STAFF REPORT
Bids for the project were opened at 2:00 p.m. on Tuesday,
June 2, 1987.
A total of 6 bids were received, ranging from $32,656.56 to
$51,118.25. The low bid of $32,656.56 is 50.3% over the
Engineers estimate of $21,722. It is obvious that the allocated
funds are insufficient to finance the total project cost, based
upon the actual low bid price. Therefore, the City Administrator
and Animal Control Officer requested that we attempt to negotiate
with the low bidder to delete some amenities that could be
installed at a later date.
We proposed to the low bidder that the 3 bid items for striping,
landscaping and irrigation system be deleted. He was unwilling
to accept the proposal, since his profit was in these items.
However, he agreed to delete these items, and the one for
guniting the drainage, if certain adjustments were made to the
bid prices for some items. These adjustments are tabulated on
Attachment One, and will reduce the contract price to $21,721.00.
Section 12.20,020 of the Municipal Code states that "public project"
shall not mean the repair or maintenance of public projects.
Therefore, Public Contract Code Section 20161 does not apply,
which means that the price can be negotiated. Change Order No.1
will adjust the bid prices in accordance with the low bidder's
proposal.
An amount of $25,000 has been allocated, under Account No.
124-233-56301, to finance the costs incurred for this project.
Listed below is the total project cost, based upon the actual
negotiated bid price:

Contingencies (5% 1,179
Total Estimated Project Cost $ 25,400
Award of the negotiated contract will result in the basic
improvements being installed. The portions of the irrigation
system under the pavement will need to be installed by City
Forces prior to the contractor commencing work. Also, the stalls
will need to be striped in order to render the parking lot
serviceable.
We feel the negotiated bid price is fair and reasonable, in light

of the quantities of work involved and current prices. Therefore,
we recommend that the contract be awarded and Change Order No.1
be approved.

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO
BRENTON LEE RHOADES FOR RESURFACING AND RESTRIPING THE PARKING
LOT FOR THE ANIMAL SHELTER, AND APPROVING CHANGE ORDER NO. ONE
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Brenton Lee Rhoades is the lowest responsible
bidder for resurfacing and restriping parking lot for animal
shelter, in accordance with Plan No. 7218, for the total amount
of $21,721.56, a contract is awarded to said bidder accordingly,
and Change Order No. One approved to reduce the contract price
from $32,G56.56 to $21,721.56, but such award shall be effective
only upon the contract and Change Order being fully executed
by the parties; all other bids therefor are hereby rejected; and
the Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is attached
hereto, marked Exhibit "A" and incorporated herein by reference
as fully as though set forth at length.

any amendments or modifications thereto shall not take effect or
become operative until fully signed and executed by the parties
and no parcy shall be obligated hereunder until the time of such
full execution.
No oral agreements, amendments, modifications
or waivers are intended or authorized and shall not be impl ied
from any act or course of conduct of any party.
