Staff Report
SUBJECT Request to Use Salary Savings to Fund Temporary and Contractual Positions in
the Development Services Department
BACKGROUND
Due to the number of vacant positions within the department and the length of time the positions
have been vacant, the Development Services Department has need to hire temporary and
contractual staff in order to provide adequate services to the public.
The following areas are in critical need of temporary staffing:
Planning Division
Current vacancies:
Senior Planner, vacant since August, 2000; third recruitment resulted in an adequate list,
appointment for Mayor and Council approval anticipated for February, 2001 agenda.
Associate Planner, vacant since July, 2000; 3rd recruitment opened 01/08/01.
Assistant Planner, position vacant since December, 2000; recruitment requested
Staff proposes to hire contractual planners through an RFP process, On December 19,2000,
staff released a Request for Proposals for temporary contract planning services for the City of
San Bernardino, Those services include the review and processing of development applications
and the preparation of environmental documents and staff reports, as required. The RFP was
distributed to eight people/firms and four responses were received. After reviewing responses
and checking references, staff selected Terra Nova Planning and Research, Inc, Matthew Fagan,
and PZL, Inc.
In the interest of time and customer service, the first Agreement for Services with Terra Nova
Planning and Research, Inc, was approved on January 12,2001 by the City Administrator for an
amount not to exceed $24,500. This enabled staff to obtain immediate assistance with the
processing of two Conditional Use Permit applications. The two remaining proposed
Agreements, each for $24,500, are attached for Council approval
Having three separate Agreements for Services will enable the Planning Division to process
development applications in a timely manner. Planning staff will be able to continue on-going
planning, process amendments to the General Plan and Development Code, and work on projects
such as the Regional Housing Needs Assessment, Housing Element, and Multi-Species Habitat
Conservation Plan, and provide services to the public information counter. The agreements will
be valid through the end of the current fiscal year, although it is hoped that the vacant positions
will be filled before then and contract planning services will no longer be needed, Each
agreement will be for an amount not to exceed $24,500 for a total amount of$73,500 needed for
contractual planning services,
Staff Report - Continued -- Request to Use Salary Savings to Fund Temporary and Contractual

Secretarial Support for Planning and Public Works
Planning Commission Secretary, vacant since May, 2000; third recruitment resulted in 19
applications, screening/testing in process
Public Works Secretary, vacant since November, 1999 due to a Workman's Comp Claim
which is yet unresolved
The Department has an on-going purchase order for temporary secretarial support for the two
divisions in the amount of $24,500, Staff requests Council authorization to increase this
purchase order by $30,000 from $24,500 to a total not to exceed $54,500,
Recruitment for the Secretary position is in process and is expected to be completed within the
next 60 days. The vacancy in the Public Works Division is a result ofa Workman's Comp.
Claim and it is not yet resolved. The department would continue to need temporary secretarial
services for the Public Works Division until the situation is resolved, Since nearly all of the
Public Works Secretary's time is spent in support of capital projects and funds for the temporary
services are drawn directly from capital project work orders, most of the additional costs for this
position would not impact the general fund
FINANCIAL IMPACT
Staff requests that salary savings funds be made available for hiring temporary and contractual
employees. Approximate salary savings since the beginning of the fiscal year (July 1,2000)
through December 31, 2000 or as estimated until filling the position, are as follows:

SECTION 1. MATTHEW FAGAN and PZL,INC. are competent, experienced and able
proposals for the provision of PROFESSIONAL PLANNNlNG SERVICES, per Responses to
10 Proposals received in response to a Request for Proposals released by the Planning Division of

the Developmen( Services Department. Pursuant to this determination, the City Administrator is
12
hereby authorized and directed to execute an Agreement for Services with each contractor on
13

behalf of the City; a copy of each agreement is attached hereto (Exhibits A and B) and
incorporated herein.
16 SECTION 2. The authorization to execute the above referenced agreements is rescinded
17 if they are not executed within sixty (60) days of the passage of this resolution.

