direct the Planning and Building Services Department to monitor the
Notice of Violation to ensure compliance at 3075 Belmont Avenue and
approve Tentative Tract No. 14997 subject to the amended Conditions of
Approval, and the Findings of Fact, and Standard Requirements contained
within the Planning Commission Staff Report dated May 19, 1992. (Staff's

: Appeal of the Planning Commission approval of Tentative
Tract No. 14997, to subdivide 3.13 acres into ten (lO)
single-family lots in an area designated by the General
Plan as RL, Residential Low.
Mayor and Common Council Meeting of July 20, 1992
REOUEST
The appellant, Barbara L. Sky, is appealing the approval of
Tentative Tract No. 14997 by the Planning Commission. The
appellant requests that the Mayor and Common Council reevaluate the
approval of the residential subdivision.
BACKGROUND
Tentative Tract No. 14997 is a proposal to subdivide 3.13 acres
into ten (10) single-family lots with a density of 3.18 dwelling
units per gross acre in an area designated by the General Plan as
RL, Residential Low.
On May 19, 1992, the Planning commission held a properly noticed
public hearing on Tentative Tract No. 14997. During the public
hearing, Gary Hartzell, a planner for Sierra Engineering spoke in
support of the project on behalf of the applicant, Robert stone.
Barbara L. Sky, an adjacent homeowner to the proposed tract,
presented testimony for the hearing. She stated that she was not
against the subdivision in principle, but rather felt that the
applicant, Robert Stone was being shown favoritism due to his role
as a Planning Commissioner. She provided documentation of a
previous building permit allegedly incorrectly finaled and she
recommended that the applicant should be required to bring the
property up to existing Municipal (Development) Code standards
prior to initiating additional development (see Exhibit "4",
Attachment "A"). After Ms. Sky's testimony, the pUblic hearing was
closed.

Prior to discussion amongst the Commissioners, Henry Empeno, Deputy
City Attorney, instructed the voting Commissioners that the item
before them was the subdivision of the land and not the Municipal
Code violations that mayor may not exist at the subject property.
A motion was made for subdivision approval, the motion was
seconded, and then was carried by unanimous vote of the six
eligible Commissioners in attendance with Commissioner Stone
abstaining from the hearing.
On June l, 1992, Ms. Barbara L. Sky, submitted an appeal of the
Planning Commission's decision of approval (see Exhibit "l"). The
basis for her appeal is that the Planning Commission did not take
into account all available and pertinent information about the
property and existing structures prior to making their decision.
ANALYSIS
The City Attorney's Office along with Planning and Building
Services and Public Works Departments discussed the appeal in a
meeting beld on June 5, 1992, the outcome of the meeting is
contained within Exhibit "2". The determination made at the
meeting was that no City agency was given the authority to waive
Municipal Code provisions and that the property in question would
be required to meet minimum standards. As a result, the Planning
and Building Services Department has initiated the processing of a
Notice of Violation for the current property owner at 3075 Belmont
Avenue to comply with the residential access provisions in the
Municipal Code.
Under the Notice of Violation provisions, the property owner will
be notified of the Municipal Code violation and then will have 180
days to complete the required improvements to meet current
Municipal (Development) Code standards. If after 180 days, the
improvements are not completed then the owner will be open to
criminal charges with the filing of the citation.

RECOMMENDATION
It is recommended that the Mayor and Common Council deny the appeal
however, based on the Code Enforcement pending action direct the
Planning and Building Services Department to monitor the Notice of
Violation to ensure compliance at 3075 Belmont Avenue and approve
Tentative Tract No. l4997 subject to the amended Conditions of
Approval, and the Findings of Fact, and Standard Requirements
contained within the Planning Commission Staff Report dated May 19,
1992.

I WISH TO APPEAL THE DECISION OF THE PLANNING COMMISSION MEETING
OF MAY 19, 1992, ON ITEM n, KNOWN AS TENTATIVE TRACT NO. 14991.
AT THIS HEARING THE PLANNING COMMISSIONERS WERE TOLD THEY COULD
ONLY MAKE THEIR DECISION ON THE ISSUE OF THE TENTATIVE TRACT, AND
NOT TO CONSIDER THE CODE VIOLATIONS, THAT THEY WERE NOT PART OF
THE PLANNING PROCESS.
PUBLIC WORKS PULLED ~ COMPLAINT OF CODE VIOLATIONS FROM CODE
ENFORCEMENT. ~~ WAS WORKING A DEAL WITH THE STONES. AT THAT
TIME THESE VIOLATIONS BECAME PART OF THE PLANNING PROCESS, AND
THE PLANNING COMMISSIONERS SHOULD HAVE HADE THEIR DECISIONS BASED
ON ALL THE TESTIMONY THEY HEARD, !NCLUDING THE CODE VIOLATIONS.
I FEEL MY RIGHTS WERE VIOLATED. AS A CITIZEN I HAD A RIGHT TO A
HEARING ON THESE VIOLATIONS. I FOLLOWED THE SYSTEM AND FI~D A
CODE VIOLATION WITH CODE ENFORCEMENT TO HAVE A HEARING BEFORE THE
BOARD OF BUILDING COMMISSIONERS. PUBLIC WORKS VIOLATED MY RIGHT
TO A HEARING BY PULLING THIS CLAIM OF CODE VIOLATIONS. WHEN DO
I GET THE PROPER HEARING ON THESE CODE VIOLATIONS??
WHERE DOES THE SAN BERNARDINO MUNICIPAL CODE GIVE PUBLIC WORKS
THE AUTHORITY TO CHANGE CONDITIONS AND GRANT SPECIAL FAVORS.
EVEN THOUGH THIS WAS A SINGLE FAMILY RESIDENCE, IT HAD CONDITIONS
AT THE TIME OF APPROVAL. ONLY THE MAYOR AND COMMON COUNCIL HAVE
THE POWER TO MAKE CHANGES TO CONDITIONS PUT ON BUILDINGS. I
BELIEVE PUBLIC WORKS OVER STEPPED THEIR AUTHORITY.
TENTATIVE TRACT NO. 14991 DOES NOT MEET ALL THE DEVELOPMENT
STANDARDS OF THE MUNICIPAL (DEVELOPMENT) CODE. IT HAS AN ILLEGAL
HOUSE SITTING ON LOT #1. THIS HOUSE HAS NEVER RECEIVED FINAL

