Synopsis of Previous Council action:
September 8, 1987 - A resolution was presented which included
829 Spruce Street among those parcels on which a hazard abate-
ment lien was to be imposed. Pursuant to Council action, said
parcel was deleted from the resolution for further study, and
continued to September 21, 1987.

STAFF REPORT
On September 9, 1987, a resolution imposing a lien on property
located at 829 Spruce Street was continued to the council meet-
ing of September 21, 1987. The reason for the continuance was
to provide background information on the lien. There were two
other items on the agenda of September 8, 1987, regarding build-
ing demolition at this property. One was a Board of Building
Commissioner's resolution which was filed, and the other was an
appeal hearing requested by the property owner and scheduled for
October 5, 1987, at 9:30 a.m.

1, 1987: A demand letter was sent by Building and Safety
to UIP Investors, Ltd., I, setting forth the provisions
for filing an appeal for the administrative costs of the
lien to be imposed at 829 Spruce by Resolution No. 1168.
The lien would be imposed in 30 days if the administrative
costs totalling $341.52 were not paid. (These administrative
costs must be recovered whether or not the building is sub-
sequentlydemolished)
August 7, 1987: The matter of 829 Spruce Street again went to
the Board of Building Commissioners. Resolution No. 1179
for immediate repair or demolition was adopted. An appeal
period was granted. The administrative costs remained the
same. (Resolution No. 1179 was the BBC resolution filed
on September 8, 1987, as Item No. 76 on the council Agenda.)
August 15, 1987: The property owner appealed pursuant to Resolu-
tion 1179. This resolution orders the immediate repair or
demolition of the property. As the time period for appeal-
ing the administrative costs passed without an appeal, the
property owner is only appealing the demolition or repair
at this time.
September 8, 1987: The appeal hearing on Resolution No. 1179 was
set for October 5, 1987, at 9:30 a.m.
In the past, our department held off placing the administrative
costs on the agenda until the entire process was completed, even
though that was long after the appeal period had expired. We
would then combine the costs (administrative and demolition) into
one document and impose one lien.

We found that this caused a problem, as many times the property
would change hands during the months between imposition of the
administrative costs and the time the demolition appeal was
finalized by the Council. There were times when the process
took years.
By imposing the administrative costs lien immediately, anyone
interested in purchasing the property would become aware through
the title search that an action was pending.
If you agree, please go forward and adopt a resolution imposing
a lien on property at 829 Spruce Street. If you want to continue
this for further study, please cause this action to coincide with
the appeal hearing scheduled for october 5, 1987.
