HomeMy WebLinkAbout6399 RESOLUTION No.ls f1 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDIlfO DECLARING ITS IJilTENTION TO ORDER THE VACATION OF P<RTIONS OF SECOND STREET BETWEiEN MERIDIAN AVENUE AlfD DALLAS AVENUE, DALLAS AVElfUE BETWEEH FOOTHILL BOULEVARD AND THE PACIFIC ELECTRIC RAILWAY CCllPANY'S RISR'l' OF WAY. BE IT REOOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of portions of Second Street between Meridian Avenue and Dallas Avenue, Dallas Avenue between Foothill Boulevard and the Pacific Electric Railway Company's Right of Way, in said City, which said portions are more particularly described as follows: A portion of the Northwest quarter of Section 7, TOW'J\ship 1 South, Range 4 West, San Bernardino Base ll1\d Meridian, in the City of San Bernardino, according to the official plat of said land approved by the United States Surveyor General's Office, San Francisco, California on August 14, 1&76, described as follows: Beginning at a point 60.00 feet South of the center line of Foothill Boulevard and the West line of Dallu Avenue 40.00 feet wide; thence Southerly along said west line to the intersection with the North line of Second Street 40.00 feet wide; thence Westerly along said North line to a point 32.00 feet East of the center line of Meridian Avenue; thence Southerly and parallel with said center line to the South line of said SeClOnd Street; thence Ea.terly along said South line to its intersection with the West line cf said Dallas Avenue; thence Southerly along said West line to its inter- section with the North line of the Pacific Electrio Railway Right of Way 100.00 feet wide; thenoe Eashrlyalong said North line to the East line of said Dallas Avenue; thenoe Northerly along said East line to a point 60.00 feet South of the center lbe of said Foothill Boulevard; thence Westerly to the point of beqinninq. . Exceptinq therefroa an easgent for the maintenance and repair and rights appurteJ\Ult thereto for a sewer line 10.00 feet in width, the center line of Which is l6l.50 feet North of the North line of the Pacific Electric Railroad right of way, and lying within the East and West lines of Dallas Avenue, 40.00 feet wide. SECTION 2. That the Mayor and COIIIIon Council of the City of San Bernardino, in vacating the above desoribed portions of said Second street between Meridian Avenue and Dallas Avenue, Dallas Avenue between Foothill Boulevard and the Pacific Electric Railway CQmpany's Right of Way, elects to proceed under and in accordance wi th the provisions of the -Street Vacation Act of 1941-, being Division 9, Part :3, of the Streets and Highways Code of the State of California. SECTION 3. That the hour of 9:30 A.M., of the 9th day of July, 1962, in the Council Chamber of the City Hall, San Bernardino, California, be, and the same hereby is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the said M~or and Common Council and offer evidence in relation thereto. For further particulars as to the pro- posed vacation of the hereinbefore described portions of Second Street between Meridian Avenue and Dallas Avenue, Dallas Avenue between Foothill Boulevard and the Pacific Electric Railway Company's Right of Way, reference is made to that certain map marked Plan No. 2919 approved January 29, 1962, on file in the office of the City Clerk of said City. SECTION 4. That the City Engineer of the City of San Bernardino hereby is directed to oause Notioes of Street Vacation to be posted as required by the Street Vacation Aot of 1941. SECTION 5. That the City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in The San Bernardino Evening Telegram, a newspaper published and circulated in the City of San Bernardino, the first of suoh publications to be made not les8 than ten (10) days prior to the date of the above public hearing. SECTION 6. The City Clerk shall Certify to the adoption of this resolution and thenceforth and hereafter the same shall be in full force and effect.