CONDITION, POWER TO THE HOUSE WAS THROUGH A 300 FOOT EXTENSION
CORD FROM ~. STONES HOUSE TO BROTHERTON'S HOUSE.
THESE VIOLATIONS ~ST BE ADDRESSED, AND THE STONES MUST BE
TREATED LIKE EVERYONE ELSE IN THE CITY AND NOT SHOWN SPECIAL
FAVORS. THESE VIOLATIONS SHOW THEIR TOTAL DISREGARD FOR THE
LAW, AND PUTS THE CREDIBILITY OF THE CITY ON THE LINE.

TENTATIVE TRACT THROUGH THE PLANNING PROCESS, THEY WOULD IGNORE
THE CONDITION OF THE DRIVEWAY.
IF AND WHEN THIS TRACT IS APPROVED IT CAN SIT FOR SEVERAL YEARS WITH
NO CONSTRUCTION. THE CITY CANNOT IGNORE THESE VIOLATIONS ANY
LONGER. ADDITIONAL CONDITIONS MUST BE PUT ON THIS TRACT ADDRESSING
A TIME LIMITATION FOR CONSTRUCTION TO START, AND EITHER THE STREET
OR THE DRIVEWAY MUST BE IN PLACE. MAKE THE OWNERS POST A BOND, SO
IF THE CONSTRUCTION HASN'T STARTED, OR IF THE STREET OR DRIVEWAY
ISN'T IN, IN THE TIME ALLOTTED, THE CITY CAN PROCEED WITH IT, AND NO
EXTENSION OF TIME ALLOWED FOR THESE CONDITIONS.
THE CITY OF SAN BERNARDINO IS NOT SETTING A GOOD EXAMPLE TO THE
PUBLIC WHEN THEY ALLOW A PLANNING COMMISSIONER TO EXEMPT HIMSELF
FROM CONDITIONS HE PUTS ON OTHERS. I FEEL THIS IS OPENING UP
THE CITY TO LAWSUITS, AND I RESENT THAT FACT, BECAUSE IN THE END,
IT'S THE CITIZENS w~O END UP PAYING FOR THE CITY'S MISTAKES.
I LOOK FORWARD TO THE OPPORTUNITY TO BRING THESE ISSUES BEFORE THE
MAYOR AND COMMON COUNCIL.

Dear Mr. stone:
On June 5, 1992, the City's Public Works, and Planninq and Building
Services staff met with Henry Empeno of the City Attorney's Office
to discuss Barbara Sky's appeal of your tentatiVe tract to the
Mayor and Common Council. This discussion focused on two issues.
They were:
1. Under what authority did Public Works Department (City
staff) administratively waive a Municipal Code provision?
2. Can the City impose additional conditions of approval to
a tentative tract after the Planning commission approval?
The followinq is the result of the discussion of these two issues:
In response to Issue Number One (1), there is no administrative
authority to waive Municipal Code requirement for the installation
of a required driveway. The efforts by city staff to work with you
to resolve the driveway issue was not a waiver, but only an
indication that the City would not pursue prosecution and/or
require the house to be vacated while you were seeking an
alternative way (an approved subdivision and related public street)
for resolvinq the driveway issue. This agreement to not prosecute
or require vacation of the house was not an open ended way of
avoidinq the construction of the required driveway. Therefore, if
your subdivision is approved (as an alternative to construction of
,the driveway), it would be appropriate for the City to direct you
to either install the drive, remove the house, or build a
subdivision street within a reasonable period of time.
In response to Issue Number Two (2), the City has the authority to

impose additional conditions of approva~ to a tentative tract after
Planning commission approval in two (2) instances:
a. When the condition is agreed to by the tentative tract
applicant and land owner.
b. When the condition is imposed by the Mayor and Council as
part of the tentative tract approva~ being appea~ed to
the Mayor and Counci~.
Additionally, discussion centered around what were and are the
City's driveway construction standards.
The Code in 1986 stated:
"19.56.010 Parking Space Requirements
D. Access shall be provided by means of a paved
driveway whicb should be not less than 15 feet wide
for a one-way dr~ve and not less than 24 feet wide
for a two-way drive."
"19.56.380 Aspbaltic Concrete Surfacing or Paving
All areas sha~l be surfaced or paved with asphaltic
concrete, concrete, or other bitulithic surfacing
acceptable to the Commission and thereafter be
maintained in good condition."
Based upon the foregoing section, in 1986, the drive sbould have
been 24-feet wide and constructed of the appropriate thickness of
aspha~ t or concrete for a distance of 380 feet from Belmont to the
house.
The City's current standards are from the city's Development Code
and Fire Code.

