Synopsis of Previous Council action:
At the meeting of the Mayor and Common Council held August
19, 1985, Resolution No. 85-331 was appr9ved authorizing the

STAFF REPORT
Dr. Stein is currently providing the City with pre-employment
and other medical exams. Dr. Stein's agreement with the City
has been in effect for approximately 2 years, with costs held
constant. The lone increase this year is for back x-rays
which was increased by the servicing x-ray lab. All other
charges are reasonable in comparison to costs charged by
other clinicsj agencies providing such service, and the work
performance by Dr. Stein has been timely and satisfactory.

This 30 page document is no longer on our wo
processing system. It can be re-entered and, with
minor wording clean up, be made ready for reissue
and mailing by mid May.

B. Council packet dated July 1985, adopting a contract
with Dr. stein for the provision of such exams.
Dr. Fowler, of the East Valley Medical Clinic, performed the
city's pre-employment medical examinations for 8 years, until
May of 1985. When he moved out of the area, the RFP was
drawn up and sent to a list of 18 physicians/clinics/-
hospitals (see "C" attached). Because of our specific
requirements, only 3 proposals were returned for our con-
sideration. Dr. stein's proposal was considerably less
costly than the only other proper proposal received (see "0"
attached) and better met our needs.
An RFP review committee consisting of the Risk Management
Director of Emergency Services, City Nurse, Assistant
Director of Personnel, Police Chief, Fire Chief, and Director
of Public Works recommended Dr. stein as the provider of exam
services. This recommendation was submitted to Council, where
it passed unanimously (Estrada, Reilly, Hernandez, Marks,
Quiel, Frazier and Strickler). Mayor wilcox subsequently
signed the approved resolution on August 21, 1985 (see "E"
attached) .
During the budget process in JUly/August 1986, Council asked
us to look at our exam requirements with an eye to saving
money if possible. A study was performed by this office, and,
our recommendation was to delete exams for "sedentary"
personnel. This would have resulted in the savings of $5,000

We have spent $58,335.00 over the last 2 years with Dr.
stein. In FY 85-86, $30,000 was budgeted and $29,633 was
spent. In FY 86-87, $35,000 was budgeted and to date (9
months) $28,702 has been spent.

The City of San Bernardino is issuing a Request for proposal
to secure the services of a physician/clinic to perform pre-
employment and other medical exams.
Interested and qualified physicians/clinics are invited to
submit six (6) copies of their complete proposal and any
related information no later than July 5, 1985 at 12:00 noon
to M.J. Perlick, Director of Personnel, City of San Bernardi-
no, 300 North -D- Street, San Bernardino, California 92418.
Additional procedural information related to the submission
and format of proposals is contained in the -Request for
Proposals.- Interested parties are urged to follow the -RFP-
instructions.
The proposals will be evaluated by a review committee.
Careful consideration will be given to each proposal. It is
anticipated that recommendations for award of the contract
will be submitted to the Mayor and City Council in July of
1985.

REQUEST FOR PROPOSAL
Provision of Pre-Employment Medical Examinations
.
for the city of San Bernardino
INTRODUCTION
The City of San Bernardino has approximately 1,500 permanent
and temporary employees in jobs ranging from those requiring
strenuous physical activity (including police Officers and
Fire Fighters) to sedentary jobs such as clerical and admin-
istrative positions.
City policy and State and Federal law prohibit any employment
practice which unfairly discriminates against an applicant on
the basis of physical or mental handicap. However, in order
to contain disability retirement and workers' compensation
costs, the City has developed physical examination procedures
which are intended to provide reasonable control of the
number and cost of injuries and still permit the
consideration of all applicants who can reasonably be
expected to safely perform the duties of the job for which
they are being considered.
I. PROGRAM DESCRIPTION
pre-employment Examinations: It is our intention to
maintain a medical examination program which will
provide the information necessary for effective
personnel administration. The medical evaluation of
applicants will have two basic parts:
The first part will be the medical examination by the
physician plus the necessary laboratory studies. The
physician will note any significant findings and
limitations and report these to the personnel
Department on mutually agreed upon forms and in
mutually agreed upon format. (forms to be provided by
the City)
Determinations as to medical limitations will be based
solely on the professional judgment of the examining
physician. The content of the examination will be
determined by the nature of the job for which the
applicant is being considered. City jobs have been
divided into groups as described in Attachment A which
also lists the contents of the examinations for jobs in
each group.

