STAFF REPORT

This parcel was donated to the City of San Bernardino by Mr. and Mrs.
Bing S. Wong, in 1974, with the condition that: "City shall hold title to
this parcel of real property for the San Bernardino Public Library."
Another condition was that "in the event City determines not to
build a branch library upon said property, then City may sell said real prop-
erty and the net proceeds received from the sale of said property shall be
placed in a Special Library Fund which Fund shall be used by Board for future
library building programs; said funds shall be used for said purposes within
twenty-one (21) years after the death of the last survivor between the Donors."

Mr. Steve Whitney, the City Librarian, has requested that this parcel
be sold; however, he did mention the following "Because of its, zoning and
potential use, the property is anticipated to net a minimum of $100,000.00."
Seven appraisers were contacted in regard to bidding on the appraising
of this property and two other City-owned parcels.. Mr. C. M. Benefiel was
the appraiser used to appraise this parcel. His value of $60,000.00 will be
used as the low bid for the sale of this parcel.
We recommend that the resolution be adopted.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO GIVING
NOTICE INVITING COMPETITIVE SEALED AND ORAL BIDS FOR THE SALE
OF CERTAIN REAL PROPERTY OWNED BY SAID CITY, GENERALLY LOCATED
WEST SIDE OF DEL ROSA AVENUE, NORTH OF MARSHALL 80ULEVARD. IN
SAID CITY. ESTABLISHING A MINIMUM SALE PRICE FOR SAID PROPERTY.
WHEREAS. the City of San Bernardino, a municipal
corporation. is the owner of the hereinafter described parcel
of real property situated in the City of San Bernardino. State
of California; and
WHEREAS. the Mayor and Common Council of the City of
San 8ernardino find and determine that there is no further need
or necessity for the use of said real property; and
WHEREAS, the Mayor and Common Council of the Ci ty of
San Bernardino believe it to be in the best interest of the
said City that said parcel of real property be disposed of at
the highest price obtainable in the open market.
NO~I, THEREFORE. BE IT RESOLVED BY THE MAYOR AND COMMON
COWNCIL OF THE CITY OF SAN 8ERNARDINO AS FOLLOWS:

SECTION 1. Notice is hereby given inviting competitive
sealed and oral bid proposals for the disposition of the
following real property, more particularly described in and
subject to the terms of Specification No. 15.02-172 on file in
the office of the Director of Public Works/City Engineer, Real
Property Section. City Hall. 300 North "0" Street, San
Bernardino. California. and generally described as follows:
"A rectangular parcel of land totaling approximate-
ly 30,000 square feet. located on the West side of
Del Rosa Avenue. North of Marsh~ll Boulevard."

Said parcel is more particularly described in Bid Specification
15.05-172. a copy of which is marked Exhibit "A" attached
hereto and incorporated as though fully set forth herein at
length.
SECTION 2. The minimum acceptable bid for said
property is as follows:
$60,000.00 cash selling price.
SECTION 3. Each sealed bid proposal must be
accompanied by a cashier's check in an amount equal to 10:1; of
the total purchase price bid.
SECTION 4. Sealed bids must be delivered to the Office
of the City Administrator. City Hall. 300 North "0" Street, San
Bernardino. California. on or before the hour of 2:00 p.m..
June 19, 1987. at which time said sealed bids shall be opened
and publicly declared. The results of said bidding shall be
submi tted to the Mayor and Common Council at the hour of 2:00
p.m.. at the Council Chambers, City Hall, 300 North "0" Street,
San Bernardino. California, at the next regularly scheduled
Council ~'eeting following the opening of bids. At that time,
oral bids may be received as follows:

oral bid shall be in an amount not less than the
highest sealed bid plus $250.00. The successful
bidder shall be required to make a non-refundable
deposit with the City Clerk prior to the end of the

The oral bidding for the sale or disposition of the property
shall be continued in the same manner until all bidding shall
have been compl eted. and an award made to the hi ghes t bi dder
by a 5/7th vote of the City Council. The successful bidder. as
determined by the Mayor and Common Council. shall make a non-
refundable deposit by cash. cashier's check or money order in
an amount which, together with any deposit made with a sealed
bid of bidder, shall equal ten percent of the total price bid
for the property. Such deposit shall be made with the City
Clerk prior to the end of the meeting or within two hours of
the awarding of the bid. whichever shall occur later. The
Mayor and Common Council shall have the right to reject all
bids. Full payment shall be made in accordance with Bid
Specification No. 15.05-172.
SECTION 5. Copies of the "Description of Property.
Requirements of Bidders. Requirements of Sale and the Official
Bid Form" may be obtained in the Office of the Director of
Pub 1 i c Work slCi ty Engi neer, Rea 1 Property Secti on. Room 405.
City Hall. 300 North "0" Street. San Bernardino, California.
SECTION 6. All written bid proposals must be signed,
sealed and delivered as indicated in Section 4. No bid
proposal will be considered which fails to offer a sum equal to
or greater than the minimum acceptable bid prices establi shed
herein. or which is filed at a later time or at a different
place or with a different person than as stated in Section 4,
unless there is substantial compliance as determined by the
City Administrator in his sole discretion.

the door of the Council Chambers. City Hall. San 8ernardino.
California. and a Notice Inviting Bids for the disposition of
said property shall be published not less than once. at least
10 days prior to the date for filing bid proposals with the
City Administrator. in the San Bernardino Sun Telegram. a
newspaper of general circulation published and circulated in
said City.

NOTICE is hereby given inviting competitive bids for the sale of a
parcel of City owned land consisting of approximately 30.000 square
feet, located at the West side of Del Rosa Avenue. North of Marshall
Boulevard. in the City of San .Bernardino.
1. lOCATION AND DESCRIPTION OF SUBJECT PROPERTY:
(A) Property location: West side of Del Rosa Avenue. North of
Marshall 'Boulevard. and is currently vacant.
(B) Legal Description:

Orange Grove Tract West Highlands. as per plat recorded in

bidder, shall equal at least ten percent (1OS) of the total

promptly returned. without interest. after determination of the
successful bidder by the Mayor and Common Council. or upon

9. RESERVED RIGHTS:
(A) The ~'ayor and Common Council shall have the right to
reject all bids.
10. The successful bidder. as determined by the Mayor and Common
Council. \-lill be required to enter into escrow within (10) days
after said determination. The escrow instructions shall
include but not be limited to:
(A) The recording of the Grant Deed from the City and the
closing of escrow within a sixty (60) day period.'

(B) The amount bid by the successful bidder shall be paid into
escrow by cash, cashier's check. or money order. in an amount
equal to the total price bid minus the successful bidder's
deposit.
(C) Escrow. Title Policy, and other fees will be paid 50S by
the Ci ty. and 50S by the successful bi dder. except for the
documentary tax, whicft will be paid by the succ~ssful bidder.
(D) The parties hereby agree that it would be extremely
difficult or impossible to determine the amount of damages
suffered by the City as a result of any failure by the
successful bidder to execute escrow instructions within the
allotted time. or to deposit the agreed upon terms of the
purchase price; therefore, it is a condition of the bidding
procedure that the successful bidder's deposit shall be
retained by the City as liquidated damages and not as a penalty
in the event of any said failure.