All driveways and parking areas shall be

structural section of slag or other material
may be approved by the City Engineer and
Director =or storage area of industrial uses,
provided that toxic or 'hazardous

B. -Fire Code Section 10.207
(b) Where Required
Fire apparatus, access read shall be required for
every building hereafter constructed when any
portion of exterior wall of the first story is
located more than J.50 feet from Fire Department
vehicle access (public read).
(c) Width
Tbe unobstructed width of a fire apparatus road
shall be not less than 20 feet.
(f) Surface
Fire apparatus access read shall be designed and
maintained to support the imposed loads of fire
apparatus and shall be provided with a surface so
as to provide all weather drivinq capabilities.-
Tbe current codes could be interpreted to allow a driveway 20 feet
wide constructed with a minimum of 6 inches of compacted crushed
reck with an approved bituminous surface treatment/sealant for
approximately 380 feet from Belmont Avenue to the house identified
as 3045 Belmont Avenue.
Based upon the above information, would you be agreeable to addinq
a condition to your tentative tract that, within six months of
tentative tract approval, you would construct a driveway meetinq
current city standards or construct the street as shown on your
approved tentative tract. It is my understanding that Barbara Sky

might be willing to withdraw ~er appeal to the Mayor and Council
based upon the addition of this condition to your tentative tract.
Regardless of your willingness to add the above condition to your
tentative tract, the city will follow up af~er resolution of Ms.
Sky's appeal with a standard Notice of Violation. This notice will
request your compliance with city standards for construction of the
driveway within a reasonable, but limited, period of time.

BACKGROUND
At the Planning Commission meeting of April 21, 1992, the applicant
requested a continuance as he did not have representation present
for the meeting. The Planning commission granted a one-montb
continuance to its May 19, 1992 meeting for Tentative Tract No.
14997, a request to subdivide 3.13 acres into ten (10) single-
family lots in an area designated by the General Plan as RL,
Residential Low.
On April 20, 1992, Planning staff received a six page letter from
an adjacent homeowner who questioned whether favoritism was being
shown to the applicant, Robert Stone (see Attachment "A"). The
letter details a series of violations that have allegedly occurred
on the Stone's property. The homeowner is questioning whether the
subdivision should be approved given that there appears to be
outstanding code violations.
On a separate issue, the adjacent homeowner called Planning staff
after reading the staff report prepared for the April 2l, 1992
meeting to inquire about the proposed wall which is to separate the
subject property from their land. During the December 5, 1991,
Development Review Committee public meeting, the homeowner
requested that a solid decorative block wall be constructed along
,the eastern perimeter of the subject property to separate the
higher density RL, Residential Low subject site from the lower
density RE, Residential Estate properties to the east. At the
time, the owner/applicant agreed to provide the solid screening.
At a previous meeting, the Police Department indicated that they,
would prefer a wall that provided some visibility to the rear yards
for security and safety purposes.

ANALYSIS
There are two separate issues raised by the adjacent homeowner.
The first issue is whether or not the subdivision can be approved
and the second issue involves the design details of the perimeter
wall. The subdivision as proposed does not make allowances for the
retention of the two existing homes in their present locations.
Two Conditions of Approval were written to address the existing
above-ground and below-ground structures currently on-site.
Condition of Approval No. 11 specifies that the owner shall remove
the existing septic tanks and all associated substructures
completely from the property prior to map recordation. Condition
of Approval No. 12 states that the owner shall remove both
dwellings and any accessory structures prior to map recordation and
that the removal, relocation and/or demolition shall comply with
all applicable city standards in effect at the time (see Attachment
"B").
The second issue involves the eastern section of the perimeter
wall. The homeowner is correct that the recorded tape during the
open public meeting section for the December 5, 1991, Development
Review Committee meeting includes a statement from the applicant
stating that it would be his preference and he would have no
problem at all with a solid wall.
As a compromise between the Police Department, the applicant, the
adjacent homeowner and Development Code standards, Planning staff
is proposing that a 6-foot high wall with decorative block and
decorative capping be constructed along the eastern property line.
Tbe decorative block wall shall be designed with pilasters provided
at every change in direction, every 5 foot difference in elevation
and at a minimum of every 25 feet of continuous wall. The wall
when facing rear yards shall include a minimum of one deco::'ative
porthole (minimum size of 4 inches by 4 inches) for each lot for
security (see Attachment "B"). The side yards of lots 1, 5, 6 and
10 forming the perimeter of the subdivision should continue the
eastern wall design pattern or select a compatible design.
CONCLUSION
Tentative Tract No. 14997 meets all of the development standards of
the Municipal (Development) Code and is consistent with the General
Plan and the Subdivision Map Act. Impacts associated with the
development of the project will be mitigated and reduced to a level
of insignificance througb Conditions of Approval and Standard
Requirements. There is a proposed Negative Declaration.

