STAFF REPORT
Bids for this project were opened at 2:00 p.m., Tuesday,
7-14-92.
A total of 6 bids were received, ranging from $36,853.48
to $96,174.19. The low bid of $36,853.48 is 8.0% below the
Engineer's Estimate of $40,064.00.
Below is the total estimated project cost, based on the
actual low bid price:

The costs incurred for installing these fill-in street

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO A. L. CHAVEZ ENTERPRISES, INC. FOR FILL-IN STREET
IMPROVEMENTS UNDER CHAPTER 27 OF THE STREETS AND HIGHWAYS CODE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION l. A. L. Chavez Enterprises, Inc. is the lowest
responsible bidder for:
Fill-in Street Improvements, under
Chapter 27 of the Streets and Highways Code, per Plan No. 8648.
A contract is awarded accordingly to said bidder for the total
amount of $36,853.48, but such award shall be effective only upon
the contract being f\l"lly executed by both parties. All other
bids, therefore, are hereby rejected.
The Mayor is hereby
authorized and directed to execute said contract on behalf of the
CitYl a copy of the contract is on file in the office of the City
Clerk and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
