Staff Report
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the Mayor
to execute an agreement with William Woolard for the provision of project management services to
the Development Services Department.
Backl!:round:
The Development Services Department has experienced a number of vacancies, which has caused a
backlog of projects in the department. The City, therefore, has the need for the services of a project
manager to provide services in the following areas:
· Review the development process including: a) assess the current functioning of the DRC/ERC to
identify ways to improve its effectiveness; and b) evaluate the development process to identify
and implement key improvements that will help simplify processes, and reduce time periods
required to accomplish tasks.
· Act as Santa Fe Depot Area Project Manager to provide leadership/coordination for the Depot
Restoration Project including negotiating and securing leases with potential tenants of the Depot,
such as SANBAG, Metrolink, Amtrak, Greyhound and others; and working with a consultant to
complete the Santa Fe Depot Area Plan.
· Act as project manager for the City's General Plan Update including the development of the
workplan, consultant coordination and implementation.
· Such other duties as assigned by the City Administrator.
The interim director of Development Services, William Woolard, is well qualified to function in this
capacity .
Financial Imoact:
Cost of the proposed agreement shall not exceed $42,625 from the Development Services
ProfessionaVContractual Account. Although this expense was not anticipated, funding is available
in the Development Services Professional/Contractual account. This amount is based on an hourly
rate of$55/hour, not to exceed 775 hours. Actual time spent on the Depot restoration can be charged
to the federal grant, which will reduce the General Fund impact. As part of the mid-year budget
review, staff will review this account to determine if any further adjustments are needed.
Recommendation:

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT WITH WILLIAM WOOLARD FOR THE PROVISION OF PROJECT
MANAGEMENT SERVICES TO THE DEVELOPMENT SERVICES DEPARTMENT,
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is hereby authorized
and directed to execute on behalf of said City an Agreement with William Woolard, an
individual, for the provision of services to the Development Services Department, a copy of
which is attached hereto, marked Exhibit "A" and incorporated herein by reference as though
fully set forth at length.
SECTION 2.
The authorization to execute the above referenced agreement is
rescinded if the parties to the agreement fail to execute it within sixty (60) days of the passage
of this resolution,

EMPLOYMENT AGREEMENT
WILLIAM WOOLARD
3 THIS AGREEMENT is made and entered into this 22nd day of January 2001, by and
4 between the CITY OF SAN BERNARDINO, a charter city ("City"), and WILLIAM
5 WOOLARD, an individual ("Woolard").

NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
ASSIGNMENT:
The City agrees to hire Woolard as Project Manager, to

TERM: The term of this Agreement shall be for a period not to exceed
one year, commencing on January 29th, 2001.
COMPENSATION:
Woolard shall be paid an hourly fee of Fifty Five
DoIlars per hour, ($55.00) for a period not to exceed 775 hours over the total term
of the contract.
TERMINATION.
This agreement may be terminated by Woolard upon
fourteen (14) days written notice to the City. This agreement may be terminated by City
14 upon ten (10) days written notice to Woolard.

ENTIRE AGREEMENT.
This agreement contains the entire agreement
between the parties. Any correspondence, letters, documents or discussions leading up to
this agreement or in any other way made between the parties of their agents are replaced
and superseded by this Agreement.
SEVERABILITY. If any part or provision of this Agreement is in conflict or
inconsistent with applicable provi~ions of federal, state or city statutes, or it is otherwise
eld to be invalid or unenforceable by any court of competent jurisdiction, such part or
rovision shaIl be suspended and superseded by such applicable law or regulations, and
e remainder of this Agreement shall not be affected thereby.
AMENDMENT:
This agreement between the CITY OF SAN
ERNARDINO, a charter city, and WLLIAM WOOLARD, an individual, may only be