l. Adopt the Negative Declaration: and,
2. Approve Tentative Tract No. 14997, subject to the amended

The applicant is requesting approval to subdivide 3.l3 acres into
ten (lO) single-family lots in an area desiqnated by the General
Plan as RL, Residential Low. The General Plan land use desiqnation
permits a maximum density of 3.1 dwellinq units per qross acre and
requires a minimum lot size of lO,800 square feet.
SITE LOCATION
The subject property is a rectangularly-shaped parcel of land
having a frontaqe of about 335 feet on the south side of Belmont
Avenue and beinq located about 370 feet west of the centerline of
Palm Avenue and beinq further described as 3045 and 3097 Belmont
Avenue (see Attachment "B", Location Map).

MUNICIPAL (DEVELOPMENTl CODE AND GENERAL PLAN CONFORMJ.NCE
The application was submitted on February l2, 1991 and deemed
complete on September 19, 1991. The project was reviewed in
conformance with the Municipal (Development) Code provisions. The
proposed subdivision was found to be consistent with the Municipal
(Development) Code and in conformance with the General Plan as
shown in Attachment "A".
CALIFORNIA ENVrRONMENTAL OUJ.T.T'I'V ACT STATUS
The Initial Study was prepared by staff and presented to the
Environmental Review COlIIIIli.ttee (ERC) on October l7, 1991. The ERC
found that no significant impacts would result fram the project and
recommended a Neqative Declaration be adopted. The Neqative
DeClaration was advertised and available for public review and
comment from October 24, 1991 to November l3, 1991. To date, no
comments on the Initial Study have been received. If comments are
received referencinq this project, they will be presented to the'
Planning COlIIIIli.ssion at the April 21, 1992, Planninq Commission
meetinq (see Attachment "E", Initial StUdy).

BACKGROUND
The subject parcels are a result of three previous subdivisions
filed with the Planninq and Building Services Department. The
first parcelization approved by the Planninq Commission on August
5, 1975 was Minor Subdivision No. 309 (MS No. 309). This map
permitted the division of one existing parcel at the corner of Palm
and Belmont Avenue into two separate lots. The rear parcel which
was desiqnated Parcel No. 1 is the property now in question. The
second subdivision (Minor Subdivision No. 332) was approved on July
20, 1976. This application qranted approval to split Parcel No. 2
of MS No. 309 into two equal parcels which could then front onto
Palm Avenue. The most recent subdivision involving the subject
parcels was in 1979. Minor Subdivision No. 530 permitted the
further subdivision of Parcel No. 1 of MS No. 309 into two lots.
The resultinq configuration was one rectangular lot consistinq of
one acre and a "L" shaped lot comprised of about 2.13 acres. The
approval was qranted by the Planninq Commission on December 4,
1979.
ANALYSIS
Si~. Charac~.ristics
The project si~e is roughly rectangular in shape and con~ains two
parcels of land which consis~ of about 3.l3 acres. Each parcel of
land is currently occupied by one existinq sinqle-family dwellinq.
Each dwelling is connected to an existinq septic tank with an
associated overflow leach field. The proposed lot layout does not
accommodate the retention of the two existing dwellinqs, therefore,
the dwellinqs shall be removed prior to tract map recordation.
The toPoqraphy of the site is relatively flat and slopes in a
southerly direction at a qrade of approximately five percent.
Veqetation on site consists of a row of ornamental olive trees near
the northern boundary of the site, and some seasonal weeds and
other native veqetation.
Lo~ Charac~.ristics
The tenta~ive tract will create ten (lO) sinqle-family lots,
ranqing in size from ll,400 square feet to l2,340 square feet with
a proposed density of 3.l8,dwellinq units per qross acre. The
General Plan land use desiqnation permits a maximum density of 3.l
dwellinq units per qross acre and requires a minimum lot size of
10,800 sguare feet. The proposed Subdivision meets or exceed all
the minimum Municipal (Development) Code requirements for lot
width, depth and total area (see Attachment "G", Tentative Tract
Map).