This AGREEMENT is made and entered into this day of January, 2001, by and
between Matthew Fagan ("Contractor") and the CITY OF SAN BERNARDINO ("CITY").
WITNESSETH:
A. WHEREAS, CITY has need for planning services within the City and,
B. WHEREAS, CONTRACTOR is competent and able to perform said services,
and,
C. NOW, THEREFORE, the parties hereto agree as follows:
I. CONTRACTOR shall furnish planning-related services to CITY in
accordance with Attachment A.
2. Over the term of this Agreement, CONTRACTOR shall be paid for such
services an amount not to exceed $24,500, in accordance with Attachment
A.
3.
CONTRACTOR shall provide the Director of Development Services
with a weekly statement of hours worked in arrears and shall be provided
payment within thirty (30) days therefrom. CITY retains the right to
challenge all or any part of the statement.

4. The term of this agreement shall be from January 22,2001 until June 30,
2001. This Agreement may be canceled by two weeks written notice by
either party.
5. CONTRACTOR shall indemnify, defend and hold CITY, its officers,
employees and agents hannless from any claim, demand, liability, suit,
judgement or expenses (including, without limitation, reasonable costs of
defense) arising out of or related to CONTRACTOR'S performance of
this agreement, except that such duty to indemnify, defend and hold
harmless shall not apply where injury to person or property is caused by
CITY'S willful or sole negligence.
6. CONTRACTOR shall perform work tasks as directed by the Director of
Development Services or his designee, but for all intents and purposes
CONTRACTOR shall be an independent contractor and not an agent or
employee of the CITY and, as such, shall not be entitled to any benefits,
including but not limited to, medical insurance, retirement and workers'
compensation.

In the performance of this Agreement contractor shall not discriminate on
the basis of race, creed, color, religion, sex, physical handicap, ethnic
background or country of origin.
8. Any notice to be given pursuant to this Agreement shall be deposited with
the United States Postal Service, postage prepaid and addressed as

CONTRACTOR shall maintain insurance policies meeting the minimum
requirements set forth herein. All insurance maintained by the Contractor
shall be provided by insurers satisfactory to the City. Certificates
evidencing all insurance coverage required herein shall be delivered to the
City prior to the Contractor performing any of the services under this
Agreement. All insurance certificates required herein shall name the City
as an additional insured and provide for thirty (30) days written notice
form the insurer to the City prior to cancellation of any insurance policy of
the CONTRACTOR.
A. Comorehensive General Liabilitv and Automobile Insurance - The
Contractor shall maintain comprehensive general liability and
automobile liability insurance with a combined single limit of not
less than One Million Dollars ($1,000,000.00) per occurrence.
B. Worker's Comoensation Insurance - The Contractor shall maintain
worker's compensation insurance in accordance with the laws of
the State of Cali fomi a for all workers employed by the Contractor.

Contractor shall perform services including, but not limited to the following:

Development Code
. Prepare Initial Studies pursuant to the California Environmental Quality Act and City
policies and procedures
. Prepare staff reports to the City's Planning Commission and/or Mayor and Common
Council
. Meet with Planning staff and other City departments as needed
. Meet with project applicants as determined by Planning staff
. Attend Development/Environmental Review Committee, Planning Commission,
and/or Mayor and Common Council meetings as needed
. Other similar duties
Contractor shall work under the supervision of the Principal Planner.

. Review development applications for completeness
. Compile and route development applications
. Prepare all legal noticing for CEQA and public hearings before the
DevelopmentJEnvironmental Review Committee, Planning Commission, and/or

. Provide sample documents and/or templates for CEQA documents, staff reports, etc.
. Provide all copying services
. Other similar duties
Comoensation
City shall compensate contractor for actual hours worked, as directed by the City, at a
rate of $90.00 per hour and according to terms in paragraph C.3. of this Agreement.
Term of aueement

This agreement shall expire on June 30, 2001 or sooner as determined by the City and
shall not exceed a total of$24,500. Hours worked, work schedule, and specified projects
shall be established by mutual agreement between Contractor and City.

Services Agreement with Matthew Fagan Consulting Services
On January 22, 2001, the City of San Bernardino adopted Resolution 2001-13 - Resolution
approving services agreements with Matthew Fagan and PZL, Inc, , for the provision of
professional planning services. An original agreement was sent to Matthew Fagan of Matthew
Fagan Consulting Services on January 26, 2001; however, the agreement was not returned to the
City Clerk's Office.
I have attached copies of correspondence sent to Mr. Fagan.
Please provide any information you may have relative to this agreement.
