We wish to appeal Standard Condition No lO of the C.U.P. due to the extremely high undergrounding costs of the l2KV lines along 9th Street. Standard Condition No. lO states "All Utility Lines shall be installed underground subject to exceptions approved by the Planning Department and the City Engineer". When phase One (l) of this development was constructed it was given an exceptj by the Mayor and Council due to the extremely high underground costs. The Phase two C. U. P. No. 87-27 also has this condition, but when the planning analysis was perfonned and amendments recommended by the Planning Department the total project was analyzed it took both phases into consideration. If this condition is not exempted the Phase One will have overhead Electric lines and the Phase Two development will be required to have underground lines, which mean the development costs would put the financial well-being of the project into jeopardy. Additionally, the use of the property is transitional in nature with the underlying Commercial-Manufacturing Zone to be realized in the future. It should be noted that the R V Park was the first development to be implemented in this area of the City along 9th street and was the initial pioneering project. For these reasons, we respectfully request the Mayor and Common Council grant an exception from Standard Condition No. lO and allow the existing utility lines to remain overhead for Phase Two as has been previouly granted for Phase One. According to the San Bernardino Municipal Code, l~.7B.070., the following applies to the filing of a tional use permit: "The decision of the Commission shall be final unless appeal- ed in writing to the Mayor and Common Council. The written appeal shall be submitted to the office of the City Clerk within ten days from the date of the Commission's decision. The existing RV Park is comprised of 80 vehicle spaces. The additional 3l spaces would raise the total to III vehicle spaces. Phase II consists of l.4 acres located on the north side of Ninth Street, west of Tippecanoe. The overall site will consist of 4.67 acres. 2. Zoning and General Plan: The existing zoning for the existing and the proposed additional 3l spaces is C-M, Commercial Manufacturing. The General Plan designates the site for Light-Industrial. Recreational Vehicle Parks are permitted in any zone subject to the approval of a conditional' use permit. 3. Access and Circulation: Three access points will be provided for the project from 9th Street. Two are found in the existing portion and one proposed for the addition. The interior private streets will maintain a 32 foot full width throughout. 4. Parking: As this is an addition to an existing RV Park the entire site is to be considered in the analysis. The existing site has 80 RV spaces with 14 guest parking spaces provided. This is a RV space to guest parking space ratio of 5.71. The 'proposed addition will have 31 RV spaces and 6 guest parking spaces for a ratio of 5.l6. Merging the two phases together there will be a total of III RV spaces with 20 guest spaces creating a ratio of 5.55 spaces. To better distribute parking parking throughout the develop- ment staff recommends the removal of one RV space and devote that area (4 spaces) to guest parking. In addition staff recommends to delete two angular guest parking spaces as shown on the proposed plan, relocating them to the RV space which staff recommends to be deleted above. Staff has amended the proposed plan to display the recommendation. The amended plan is attached and is labled "Amendment No. l". If approved as recom- mended by staff two additional guest parking spaces would be provided and one RV space would be deleted creating llO RV spaces and 22 guest spaces for a ratio of 5.00. 5. Landscaping: The proposed addition will maintain an l8 foot landscaped setback from the property line on 9th Street with a 6 foot block wall matching the existing wall to the east. A six foot block wall will be established on the north I.. The wall will continue along the west property line except for that area which may be required as access easements for the San Bernardino County Flood Control District. Interior landscaping of the proposal will be treated in a similar manner as the first phase with a landscaped area with a tree separating' each RV space. 6. The porposal is an addition to an existing RV Park. The General Plan designates the site for Light Industrial and the zoning of C-M, Commercial-Manufacturing is considered consistent with the General Plan. The proposed land use is acceptable in the C-M zone subject to the appro- val of a conditional use permit. 2. The site is sufficient in area to accomodate the proposed Recreational Vehicle Park. 3. Sufficient ingress/egress is provided with three, two-way driveways onto Ninth Street. 4. The proposed Recreational Vehicle Park addition is not incompatible with the surrounding land uses. However, if no development has been initiated at the end of the 12-month period, the application shall expire. Additional time may be approved upon request of the applicant prior to expiration of the l2-month period. Expiration Date: June 2, 1988. --2-- PARKING: a. This development shall be required to maintain a minimum of -1- stan- dard off-street parking spaces. (For guests) b. All parking and driving aisles shall be surfaced with two inches of AC over a suitable base or equivalent as approved by the City Engineer. Parking spaces shall be striped and have wheel stops installed at least three feet from any building, wall, fence, property line, or walkway. c. Whenever an off-street parking area is adjacent to or across an alley from property zoned residential, a solid decorative wall six feet in height shall be erected and maintained along the property line so as to separate the parking area physically from the residentially zoned pro- perty provided such wall shall be three feet in height when located within the required front or street side yard setback. Where no front or street side yard is required, such wall shall be three feet in height when located within ten feet of the street line. d. Whenever an off-street parking area is located across the street from property zoned for residential uses, a solid decorative wall or equiva- lent landscape berm not less than three feet in height shall be erected and maintained along the street side of the lot not closer to the street than the required depth of the yard in the adjoining residential ari'a. Street trees must be installed at a minimum of 30 feet on center. Varieties and exact location shall be determined by the Director of Park and Recreation. b. All required setbacks abutting a public right-of-way shall be landscaped (except for walks and driveways which bisect or encroach upon the required landscape area). c. Air conditioning and vent ducts shall be directed away from any adja- cent residential uses. b. All mechanical equipment located on the roof shall be screened and located away from adjoining residential uses. Screening design shall be approved by the Planning Department. Compliance with all recommendations of the Geology Report shall be required (if applicable). Grading and revegetation shall be staged as required by the City Engineer in order to reduce the amount of bare soil exposed to precipitation. During construction, the City Engineer may require a fence around all or a portion of the periphery of the site to minimize wind and debris damage to adjacent properties. The type of fencing shall be approved by the City Engineer to assure adequate project site maintenance, clean-up and dust control. Within 75 feet of any single-family residential district, the maximum height of any building shall not exceed one-story or 20 feet unless the Commission determines that due to unusual topographical or other features, such restrictive height is not practical. All necessary drainage and flood control measures shall be subject to the requirements of the City Engineer, which may be based in part on the recommendations of the San Bernardino County Flood Control District. The developer's Engineer shall furnish all necessary data relating to drainage and flood control. 20. A catch basin and storm drain shall be installed on the north side of Ninth Street to carry street drainage into Warm Creek Channel. Grading 21. If more than l' bf fill or 2' of cut is proposed, the site/plot grading and drainage plan shall be signed by a Registered Civil Engineer and a grading permit will be required. 22. If more than 5,000 cubic yards of earthwork is proposed, a grading bond will be required and the grading shall be supervised in ~ccordance with section 7012 (c) of the Uniform Building Code. 23. The site/plot/grading and drainage plan submitted for a building permit shall contain sufficient ground elevations (both existing and proposed), building pad and finished floor elevations, grade slopes, and gradients to define the amount of grading to be done and the means of draining the site.