The site is bordered by existing houses and graded lots on the
north, east and west and to the south is a vacant field. The
surroundinq residential properties to the north and west are
desiqnated RL, Residential Low and the properties to the east and
south are presently desiqnated as RE, Residential Estates (see
Attachment "H", Location Map).
Traffic
The City Traffic Engineer reviewed the proposed subdivision and
determined that the project did not meet the minimum criteria for
a traffic impact study. The additional trips from the proposed
project are not sufficient to cause a siqnificant impact on the
adjacent street system.
Acee.. and CirCUlation
The site has frontage along the south side of Belmont Avenue of
approximately 335 feet and is located about 370 feet west of the
centerline of Palm Avenue. Tentative Tract No. l4997 proposes to
utilize Belmont Avenue as its primary access for all lots. Belmont
Avenue is classified as a collector with a right-of-way of 60 feet.
The ten lots will take access to Belmont Avenue by way of an
interior street tentatively named "Royal Oak Avenue". The proposed
street has been desiqned to have a temporary turn-around until such
time that the property is connected to the parcel to the south.
DraiJUlqe and water/S_er Xnfra.trueture
The applicant's engineer is proposinq to convey the on-site
drainaqe runoff southerly alonq the proposed street to be
intercepted by a future tract to the south and then toward
Xrvinqton Avenue. If the future tract at the southern boundary is
not in place at the time of development, an alternate method of
conveyance will be subject to the review and approval of the
Planninq and Buildinq Services and Public Works Departments.
The desiqn of the tentative tract proposes a 25-foot wide easement
for water and sewer throuqh the southerly property in the event
that a dedicated street is not in place prior to developinq the
subject site. The adjacent property owners have furnished Letters
of Intent to the city to declare their intent to qrant the
applicant an easement for sewer, water and drainage purposes. In
addition, the owners of the southern property have declared their
intent to qrant the City dedication for a 50-foot wide roadway for
access purposes. The Letters of Intent also include a declaration
of intent to permit easements for slopes and qradinq (see
Attachment "F").

Bnvirolllll_tal Concerns
The proposed subdivision is mapped in the General Plan as beinq
within the boundaries of the Bioloqical Resources Manaqement
OVerlay District, the High Wind Hazard Area, and a potential
Archaeoloqical Area.
A Bioloqical Survey was prepared for the site by Lilburn
Corporation on August 29, 1991. The repor:t concluded that no
threatened, endangered, or sensitive spec~es of wildlife or
veqetation were found and that none were thouqht to be present on
the subject property. Additionally, a row of ornamental olive
trees exists near t.'1e northern project boundary. The applicant has
indicated that the l2 trees delineated in proposed Lot 1 and the 3
trees in proposed Lot lO are to remain on-site in their current
location. One ornamental tree located in the proposed street
riqht-of-way will be removed with the development of the
infrastructure. Kim Burqett, Parks Maintenance Supervisor visited
the property for an on-site evaluation and determined that the loss
of the sinqle non-native tree would not be considered a siqnificant
impact.
The site is located in a hiqh wind hazard area, Standard
Requirements and Conditions of Approval from the Planninq and
Buildinq Services Department pertaininq to buildinq exposure and
orientation, and buildinq roof construction usinq 110 MPH winds
shall serve to reduce potential wind impacts to a level of
insiqnificance.
The San Bernardino County Huseum Arcbaeoloqical Information Center
evaluated the proposed project site and determined that no
cultural resources are known to exist within or adjacent to the
project area and that the potential for the presence of cultural
resources within the project area is low. No further studies were
recommended.
COHMENTS RECEIVED

All City Departments reviewed the proposal at the Development
Review Committee meeting on December 5, 1991. The Public Works/
Enqineering, Police, Fire and Water Departments have attacbed
Standard Requirements (see Attachment "0").

Southern California Edison Company replied that the developer will
be required to furnish them two (2) copies of the final map,
including title sheets, no later than two (2) weeks prior to tract
recordation. Tbe subdivider shall comply with all current
regulations and rules of the Southern California Edison Company as
filed with the Public utilities commission for the installation of
underground or overhead electric utilities within the tract.
Southern California Gas company
Southern California Gas company responded to the availability of
natural gas service for the project. They indicated that the
nearest gas service to the site could be provided from a 6-inch
main at the intersection of Belmont and Palm Avenues.
u.s. Postmaster
The United States Postal Service requests that the final map shall
show easements or other mapped provisions for the placement of
centralized mail delivery units. Specific locations for such units
shall be to the satisfaction of the Postal Service and the Public
Works Department.
CONCLUSION
Tentative Tract No. l4997 meets all of the development standards of
the Municipal. (Development) Code and is consistent with the General
Plan and the Subdivision Map Act. Impacts associated with the
development of the project will be mitiqated and reduced to a level
of insiqnificance through Conditions of Approval and Standard
Requirements. There is a proposed Negative Declaration.

1. Tentative Tract No. l4997 is consistent with the General
Plan in that it meets all standards of the General Plan
and Municipal (Development) Code as they pertain to the
Subdivision of property in the RL, Residential Low.
General Plan land use designation~
2. The site is physically suitable for residential
development in that the division of land is consistent
with the provisions of the Subdivision Map Act and the
proposed lots to be created are compatible in design with
surrounding developments, the lots contain sufficient
buildable area and they are each adjacent to a dedicated
roadway.
3. The proposed lot density of 3.l8 dwelling units per gross
acre is consistent with the RL, Residential Low permitted
density of 3.l dwelling units per gross acre.
4. The lots created are not likely to cause substantial
environmental damage or substantially and unavoidably
injure fish and wildlife or their habitat as an Initial
Study has been prepared for the project and the ERC found
that no significant impacts would result from the project
and recommended a Negative Declaration be adopted as all
potential impacts could be reduced to a level of
insignificance.
5. The design of the subdivision is not likely to cause
serious public health problems in that there is existing
and proposed infrastructure to provide service to the
proposed lots.
6. The design of the Subdivision will not be in conflict
with eas_ents, acquired by the public at large. for
access through or use of, property within the subdivision
in that the lots are of buildable size and have dedicated
access to Belmont Avenue by proposed Royal Oak Avenue and
the legal owners of record have offered to make all
dedications required to the City of San Bernardino.

