The revised motion should read as follows: That the Community Development Commission approve the conceptual development plan of the public square located at Court and "E" Streets and authorize the Executive Director to enter into a contract for' engineering and design services with the firm of SD Engineering & Associates at a cost not to exceed $14,885. As discussed in the report, the Engineering bids were not returned by the date the agenda report was prepared. On July 2, 1992 the Development Department received four Engineering bids in response to the Invitation To Bid. The four bids ranged from $14,885 to $29,990 and were all from responsible firms. The Invitation To Bid requested proposals for the costs to prepare engineering and construction drawings for the Public Square at the Court and "E" Streets parking lot and City Hall upper plaza. The drawings are to include the four stages consisting of demolition, improvements, planting and irrigation as presented in drawings prepared by Project for Public Spaces. '" /- ..........~. , 0 DEVELOPMENT DEPARTMENT OF TIlE CITY OF SAN BERl'IAIUlINO STAFF REPORT ImD1ementation of Short Tel'll Downtown Pro1ects Backllround Projects for Public Spaces (PPS) is the Commission approved consultant retained for the development of a downtown urban plan. On May 4, 1992, the Community Development Commission awarded two contracts to PPS for the development of short-term improvement projects (EDA-92-C004) and for creation of marketing drawings for the Rancon/Superb1ock site (EDA-92-COOS). These contracts were awarded as a result of the findings developed by PPS resulting from surveys and Town Hall meetings regarding the Downtown Plan. Surveys, and interviews with San Bernardino employees, businesses and potential downtown tenants indicate a serious negative perception about security, crime and the lack of social and business activities in downtown. It has been strongly recommended by PPS, and supported by the Downtown Task Force and private sector participants in attendance at the June 23, 1992 Town Hall meeting, that short-term projects begin immediately to bring new life and activity to downtown San Bernardino. The marketing renderings have been completed and are highlighted in the Downtown Plan. The Consultant Team has developed several downtown short-term projects which are presented in this report. Staff requests approval to initiate three short-term projects: 1) approve the concept plan (Court & E) and begin implementation of the Public Square construction and events programming strategies; 2) authorize formation of the high-activity zone and; 3) authorize the Public Works and Development Departments to develop a experimental plan for diagonal parking on Court Street between "E" and "D" Streets. Project for Public Spaces has completed its work in accordance with the scope of services. In recognition of the need for continuity and expert guidance during critical stages of implementation, the Task Force, comprised of the Chairman, Commission members and the private sector, recommended PPS's continued involvement during the implementation phase of the Downtown Plan. In addition to providing technical support and assisting with implementation of the short-term projects, PPS will help coordinate a "one day retreat" to identify implementation strategies for each of the plans recommendations. If the projects are successful, they can be developed into a permanent uses for the downtown. However, if they are not successful, the program, project or activity will be terminated without the loss of major funds. The activities are intended to enhance the downtown environment during lunch hours for office workers, attract more people downtown during evenings and bring families downtown during weekends. A new pedestrian-centered environment that is inviting and interesting to those wanting to window shop, participate in programmed activities or stroll downtown can be created by this process. Owners of retail restaurants, entertainment, and other desirable uses which require private/public investment will then feel justified and encouraged to follow patterns and behavior initiated by this process. Public Souare at Court and "E" Street I' " Pursuant to the plan, the Public Square at Court and "E" Streets will become a central community setting for special events and activities. Currently, there are no outdoor public spaces in the downtown which are used extensively to provide social activities. The Court and "E" Street lot is owned by the Economic Development Agency and underutilized as a temporary parking lot. The farmer's market has initiated the first phase to transform this space into an active community gathering place on Saturday mornings. The Public Square will expand on this use with physical amenities and daily activities/ events. Suggested uses include markets, concerts, and special events, as well as places for people to sit, eat and socialize. Physical amenities include a lawn, trellises, flower planters, benches, tent, and kiosks. The concept plan for this square is attached (Exhibit A). The estimated cost to construct these improvements ranges from $300,000 - $500,000. The exact cost will be determined after the completion of engineering drawings and cost estimates. Currently, the Development Department Staff has issued a Request for Bids for Engineering Drawings for the square. Bids are due the day after this agenda item was prepared. Staff will advise the Commission of the bid results and request award of the bid verbally at the July 6 meeting. In order to maintain the current level of progress, staff recommends construction commence in August, 1992. It is projected that events and projects will begin in November/December of this year if target construction dates are met. In addition to construction of the square, staff will also develop management, maintenance and security procedures for the square, as well as an events calendar and activity uses. The goals of the High Activity Zone would be to establish an area in the downtown that will act as an incubator of both businesses and activities. This will strengthen existing businesses within the downtown while encouraging new businesses to locate downtown. The program affords greater development flexibility, expedited processing and is in harmony with the following objectives in the general plan: 1.16.15 Allow for the development of outdoor dining. 1.16.16 Require that a percentage of the ground floor of all commercial and office structures incorporate "pedestrian-active" retail uses (restaurants, florists, gift shops, bookstores, clothing, shoe repair, etc.) 1.16.17 Establish a "high-activity" sub-area (generally between "D," "E," 2nd and 5th Streets), where it is the intent to achieve a high level of evening activity, and limit the uses which can be accommodated in the ground elevation of structures to those opening in the evening. The High Activity Zone will allow activities that work towards creating a "user friendly" pedestrian active retail environment with an emphasis on arts, entertainment, dining and unique retail uses. Current city regulations, pOlicies, and fees inhibit the ability to bring more entertainment and business downtown. The ordinances also prohibit desirable activities that take place in public spaces, such as vending and street entertainment, as well as limit uses related to specific businesses. Business owners who completed surveys in the Downtown Plan process complained about the many restrictions, high license fees and other "red tape". In the development of a "High Activity Zone", staff will conduct further research on these issues and propose solutions through uses specific and development within the zone. Staff will return to the Commission with a draft program and criteria for this High Activity Zone and an appropriate request to implement such program at that time. Changing Court Street, between "E" and "D" Streets from parallel street parking to diagonal street parking is a related short-term recommendation (Exhibit C). Staff seeks approval to work with the Public Works Department to finalize a diagonal parking plan which will allow a better pedestrian environment, create more parking spaces, and lower the speed on this street. Staff plans to test effectiveness of the plan (using PPS) through time lapse photography, speed checks and input from the citizens and local business owners. Upon approval, staff will proceed to develop a diagonal parking plan and return to the Commission with cost estimates, a test plan, and other pertinent information. Extension of PPS Contract Future involvement of PPS for approximately sixty more days is desirable. This is a conclusion concurred in by all Task Force participants in the plan to date. Subsequent to a "one day retreat" of the administrative team to identify implementation strategies, the results of the plan would be summarized in a short report that would be reviewed by the Task Force members initially, and subsequently the Commission. Implementation assistance would include completion of detailed design drawings, review of construction documents, preparation of detailed conceptual designs for the Maruko Hotel entrance/gift shop, development of a site plan for an antique market, and before/after time-lapse filming of Court Street to study the impacts of diagonal parking. Total cost would be $23,300 for labor plus $4,450 allocated to expenses for a total not to exceed approximately $28,000. The short-term projects, with the exception of details of the proposed PPS contract, have been presented and approved by the Downtown Plan Administrative Team and Task Force. They were also presented to interested citizens at the June 23, 1992 Town Hall meet where the participants approved and urged implementation of the projects.
