HomeMy WebLinkAbout12643 7 9 10 11 12 13 14 15 16 17 18 1 RESOLUTION NO. /;;! & .y.3 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF THE WEST SIDE OF PlCO AVENUE, LYING SOUTH OF THE SOUTH LINE OF RIALTO AVENUE AND NORTH OF THE NORTH LINE OF BELLEVIEW STREET, AND RESERVING PUBLIC UTILITIES THEREON 3 4 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of the West 8 side of Pico Avenue, lying South of the South line of Rialto Avenue and North of the North line of Belleview Street, in said City, which said portion more particularly is described as follows: That portion of the West Side of Pico Avenue, South of the South line of Rialto Avenue, and North of the North line of Belleview Street. The West 20.00 feet of Pico Avenue (California Street) as delineated on the Map of Murray and Payne's Subdivision of the Metcalf Tract as per plat thereof recorded in Book 4 of Maps, page 27 records of the County Recorder, County of San Bernardino, State of California, and lying between the South line of Rialto Avenue (1st Street) and the North line of Belleview Street (Atlantic Street) as said streets are delineated on the map of said Subdivision. SECTION 2. That the Mayor and Common Council of the City of San 19 Bernardino, in vacating the above described portion of said street, elects 20 to proceed under and in accordance with the provisions of the "Street 21 Vacation Act of 1941", being Division 9, Part 3, of the Streets and Highways 22 Code of the State of California. 23 SECTION 3. That the hours of 9:30 A.M.. on the 17th day of 24 January, 1977, in the Council Chamber of the City Hall, San Bernardino, 25 California, be, and the same hereby is fixed as the time and place when and 26 where all persons interested in or objecting to the proposed vacation may 27 appear before the said Mayor and Common Council and offer evidence in 28 relation thereto. For further particulars as to the proposed vacation of II. , I 1 2 3 !I ! 4 S 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2S 26 27 28 the hereinbefore described portion of said street, reference is made to that certain map marked "Plan No. 4979" approved November 15, 1976, on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for sanitary sewer and appurtenant facilities and for public utility purposes belonging either to the City of San Bernardino or to any public utility and there is hereby reserved for future general public utility purposes and for this City an easement reasonably necessary to locate such sanitary sewer and public utility facilities over, in, under, or across a portion of the real property describe4 hereinbefore and to use, maintain, repair, replace or renew such facilities. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street Vacation to be posted as required by the Street Vacation Act of 1941.