1. within two years of this approval, the filing of the final map
or parcel map with the Council shall have occurred or the
approval shall become null and void. Expiration of a
tentative map shall terminate all proceedings and no final map
or parcel map shall be filed without first processing a new
tentative map. The city Engineer must accept the final map or
parcel map documents as adequate for approval by Council prior
to forwarding them to the City Clerk. The date the map shall
be deemed filed with the Council is the date on which the City
Clerk receives the map. The review authority may, upon

2. In the event that this approval is legally challenged, the
City will promptly notify the applicant of any claim or action
and will cooperate fully in the defense of the matter. Once
notified, the applicant agrees to defend, indemnify, and hold
harmless the city, its officers, agents and employees from any

Bernardino. The applicant further agrees to reimburse the
City of any costs and attorney's fees which the City may be
required by the court to pay as a result of such action, but

The developer is to submit a complete master landscape and
irrigation plan (5 copies) for the entire development to the
Engineering Department with the required fee for approval.
The landscape plans will be forwarded to the Parks, Recreation
and Community Services and the Planning Division for review
and approval. (Note: the issuance of a building permit, by the
Building Services Division of the City of San Bernardino, does
NOT waive these requirements/conditions.) No grading permits
will be issued prior to approval of landscape plans.
The design shall include, but not be limited to the following:
a. street trees shall be planted on 30 foot center spacing
unless otherwise indicated by the Department of Parks,
Recreation and Community Services. The Parks Department
shall determine the varieties and locations prior to
planting. All trees shall be 24" box specimens. Trees'
are to be inspected by a Park Division representative
orior to planting.
b. The landscape and irrigation plans shall comply with the
"Procedure and Policy for Landscape and Irrigation"
(available from the Parks Department).
5. Trees, shrubs and groundcover of a type and quality generally
consistent or compatible with that characterizing single-

irrigation system adequate to insure their viability. The

7. This permit or approval is subject to all the applicable
provisions of the Development Code in effect at the time of
approval. This includes Chapter 19.20 (Property Development
Standards), and includes: dust and dirt control during
construction and grading activities; emission control of
fumes, vapors, gases and other forms of air pollution; glare
control; exterior lighting design and control; noise control;
odor control; screening; and vibration control.
This requirement also includes any applicable Land Use
District Development Standards for residential, commercial and
industrial developments regarding minimum lot area, minimum
lot depth and width, minimum setbacks, maximum height, maximum
lot coverage, etc.
8. A Composite Development Plan (CDP) shall be filed with the
Public Works and Planning and Building Services Departments
prior to Final or Parcel Map processing by the City. The CDP
shall provide additional survey and map information including,
but not limited to building criteria (i.e. setbacks), flood
control criteria, seismic and geological criteria,
environmental criteria and easements of record. The CDP shall
be labeled with the title "Composite Development Plan" and
contain a section entitled "CDP Notes". The applicant shall
have listed under the CDP Notes section the following
conditions or mitigation measures required for the development
of the subject property: Conditions of Approval No. 1-19.
9. The developer will be required to furnish Southern California
Edison Company two (2) copies of the final map, including
title sheets, no later than two (2) weeks prior to tract
recordation. The subdivider shall comply with all current
regulations and rules of the Southern California Edison
Company as filed with the Public utilities Commission for the
installation of underground or overhead electric utilities
within the tract.
10. The developer shall identify specific locations for
centralized mail delivery units to the satisfaction of the
Postal Service and PUblic Works Department and shall delineate

11. The owner shall remove the existing septic tanks and all
associated substructures completely from the property prior to
map recordation in conformance with all applicable standards
and subject to the appropriate permits and approvals.
l2. The owner shall remove both dwellings and any accessory
structures prior to map recordation. The removal, relocation
and/or demolition shall comply with all applicable standards
in effect at the time.
13. The developer shall pave the temporary turn-around to full
radius and shall mark the turn-around with a no parking
restriction.
14. The owner shall retain all fifteen trees delineated on the
site plan in proposed Lot 1 and proposed Lot 10. The one

19. The developer shall construct a perimeter wall around the
subdivision with the exception of the western project boundary
of lots 1 through 5 lying adjacent to the existing 6 foot high
block wall.
20. The 6-foot high perimeter wall shall be constructed with
decorative block and decorative capping. The decorative block
wall shall be designed with pilasters provided at every change
in direction, every 5 foot difference in elevation and at a
minimum of every 25 feet of continuous wall.
21. The proposed perimeter wall when facing rear yards shall
include a minimum of one decorative porthole (minimum size of
4 inches by 4 inches) for each lot for security.

