The informal Attorney General' s Opinions we have r_i_ed .nd
the ev.luation by Mr. John Martin, previously of thi. office, are
.U based on the earlier langu.ge and not on the langua~e of 511489
as it re.d. betw..n July 1, 1992 and 1994. CUnently, whether
through oversight or by design, there appe.r. to be no restrictions
on the us. of .tate ....t forfeiture funda.
I have discussed thi. matter with Jeff COOk, . Depu1;y Attorney
G.n.ral with the A..et Porfel ture '1'091'." in San Di.go. They were
not aware of the discrep.ncy untll my call. After intern.l
discussions he called me back .nd .tat.d th.t it v.. the position
of the Attorney General that the change wa. only a typographical
error of the Legi.lative Coun.el. Therefore the re.trictive u.e
w.. .till 1n place. 1 told him th.t in my view he would have a
h.rd time ma~ing that position stand up in court in light of the
s_e language in the 1989 Leg1s1.tion and the other two versions in
the 1991 legisletion having the correct language. He acknqwledged
the problem but stated again that that was the position of the
office. He ..id mine was the first call that he had received, but
that he anticipated that he would receive others. I .sked if they
were going to initiate legls1ation to correct thi. problem and he
said that thJt h.d not yet been decided. .
Assuming that this position of the Attorney Oeneral etand.,
the question then is, .. restricted, c.n the asset forfeiture fund
be used to, finanoe the propoaal of Lo. 'adZ'incs. MI'. Cook
indicated that their position has alway. been that the use of such
funds by out.ide organiz.tiona essentially as independent
contractors wes prohibited. The proposed use haa to be und8Z' the
SUpervision and control of the POlice nepariment, foZ' la.
enforcement ~urpo8e. and not u.ed to supplant nonual funding. I
bel1evB that these concerns could be DIet in this instanoe by
entering in~o an agreement with Los Padrlnos 81m11ar to those
agreementa ~.ed for CDSO funds specifying what the use will be,

ty Coalition the opportunity to respond to the
Community Development Block Grant program.
Gang and drug warfare has become an extremely
"deadly" daily topic for the citizens of San
Bernardino.
Los Padrinoi, over the past 20 years of assessing
and implelO1enting youth programs, hu'-designeda
"Gang Intervention Model" for the City of San
Bernardino. This "Gang Inter~ention Hodel" will
strike at the educational, social and economic
needs of "notorious gang members" identified by
the City of San Bernardino Police Department.
Based upon our experience and with a networking of
community agencies, we firmly believe that an
integrated comprehensive approach of this nature
will be highly successful.

GANG INTERVENTION MODEL
- Phase One -
First Year Program
HEED STA TEMENT-
Currently the City of San Bernardino is being inundated with
Gang/Drug Warfare. All law enforcement agencies, City Police Depart-
ment, Sheriffs Department, Probation etc. are searching for solutions
to curtail this increasinq danger to all the citizens of the City of
San Bernardino. In the past two decades, gangs and dru~ activity have
impacted the County of San Bernardino. From middle 80 s to the
present, Gang/Drug violence has escalated to a daily activity (Please
see enclosed Article, Sun Telegram April 2, 1992 "Girl 12, Killed in
Drive-by Shooting"). It is no longer safe to go anywhere at night in
the City of San Bernardino. The expenses associated with one Gang/
Drug activity are astronomical. For example, a typical gang related
drive-by shooting can escalate into:

o A potential life long retaliation by gang member~,-familY~
and innocent victims. .
o The innocent victim's medical, hospital, .and hutial e~-
penses.
o The cost of police investigations; identifying, monitoring
and arresting the assailant.
o Probation, Court, Public Defenders, Prosecutors and Judges;
judicial expenses.
o Incarceration; conviction of a violent crime, 10 year sen-
tence.
This common-place scenario translates to well over $500,000, a
half million dollars, of tax payers money and resources. There
is no question that the Gang/Drug Problem must be ad,dressed in a
comprehensive multi-faceted fashion on a county level - identify
the needs of each city.
Today's anti-gang program cannot compete with the gang members
access to power and influence through drug dealing, and the
enormous generation of cash income. The need to provide a mone-
tary base income for the gang member is a must to compete with
the above. It is imperative that the gang member be instilled
with a vision, that will be supported by proper training (educa-
tional and vocational), motivation, and emotional skills to
become a productive citizen in today's society.
ORGANIZATION CAPABILITY
Los Padrinos and the Community Coalition will utilize a community
network developed over the past twenty (20) years. A viable
network of organizations and agencies, will include but not be

Los Padrinos and the Community Coalition are uniquely qualified
to design and implement the first year of the "Gang Intervention
Model". Since the Early 70's. Los Padrinos established a posture
to identify and infiltrate gang activity and provide viable
alternatives to over 3,000 young adults. "During that time, Los
Padrinos' highly successful gang intervention program had been
documented by private and public entities: San Bernardino County
Probation; Juvenile Court Recidivism Check; California Youth
Authority - "Most Outstanding Youth Service Bureau", 1975; Boy
Scouts of America National Magazine, 1973 (See enclosed article).
Since 1974, Los Padrinos has contracted for multiple Federal,
State, County and City funds to provide needed youth services for
the Inland Empire. Los Padrinos, over the past 17 years 1)f
receiving funding assistance, has complied with all fiscal proce-
dures and program audits set forth through each contractual
obligation.
LOS PADRINOS GANG INTERVENTION MODEL PROJECT
Goals/Objectives
We propose a two year model program. First year statistics and
results will determine the need for expansion of c'ontinued or new
services. This two year model program will be 'able to demon-
strate conclusively the best use of limited resources far combat-
ing drug addiction and gang warfare.
o Identi fy and .sel ect 35 gang members and peers',seven (7)
identified by San Bernardin~ Police Department'as "notori-
ous. active members on probation.
o Provide a two year intervention program for gang members
that would center around: ~e1f esteem, goal setting, spirit-
ual awareness, physical fitness, family and individual
counseling, Drug rehabilitation, community awareriess:
Education preparation (G.E.D.) Job training/placem,ent.',
o Provide a two year model intervention program age's 16-19
that will empower the gang member to realize his/her poten-
tial through self-esteem building individual/family counsel-
ing, life/career goal setting.
o 35 Gang members become drug free and,
are not incarcerated

self-esteem, spiritual guidance, etc.

o Utilize Gents Organization, Latino Peace Officers, and the

activity either as a helpin9 professional or as a prior

bers. Impact other gang members and peers as a prior "noto
rious. gang member through positive role modeling to
diminish peer involvement in drugs and gangs.
