2 RESOLUTION OF THE CITY OF SAN BEfu~ARDINO AUTHORIZING THE
EXECUTION OF AN AGREE~lliNT WITH CURCI-TUfu~ER CO., A PARTNERSHIP,
3 RELATING TO THE ACCEPTANCE OF A GRANT DEED; AND AUTHORIZING THE
ACCEPTANCE OF A GRM~T DEED CONVEYING CERTAIN REAL PROPERTY IN THE
4 CITY OF SAN BERNARDINO TO BE USED FOR PUBLIC PURPOSES IN ACCORDANC:
WITH THE TERMS OF THE AGREEMENT.

BE IT RESOLVED BY THE ~ffiYOR AND CO~~ON COUNCIL OF THE CITY
6 OF SNq BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
8 authorized and directed to execute on behalf of said City an
9 agreement with Curci-Turner Co., a partnership, whereby said
10 partnership donates two parcels of real property to the City for
11 the public use, a copy of which is attached hereto, marked
12 Exhibit "I" and incorporated herein by reference as fully as thoug
13 set forth at length.

SECTION 2. That the City of San Bernardino does hereby
15 accept a Grant Deed, dated December 13, 1976, conveying two
16 parcels of real property from Curci-Turner Co., a partnership, a
17 copy of which is attached hereto, marked Exhibit "11" and
18 incorporated herein by reference as fully as though set forth at
19 length.

4 a municipal corporation, 300 North "D" Street, San Bernardino,
5 California, hereinafter called "City", and CURCI-TURNER CO., a
6 partnership, Post Office Box 1457, Newport Beach, California,
7 hereinafter called "Donor".

WHEREAS, Donor is the owner of certain parcels of real

property situated
in the City of San Bernardino, County of San

Bernardino, State of California, hereinafter described; and

WHEREAS, Donor desires to give said property to City for
13
the public use of City, and City desires to accept said gift of
14
real property for public use; and
15
WHEREAS, said parcels of real property are a part of a
16
larger parcel of property and have not as yet been split in
17
accordance with the provisions of the Subdivision Ordinance and
18
the provisions of the Government Code of the State of California;
19
and
20
WHEREAS, Donor has filed its minor subdivision map with
21
the Planning Commission of the City of San Bernardino and its said
22
application therefor is in process; and
23
WHEREAS, Donor desires to give and City desires to accept
24
said parcels of real property effective upon the date of
25
acceptance of the deed by City and both parties desire that the
26
minor subdivision be expeditiously processed,

NOW, THEREFORE, in consideration of the terms, conditions,
28
provisions, covenants and legal detriments herein contained, it

1. Donor does hereby convey, bargain, sell, set over,
3 transfer, assign and give unto City all that real property
4 situated in the City of San Bernardino, County of San Bernardino,

North, Range 4 West, unsurveyed, San Bernardino Meridian,

as per plat recorded in Book 7 of Maps, Page 23,

2. City hereby accepts said real property upon the follow-
18 ing terms and conditions:

(a) Donor shall expeditiously continue with the processing
20 of its application for a minor subdivision now on file with the
21 Planning Commission of the City of San Bernardino and faithfully
22 pursue said matter until the approval thereof is obtained or
23 requirement waived.

(b) Upon the filing and recordation of the aforesaid
25 minor subdivision, Donor shall provide to City a standard form
26 policy of title insurance insuring City's title in fee in the
27 above described parcels of real property.

(c) Donor shall hold City, its elective and appointive

boards, commissions, officers, agents and employees free and

harmless from any and all liens and encumbrances that may be upon

said property, if any, and from all liens and assessments for

I real property taxes levied upon said property up to and including

the date of acceptance of the deed to said real property by city.

lIt is the intention of the parties hereto that City have said

real property free and clear of all encumbrances.

3. Donor shall execute and deliver to City a grant deed

IIconVeY1ng the aforesa1d lots and parcels of real property to City
land City shall accept and record same. Said conveyance shall be

subject to covenants, conditions and restrictions of record and

shall be delivered by Donor concurrently with the execution of

this agreement.

4. The provisions of this agreement shall bind the heirs,
15 executors, administrators and assigns of the parties hereto.