NOTE TO APPLICANT: Where separate Engineering plans are required, the
applicant 1S responsible for submitting the Engineering plans directly

Drainage and Flood Control
All necessary drainage and flood control measures shall be

Design and construct all public utilities to serve the site in
accordance with City code, City Standard and requirements of the
serving utility, including gas, electric, telephone, water, sewer
and cable TV.
Each parcel shall be provided with separate water and sewer faci-
lities so it can be served by the City or the agency providing
such services in the area.
Sewer main extensions required to serve the site shall be con-
structed at the Developer's expense. Sewer systems shall be
designed and constructed in accordance with the City's "Sewer
Policy and Procedures" and City Standard Drawings.
Uti 1 i ty servi ces shall be pl aced underground and easements pro-
vided as required.
Sewers within private streets or private parking lots will not be
maintained by the City but shall be designed and constructed to
City Standards and inspected under a City On-Site Construction
Permit. A private sewer plan designed by the Developer's Engjn-
eer and approved by the Ci ty Engi neer wi 11 be requi red. Thi s
plan can be incorporated in the grading plan, where practical.
A "communication Conduit" shall be installed in all streets with-
in and adjacent to this project. The conduit shall be dedicated
to the City and its pI imary use shall be for Cable TV installed
by the Cable TV Company under permit from the City of San Bernar-
dino.

Initial Study for Tentative Tract No. 14997 which is an
application to subdivide 3.l3 acres into lO single family
residential lots.
As stated in section 15063 of the California Environmental

2.0 PROJECT DBSCRIPTION
The applicant's request is to subdivide 3.13 acres into 10
single family residential lots in the RL, Residential Low,
General Plan land use designation located on, the south side
of Belmont Avenue avout 370 feet west of Palm Avenue. The RL
desiqnation permits detached single-family residential
development at a density of 3.1 dwelling units per gross acre.
The applicant's proposal is 3.l8 dwelling units per acre.

2.1 Project site and surrounding Area Characteristics
The project site is roughly rectangular in shape and contains
two parcels of land which consists of about 3.13 acres. The
site is partially developed with two single family dwellings.
The topography of the site is relatively flat and slope in a
southerly direction at a grade of approximately five percent.
Vegetation on site consists of a row of ornamental olive trees
near the northern boundary of the site, and some seasonal
weeds and other native vegetation. Soils on site tend to be
coarse and sandy.
The site is bordered by existing houses and graded lots on the
north, east and west and to the south is a vacant field.
3.0 ENVIRONMENTAL ASSESSMENT
3.1 Environmental setting
The amendment site has a number of environmental constraints.
It is located in the Biological Resources Management District,
the High Wind Hazard Area, and an potential Archaeological
Area.

C. DISCUSSION OF ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES
1. BUR RBSOURCBS
h. The development of the site could result in soil erosion on
or off the property. Proper grading and erosion control,
including the prevention of sedimentation or damage to off-
site property shall be in compliance with the standards
outlined in Chapter 15 of the Municipal Code and the
Subdivision Map Act Section 66411.
2. AIR RESOURCES
c. The site is located in a high wind hazard area, Standard
Requirements and Conditions of Approval from the Planning and
Building Services Department pertaining to building exposure
and orientation, and building roof construction using 110 MPH
winds shall serve to reduce potential wind impacts to a level
of insignificance.
3. WATER RESOURCES
a. The nature of the project, Le. grading, construction of
streets and driveways, may result in some environmental
impacts relating to absorption rates, drainage patterns and.
the rate and amount of surface runoff due to the loss of
permeable surfaces. The applicant's engineer is proposing to
convey the on-site runoff southerly along the proposed street
to be intercepted by a future tract to the south and then
toward Irvinqton Avenue. If the future tract at the southern
boundary is not in place at the time of development, an
alternate method of conveyance will be subject to the review
and approval of the Planning and Building Services and Public
Works Departments.
4. BIOLOGICAL RESOURCES
a. The site is located in the Biological Resources Management
OVerlay. A Biological Survey was prepared for the site by
Lilburn Corporation on August 29, 1991. The report concluded
that no threatened, endangered, or sensitive species of
wildlife or vegetation were found and that none were thought
to be present on the subject property.
d. A row of ornamental olive trees exists near the northern
project boundary. The applicant has indicated that the 12
trees delineated in proposed Lot 1 and the 3 trees in proposed
Lot 10 are to remain on-site in their current location. One
ornamental tree located in the proposed street right-Of-way
will be removed with the development of the infrastructure.
Kim Burget, Parks Maintenance Supervisor visited the property
for an on-site evaluation and determined that the loss of the
single non-native tree would not be considered a siqnificant
impact.

7. DH-DDB HAZARDS
a. The site contains two existing septic tanks and related leach
fields. The developer shall comply with the regulations
outlined in the Uniform Plumbing Code Chapter 11, Section 1119
- Abandoned Sewers and Sewage Disposal Facilities if the
development of the site does not impact their present
locations. The developer shall fill all abandoned facilities
within 30 days from the time of connecting to the public
sewer. Based on the design of the subdivision, it appears
that it is not feasible to plug or cap the existing septic
tanks in their present locations rather they will need to be
removed completely from the property in conformance with all
applicable standards and subject to the appropriate permits
and approvals.
13. CULTURAL RESOURCES
a. The site lies within an archaeologically sensitive area. The
San Bernardino County Museum Archaeological Information Center
evaluated the proposed project site and determined that no
cultural resources are known to exist within or adjacent to
the project area and that the potential for the presence of
cultural resources within the project area is low. No further
studies were recommended.

