determins if the redevelopment aganey hat complied
with the provl.lona of thi. chapter and Where
applicable, flderal re,ulatiODl. The board shall,
after a publlc hlarina, tranlmit it. flndinas and
recommendatlons to the asency, The members of the
relocation apPlal. board ahall serve without
compenlation, but each of the melllben lhall be
reimbur.ed for hi. neCeslary expenae. incurred ln
performance ot hi. dutlea, as determined by the

All initial relocation deeieions or Irievances will b. appealed to the
Executive Dlreetor of the Development Departm8J1t. In the event the
concerns ara not resolved at thls Ilvel, they wlll be referrad to a
Relocation Appeal. Boards. It, upon review and decidon of the
RIlocatlon ApPlal, Board, pur'Uant to .tate law, the complainant hat
eXb4Ultld all admiuiltrative avenues to resolve thl arievance, the
complainant il then at liberty to Silk rlliet ln a court of law.

(14) member Community Deve10PIIIlllt Advieory Committee, haa been inactive
for SOllie time, primarily a. a reault of thl Alency not IpoDlOrins
project. rlquirina relocation. The Iltuation hel now changed aa
evldencld by the Rencon and Emplre Bay projectl ln particular.

Relocation Appaale Board to addra.s arievance. and disputa. ~ai.ed by
displac..a of the I1edevelopment Agency.
In order to comply with SectioD 33417.5 and Chapter 2.31 of the Municipal
Code, ataff recommend. that the Community Development Commi..ioD adopt a
re.olution authorizing thl Mayor to ree.tablish and appoint a new
Relocation Appeal. Board, .ubject to the approval of the Common Council.
It la recommended tha Board consist of fivI (5) maben, includilll
individuals .erving in positions of thl Deputy Director of the
Development Dlpartment, Development Department A4mini.trative Service.
Manaaer, Dirlctor of Planning and Buildinl Service. the Executive Officer
of thl San Bernardino Board of Realtor., and a private citizen not
currently empl01ed b1 the City or nrving on InJ City COlllllil8ion,
CODlllittee or Ad Hoe body. The alreeDIent to serve has been confirmed by
all propoled board .ambera with the exception of the private citizen, yet
unidentified as of thil writilll.
Attached il the form Resolution Which repeals a previoualy adopted
Re.olution not in harmoll1 with the appropriate lea1l1atioa, The Health
and Safety Codl Section 33417.5 rlquires that .ueh Relocation Appeal.
Board be established b1 the City and the Municipal Code Chapter 2.31
effectively estabUlhu that Board. At thb point in tille, the Mayor,
.ubjact to the approval of the COlIIIDon Council, needs to appoint the
actual Board Membara.

Community Development Citizen. Adviaory COmmittee a. the official
Relocation Appeal. Board, and
WHEREAS, Health and Safety Code 533411.5 requite. that .uch
Relocation Appeals Board be e.tablished by the City, and be made
up of five (5) member. appointed by the Mayor and approved by th~
Common CouncU,
NON, THEREFORE, BE IT RESOLVED THAT SECTION 2 OF RESOLUTION
NO. 4405 IS HEREBY REPBALED.
