STAFF REPORT
Subject
Amendment to the agreement with Roger Ernst & Associates. Auctioneers to store and
sell seized vehicles, personal and real property, and firearms.
Background
On June I, 1992, the City entered an agreement with Roger Ernst & Associates
Auctioneer, per the provisions of Resolution #1992-189, to store and sell vehicles,
personal and real property, and firearms seized in accordance with Federal and State asset
forfeiture laws. The Auctioneer continues to provide services according to the terms of
the agreement, for the sale of property seized by the narcotics unit of the police
department.
Findings
The narcotics unit has the responsibility of investigating crime directly related to the sales
or distribution of illegal narcotics within the City. When an investigation establishes an
entity has illegally acquired property through the sales, transportation, or distribution of
narcotics. that property is subject to civil forfeiture per Health and Safety Code 911470.
The reason for the proposed amendment is to include the sale of vehicles civilly forfeited
as a "nuisance" per the provisions of California Vehicle Code 914607.6.
The police department uses the Auctioneer to maintain and sell vehicles and
miscellaneous property seized by the narcotics unit. Ernst & Associates is located in
Modesto California, which is beneficial to the City. The geographical distance serves to
benefit the City in several important ways.
. The geographical distance safeguards against potential conflicts of interest.
. No cost to the City for pick up and storage of property. This is essential for
vehicles.
. No cost to the City for the return of the property if forfeiture is rescinded by
the courts.
. Flat commission rate of 10% of the sale price, and incidental charges to
prepare an item for sale.
. Itemized reporting of property in inventory, sale, and costs.
. 48-hour response to request for the pick up of property.
The police department has initiated the civil forfeiture of vehicles as a nuisance in
compliance with California Vehicle Code 914607.6. A vehicle is a nuisance if a driver is
unlicensed or has a suspended or revoked driving privilege and operates that vehicle on a
highway, after having been convicted for a driving license offence or having signed a
Stipulated Vehicle Release Agreement. Ernst has provided services to the City since
1990 for the sale of vehicles subject to civil forfeiture. The benefits Ernst provides to the
narcotics unit are the same, as those required for the civil forfeiture of vehicles as a
"nuisance". Currently, the agreement with Ernst does not include the sale of vehicles
forfeited as a "nuisance".
Financial Impact
There is no cost to the City for property that is not awarded in civil forfeiture. Revenues
are undetermined due to the wide variety of types of property seized in civil forfeitures.