RE: Appeal of T.T. 14997 and letter dated 6-15-92.
This letter is in response to your correspondence dated
6-15-92 and the appeal which has been filed against our
project, Tentative Tract No. 14997.
First, we feel that the issue involving the existing
structure located at the south portion of the project area
has no relevance with respect to the approval and/or denial
of the pending tentative tract map application. We have
clearly complied with all of the requirements of the City's
Development Code and the State Subdivision Map Act. We have
also taken a responsible position with regards to
negotiating off-site public dedications and utility
easements with adjacent property owners. This has taken an
extended amount of time and effort.
Regarding the existing structure and the pending code
violation, it is important to note the following facts:

owned by separate individuals as follows:

2. The structure which is the main subject of your letter
dated 6-15-92 is owned by Bernice H. Brotherton and is
contained totally within Parcel No. 261-142-16.
3. Several individuals, including Mr. Robert Stone, have
been involved with assisting Mrs. Brotherton with the
handling of her affairs over the past several years due
to her health and recently the death of her husband in
June of 1991.

4. The development of the property was determined to be the
best method of achieving the highest value for the land
at time of sale. The sale of the property is in keeping
with a family law judgement which occurred in January
16, 1989 between, (at that time), Mr. and Mrs. Robert
stone.

Although we recognize the responsibility of land owners to
comply with the City's codes and standards, it seems wasteful
and definitely presents a hardship to Mrs. Brotherton to
comply with the request to install a driveway at this time.
This is especially true since the city is requiring the
removal of the house from the property before the final map
can be recorded.
The driveway installation, at a minimum, would cost
approximately $3,000.00 to install and would prove to be an
insignificant upgrade to the existing condition which is
merely an extension of a highly compacted, legal, dirt
drive which has been utilized daily for the past twenty
years. Beside the fact that the improvements will be short
term, Mrs. Brotherton must maintain her household on a fixed
income of $714.00 a month.
Please understand that we are not the type of individuals who
practise "throwing stones", however, there are other issues
and existing circumstances which are in need of the City's
attention and well worth the time and trouble to do so. with
the current state of our economy and social values, it would
be a kind and humble action if the city would see the
practical aspect of this dilemma and act accordingly.
Our request of the Mayor and Common Council is to uphold the
recommendation of the Planning Commission and deny the
request for appeal. Further, if not in conjunction with the
appeal action at a subsequent hearing, grant Mrs.
Brotherton relief from the code violation for the
installation of the driveway due to both her physical and
economic hardship.

This notice is given to you as owner of the above-referenced
property.
BACKGROUND
The house at 3075 Belmont Avenue, constructed in 1984 under
Building Permit No. 58670, was never completed to City code
standards. This situation was discovered by the City in 1989 when
code officers visited the site in response to a citizen's complaint
concerning abandoned vehicles, junk and debris on the property.
This inspection, in addition to discovering property maintenance
violations, found that the house did not have an adequate
electrical service and access drive as required by City code. The
inadequate electrical service has been corrected (I believe by
December 1989). The required driveway, however, has not been
constructed in accordance with City code standards.
As owner, you are advised that the property exists

Driveways for an attached two-car garage shall have
a minimum width of 16 feet and a minimum length of
24 feet measured from the inside sidewalk or apron
to the front of the garage.
18. Surfacing
All driveways and parking areas shall be surfaced
with a minimum thickness of three inches of
asphaltic concrete, concrete, or other City
approved bituminous surfacing over a minimum
thickness of four inches of aggregate base
material. An appropriate structural section of
slag or other material may be approved by the city
Engineer and Director for storage area of
industrial uses, provided that toxic or hazardous
materials,...are not located in such storage
areas."

(b) Where Required
Fire apparatus, access road shall be required for every
building hereafter constructed when any portion of
exterior wall of the first story is located more than 150
feet from Fire Department vehicle access (public road).
(c) Width
The unobstructed width of a fire apparatus road shall be
not less than 20 feet.
(f) Surface
Fire apparatus access road shall be designed and
maintained to support the imposed loads of fire apparatus
and shall be provided with a surface so as to provide all
weather driving capabilities."

CORRECTIVE ACTION
You have a total of 180 days to obtain City approval of the design
and location of the driveway; and to construct the driveway in
accordance with city code standards (by January 10, 1993). Your
failure to correct this code violation could lead to (Option No.1)
a code violation case being filed in court, seeking a dollar fine
to compel compliance or (Option NO.2) the City constructing the
driveway and billing you for the cost of construc~on. The City's
third option to compel compliance would be the evacuation of the
house. This third option, however, is not applicable because there
is not an immediate health or safety issue involved.
An appeal of the Department's determination of code violation may
be made to the Planning Commission within 15 days of receipt of
this letter. An appeal must be filed in writing with the
Department of Planning and Building Services at 300 N. "D" Street,
Third Floor, City Hall, San Bernardino, California 92418. A fee
of $110 must accompany your request. Your written appeal must
include:
1. Reference address of the house.
2. Specific grounds of appeal (what alternative meaning can
be given to the specific code sections.
3. What relief is being sought and the legal grounds for the
relief.
