Synopsis of Previous Council action:
August 17, 1987 - The request for additional playground and facility space for Teddy
Bear Tymes Child Care Center, adjacent to the YWCA building at Seccombe
Lake Park was referred to the Park and Recreation Commission for the
purpose of allowing time for the City Attorney to review the legalities
of the request.
Recommended motion:
That the recommendation be accepted for action as deemed appropriate by the Mayor
and Common Council.

SECCOMBE LAKE PARK PROPERTY BY THE YWCA
FOR THE TEDDY BEAR TYMES CHILD CARE
CENTER.
The Mayor and Common Council referred the Teddy Bear Tymes request for
additional playground and facility space at Seccombe Lake Park adjacent to
the YWCA to the Park and Recreation Commission. The Commission held two
(2) Special Meetings on August 27 and September 3, 1987 to hear the pros
and cons of the request.
The Commission asked the Parks, Recreation and Community Services staff to
meet with the Teddy Bear Tymes staff to develop a proposal for use of the
park property. That proposal was presented at the September 3rd r~eeting with
the following recommendation being made by the Commission:
"...That the Mayor and Common Council accept the proposal with conditions
outlined for expansion of the child care play area for use by the Teddy
Bear Tymes."
Attachment number 1 is a copy of the proposal and conditions for review and
action as deemed appropriate by the Mayor and Common Council.
The Park and Recreation Commission did not make a recommendation concerning
the use of building space. After discussions during the Meeting on August
27, 1987, the Commissioners agreed that the expansion of the playground and
the use of building space were issues which needed to be dealt with separately.
The building space issue should be discussed at a regular commission meeting
when there is more time to collect information pro and con.
The Operating Agreement, as Amended by Amendment Number Four, states that
either the City or the State may not let or sublet with respect to the use
and occupancy of Seccombe Lake Park property or any portions of said property
without the written consent of the other. Attachment number 2 is a letter
from Assemblyman Jerry Eaves with a letter from State Parks and Recreation
Director Henry R. Agonia in which the State has essentially given their
consent for expanding the playground area.
Attachment number 3 is a sketch of the area needed for expansion of the play-
ground. The area is approximately 30' x 156' on the south end of the YWCA
building and 105' x 12' on the west side of the present YWCA playground area.
Attachment number 4 is a drawing showing the intended improvements proposed
by Teddy Bear Tymes for the playground area which includes adding a wrought
iron fence and landscaping inside the fenced playground. Teddy Bear Tymes
will also install a wrought iron gate with handicapped pedestrian access in
the walkway entrance to the park adjacent to the playground area.
This Department staff is amendable to the request to expand the play area. The
park area in question is presently only used as a landscaped area for esthetic
value. The improvements proposed by Teddy Bear Tymes will not only improve the
appearance of the YWCA property but will also add to the esthetics of the park
in that area.

TEDDY BEAR TYMES PLAYGROUND EXPANSION PROPOSAL
As a result of a meeting between representatives of the Teddy Bear Tymes
Child Care Center and the City of San Bernardino Parks, Recreation and
Community Services Department, the proposal to allow the expension of the
Teddy Bear Tymes playground area at the YWCA is endorsed by this Department
contingent upon the conditions listed below. Implementation of this arrange-
ment will take place through the leasing of the specified area, approximately
5,000 square feet, to the City Redevelopment Authority who would in turn
include the property as part of its arrangement with the YWCA. The YWCA
would then be required to lease the land to Teddy Bear Tymes for development.
It should be noted that this endorsement is exclusive to the playground area
and in no way is to be construed to be associated with the proposal for
building space.

CONDITIONS FOR THE USE OF ADDITIONAL PARK SPACE
FOR TEDDY BEAR TYMES PLAYGROUND AREA
YWCA/Teddy Bear Tymes Technical Committee agrees to:
1. Provide an engineering plan detailing the proposed playground modifications
subject to approval by Parks, Recreation and Community :ervices Department.
2. Relocate all park irrigation, all mainlines and control wires in the
proposed playground area will be sleeved when crossing t~e area.
Automatic valves will be relocated outside the proposed ~layground area.
The lateral and sprinkler heads will be relocated outside of the proposed
playground area to give full coverage to landscaping.
3. Design and construct double wrought iron entry gate with wheel chair
accessibil ity.
4. Provide pedestrian gate to playground area.
5. Provide a hold-harmless and indemnification agreement to the City and
the State.
No construction is to begin until approval is given by the City Council and
State of California. Use of the park lands is subject to completion of all
legal agreements that may be required such as transfer of title, leasing
agreements, etc. All legal aspects of this arrangement are Subject to review
and approval by attorneys for the City and the State.

Director, State of California Department of Parks and Recreation.
Recognizing the City of San Bernardino has a vested interest in
this project, I have, in the interest of updating the Common
Council, sent each member correspondence covering the background
and current status of this project.
In an effort to expedite the implementation of those items covered

Dear Assemblyman Eaves:
The proposal for the use of Seccombe Lake State Urban Recreational
Area for child care activities was discussed with Les McCargo after
having reviewed the material provided.
The proposal for use of the playground area would not seem to be in
conflict with the proposed park. I am sure you are aware that at one
time there was a "tot lot" proposal in the near vicinity. It would
seem that the playground area could serve the child care center and,
likewise. during after hours serve the community. Additionally, the
portion of the building that would serve for classroom space during
the daytime might also serve for recreational opportunities for the
community after child care hours. With the addition of the child care
center, this park would continue to serve its purpose as an urban
recreational area, perhaps even expanding the opportunity for multiple
use.
Thanks for your continued concern in the State Park System and the
opportunity to review the proposal.
