that the announcement be made public this date, that the
Mayor be instructed that upon expiration of 72 hours after
receipt by the San Bernardino Spirit Baseball Club of the City's
notice regarding noise levels at Fiscalini Field, if no appeal is
filed by the San Bernardino Spirit Baseball Club to the Mayor and
Common Council, that the Parks, Recreation and Community Services
Department be instructed to have a supervisor monitor the noise
level from the neighborhood surrounding the baseball field; if
the noise level is found to be too high, that the Police Depart-
ment be instructed to assist this supervisor in turning down the
volume once; if the volume is again raised, they will return to
the ballpark and remove the sound box and microphone. All pre-
sent - Maudsley voted no

The consultant review committee comprised of myself, and neighborhood
representatives Jack Nelson and Jim Brouse interviewed the following
consultants on two separate occassions:
1. Bolt, Beranek and Newman, Inc.
2. Gordon Brichen and Associates
3. J.J. Van Houten and Associates, Inc.
4. General Acoustics (did not show for first day of interview due
to car trouble)
After the first interview Bolt, Beranek and Newman, Inc. and J.J. Van
Houten and Associates were asked back for a second interview. As General
Acoustics did not make their first day appointment due to car trouble, they
were contacted to come during the second day of re-interviews.
Bolt, Beranek and Newman, Inc. withdrew from their second interview as their
representative went on vacation and they had no one they could send with
the technological background required to answer the questions.
After interviewing J.J. Van Houten and Associates the committee felt that
J.J. Van Houten and Associates, Inc. had the background experiences in
situations similar to the Fiscalini problem. They provided copies of previous
studies which demonstrated they had the expertise to evaluate and provide
recommendations to problems as we are experiencing.
Via telephone conversations with Bruce Englebrecht, legal counsel for the
Spirit team and Leanne Pagliai, assistant team General Manager, concurred
with me and the neighborhood representatives that their choice would be
J.J. Van Houten and Associates, Inc.
Based on the interview process and an understood scope of services requested
Mr. Van Houten has provided an estimate of $13,890 for his services.
The committee recommends J.J. Van Houten and Associates, Inc. be considered
for consultant services for the Fiscalini Field noise problem and that
I,layor and Common Council give further direction on the matter.

Subject: Proposed Noise Assessment Regarding the Community An-
noyance During the San Bernardino "Spi ri t" Ba seball
Games and Related Events
Gentlemen:
J. J. VAN HOUTEN & ASSOCIATES, INC., is pleased to propose the
subject effort as requested in our telephone conversation on this
date. The analysis and measurement procedures required to ac-
complish the effort are an integral part of the acoustical con-
sulting services provided by our company.
WORK STATEMENT
The following provides a description of the measurement program,
analysis, assessment of impact and mitigation measures to be
provided as part of the proposed effort. Appropriate noise
standard s for the Ci ty of Sa n Berna rdi no w ill be recommen ded, a
draft noise assessment study will be prepared and after respond-
ing to comments, a final study report will be submitted.
The following tasks will be performed as part of the proposed
consulting effort:
1. Existing Conditions
Obtain noise measurements within the ballpark and at residen-
tial locations within the community during representative
events. In addi tion, obtain measurements, on a 24-hour
basis, at community locations to establish the conditions
which exist without an event. Determine the "other" related
event activities and assess the noise which will be produced
by these events at community locations.

2. Standards of Annovance
Establish the appropriate noise control standards which
should be considered for intrusion of the various ballpark
activities (crowd noise, amplified speech and music, traffic,
etc.). Identify standards, both as they relate to annoyance
at community locations in the viCinity of the ballpark and to
recognized noise regulations.
3. Assessment of lm~
Assess the impact of the existing event activity and ambient
noise at community locations in the vicinity of the ballpark.
Determine the number of people exposed to various levels of
noise and how these numbers relate to the annoyance potential
of the noise of various events.
4. Mitigation of Si~nificant Impacts
Where significant impacts are identified, indicate methods by
which the event activity noise may be reduced to recognized
standards and the methods by which community annoyance may be
reduced ~r eliminated. Consideration will be given to the
use of limiters, compressors, band pass filters, shapers, al-
teration in loudspeaker directivity, barriers, and alterna-
tive ballpark configurations and/or relocation.
5. Recommended Course of Action
Provide recommendations concerning the action which should be
taken by the Ci ty. Consideration will be given to actions
which provide a measurable benefit to the community as well
as those which allow the baseball and "other" event activi ty
to operate in a compatible and viable manner.
6. Preoare Draft and Final Reoorts
A draft report of the findings and recommendations will be
prepared in reproducible form. After review and comment by
the City, community, and ballpark management, the draft will
be revised and submitted as a final report.
7. Public Hearings
Attend staff meetings as needed to complete the above tasks.
Attend two public hearings to present and assist in formulat-
ing a plan of action.

ITEMS TO BE DELIVERE~
As a result of the study effort and the proposed staff and public
agency reviews, the following will be submitted:
1. Draft and final reports in reproducible form.
2. The project principal, John J. Van Houten, will attend staff
reviews as required, and two public hearings.
ITEMS TO BE PROVIDED BY THE CITY
It is understood that the City will provide copies of drawings of
the layout of the ballpark, maps of the community in proximity to
the park, and where available, aerial photographs of the area of
concern. It is also understood that the ballpark management will
assist by providing the sound amplification system and man-power
to operate the system during non-event noise measurement periods
(about 2 to 3 periods of 4 to 5 hours each).
EXPERIENCE
John J. Van Houten will perform all analyses and determine the
impact and mitigation of noise within the City. As a registered
Professional Engineer in the State of California, he will certify
all measurements and the detailed recommendations provided as
part of the proposed effort. Mr. Van Houten will be assisted in
the measurement portion of the study and the computer aided
analysis by Mr. David Wieland, Senior Engineer and Mr. Sang Min
Lee, Associate Engineer. Resumes of Mr. Van Houten's, Mr.
Wieland's and Mr. Lee's backgrounds are attached.
J. J. VAN HOUTEN & ASSOCIATES, INC. has performed over fifteen
hundred (1500) noise assessment and community noise studies for a
variety of residential and commercial developments and
municipalities. A representative listing of clients and related
projects are attached.
INSTRUMENTATION CAPABILITY
The instrumentation required to perform the effort is owned and
operated by J. J. VAN HOUTEN & ASSOCIATES, INC. Certifications
of instrumentation calibration are available as required to sup-
port the effort.

SCHEDULE AND COSTS
The effort, as proposed, is offered on a not-to-be-exceeded fee
basis of $13,890.00. Table 1 indicates the man-hours and expense
estimates leading to this fee on a task-by-task basis. A draft
report will be completed within a sixty (60) day period from the
date of your authorization to proceed.
