen trees (Mondale Pines)
planted 30 apart. Trees along Walnut Street shall be
planted on the outside of the wall. Trees along the
east, west and south perimeter areas may be planted in
the interior yard area adjacent to the 6 foot wall. The
Exact placement of the trees will be determined by the
Planning Division and Parks and Recreation Department
during landscape plan review to ensure maximum screening
of the site.
No vehicles, parts or equipment are to be stacked above
the height of the 6 foot block wall required by condition
EOT-6.
The use of a Public Address system on the site is
prohibited at all times. Radio, tape playes, etc. shall
not be played at a volume sufficient to be heard beyond
the limits of the property.
Three notices of violation of project Conditions of
Approval or code enforcement violation(s}, or any
combination thereof, shall result in immediate
proceedings to revoke this Conditional Use Permit.
Permitted hours of operation shall be 7:00 a.m. to 6:00
p.m.

STANDARD CONDITIONS
1. Minor modifications to the plan shall be subject to
approval by the Director of Planning. An increase or
more than 10 percent of the square footage or a
significant change in the approved concept shall be
subject to (Planning Commission and Development Review
Committee) review and approval. Construction shall be in
substantial conformance with the Plans approved by the
Development Review Committee, Planning Commission or
Director of Planning and Building Services.
2. The developer is to submit a complete master landscape
and irrigation plan (4 copies) for the entire development
to the Engineering Department with the required fee for
approval, the landscape plans will be forwarded to the
Parks, Recreation, and Community Services and the
Planning Department for review and approval. (Note: the
issuance of a building permit by the Department of
Building and Safety of the city of San Bernardino, does
mrI waive these requirements/conditions.) No grading
permits will be issued prior to approval of landscape
plans.
The design shall include, but not be limited to the
following:
x Street trees shall be planted on 30 foot
center spacing unless otherwise indicated by
the Department of Parks, Recreation, and
Community Services. The Parks Department
shall determine the varieties and locations
prior to planting. All trees shall be 24" box
specimens. Trees are to be inspected by a
Park Division representative Drior to
planting.
x Planters shall be enclosed with concrete
curbing.

The setbacks from the north , south ,

to issuance of Certificate of Occupancy.
4. In the event that this approval is legally challenged,
the City will promptly notify the applicant of any claim
or action and will cooperate fully in the defense of the
matter. Once notified, the applicant agrees to defend,
indemnify, and hold harmless the City, its Officers,"
agents and employees from any claim, action, or
proceeding against the City of San Bernardino. The

7. The project shall preserve all trees in place wherever
feasible. Should the removal of any tree be necessary, the
applicant/developer shall file a tree removal permit with the
Planning Department, subject to the approval of the Parks and
Recreation Department and the Planning Department. The tree
removal permit application shall include an arborist report on
the condition of any trees to be removed and the viability of
relocating/transplanting the trees elsewhere on site.
8. The office and storage building shall be constructed with of
a decorative split-face or fluted concrete block exterior for
greater durability.
9. No vehicles, parts, or equipment are to be stacked above the
height of the six foot decorative wall surrounding the storage
yard.
10. No liquid containers shall be dismantled on the site.
11. All storage shall be contained within the fenced area.
12. This development shall be required to maintain a minimum of 51
standard Off-street parking spaces. However, after 12 months
of operation of the business, the recycling yard owner, shall
submit to the City two sets of mailing labels of property
owners and their addresses and/or tenants addresses of the
property within 500 feet of the exterior boundaries of the
recycling yard site. A map illustrating the 500 foot radius'
boundary and all parcels within that boundary shall also be
submitted. This information shall be obtained from the latest
San Bernardino County equalized assessment: roll and maps.
After receipt of the mailing labels and map, the City will
send a parking questionnaire to those neighboring property
owners, Councilmembers and Police. This questionnaire will
ask questions about whether or not the parking from he
recycling yard has overflowed and impacted their property, the

frequency of such occurrences, and the adequacy of parking for
the facility. If a parking inadequacy is identified and
substantiated, the applicant shall provide the additional 78
standard parking spaces required by the current code.
13. The applicant shall obtain all necessary permits from DEHS for
storage, handling, etc. of hazardous materials and waste.
14. All fluids, including oil and gasoline shall be drained from
all vehicles to be stored/recycled at the site.
15. Since no evidence of faulting was observed within the limits
of the trenching, no restricted building use setback is
warranted where the proposed building is to be located.
16. A potential for settlement of the fault trench backfill exists
at the site and shall be mitigated during rough grading by
removal and recompaction, or compaction in place if
applicable.
17. Moderate-severe ground shaking levels can be anticipated
during the life of the structure. The seismic accelerations
discussed in the text of the geologic report shall be
incorporated into the structural design of the building in
addition to complying with the seismic code provision for the
City of San Bernardino and the latest edition of the Uniform
Building Code.
18. If any other areas at the site are proposed to be built on in
the future, appropriate investigation shall be performed to
evaluate the potential for faulting.
19. A copy of the geologic and seismic investigation of the site
conducted by Terra Geotechnical shall be made available to
property owners and tenants of the proposed project, present
and future, in an effort to make them aware of the potential
seismic risks associated with the site.
20. Should any conditions be encountered during development that
appear in any way to be different from those described in the
geologic and seismic report completed by Terra Geotechnical,
a qualified geologist shall be notified concerning appropriate
recommendations and mitigation.
21. The storage building shall not be used for office or any other
human occupancy use unless the appropriate geological studies
have been conducted.

1. Conditional Use Permit No. 90-32 shall be in effect for
a period of 12 months from the date of approval.
However, if no development has been initiated at the end
of the 12 month period, the application shall expire.
Addi tional time may be approved upon request of the
applicant prior to expiration of the 12-month period.

2 . PARKING:
b. All parking and driving aisles shall be surfaced,
with two inches of AC over a suitable base or
equivalent as approved by the City Engineer.
Parking spaces shall be striped and have wheel
stops installed at least three feet from any
building, wall, fence, property line, or walkway.

COMPOSITE DEVELOPMENT PLAN
A Composite Development Plan (CDP) shall be filed with
the Engineering, Planning, and Building and Safety
Departments prior to Final or Parcel Map processing by
the city pursuant to Ordinance No. MC-592. The CDP shall
provide additional survey and map information including,
but not limited to, building criteria (e.g. setbacks),
flood control criteria, seismic and geological criteria,
environmental criteria and easements of record. The CDP
shall be labeled with the title "Composite Development
Plan", and contain a section entitled "Composite
Development Plan Notes". The applicant shall have listed
under the CDP Notes section the following conditions or
mitigating measures required for the development of the
subject property:
13. The property owner shall sign a covenant running with the
land agreeing that if the required landscaping is not
maintained, the City may enter on the property and
install and maintain the required landscaping and may
lien the property for the costs. The covenant shall be
signed and recorded with the County of San Bernardino

Utilities:
68. ~Design and construct all public utilities to serve the site in
accordance with City Code. City Standards and requirements of the
serving utility. including gas, electric, telephone. water, sewer
and cable TV.
Each parcel shall be provided with separate water and sewer