The second part of the medical evalua~ion will be a
determination by the Personnel Department as to whether
the significant findings and limitations reported by
the examining physician preclude an applicant from
safely performing the duties of a specific job. The
Personnel Department will have final authority and
responsibility for deciding if an individual is to be
employed.
Department of Motor.Vehicle Examinations: The medical
provider will also administer physical examinations as
prescribed by the California Department of Motor
Vehicles to those City employees whose jobs require
possession of Class 1 or Class 2 driver's licenses.
apecial Medical Evaluations: In addition to the above,
the City may also wish to provide comprehensive special
medical evaluations to selected employees.
II. SCOPE OF SERVICE
Specific criteria for providing medical services are
outlined below:
1. The Medical Provider's facility and staff must be
available to provide physical examinations conven-
ient and timely to the City's needs. (Specify day
and hours of availability) City's normal operat-
ing days and hours are 7:30 A.M. to 4130 P.M.,
Monday through Friday.
2. pre-employment examinations will usually be
scheduled on short notice. Up to 10 appointments
will frequently be requested for the same day and
examination must be conducted within five (5) City
working days of the request.
3. The City anticipates needing approximately 400-500
pre-employment and Department of Motor Vehicle
Licensing examinations per year. Examinations
will be on an as-needed basis and no minimum
number per day, week, or for the duration of the
contract will be guaranteed.
4. The actual physical examination must be made by a
licensed physician. However, routine measurements
and laboratory samples may be taken by nurses or
appropriately licensed or qualified technicians.

All results must be reviewed by a licensed physi-
cian.
5. A final written report of the examination results
which includes any laboratory and x-ray results
will be provided to the City within three work
days of the completed examination. Early verbal
reports will be provided by telephone upon request
of the personnel Department.
6. The Provider must ensure the availability of a
principal physician as a contact source to respond
to questions from the City Personnel Department
staff relating to medical examinations and ser-
vices.
7. The Provider will maintain complete records on
each individual examined. Such records will be
confidential and will be available only to the
Provider, the City's personnel Director or such
other persons as he/she may designate, and to the
individuals examined as allowed by State law.
8. The Provider shall be required to certify itself
as an equal opportunity employer and shall comply
with applicable requirements relating to any type
of discrimination.
9. The following clauses pertaining to a hold harm-
less agreement and insurance coverage will be
contained in the Contract which the Provider
executes with the City:
a. HOLD HARMLESS: Provider shall assume the
defense of indemnify and hold harmless the
City from all claims, expenses, damages, and
liability of every nature, directly or indir-
ectly arising from, or alleged to have arisen
from any operation, act or omission of the
provider or employees.
b. lNSURANCE: Provider shall be insured by an
insurance carrier acceptable to the City
against loss from public liability arising
from any operation or activity of the Provider
or employees. Minimum coverage shall be
three-hundred thousand ($300,000) COMBINED
SINGLE LIMIT LIABILITY, to include medical
malpractice insurance. A copy of the policy

of insurance shall be filed with the City and
shall name .The City of San Bernardino. as an
additional insured. Said policy shall specify
that the policy may not be terminated, altered
or cancelled without ten (10) days prior
written notice to the City by the insurance
company.
~~~S COMPENSATION: Consultant's employees
shall be covered by workers' compensation
insurance in an amount and form to meet all
applicable requirements of the Labor Code of
the State of california and which specifically
covers all persons providing services on
behalf of contractor and all risks to such
persons under this agreement.
10. The provider must have equipment and personnel for
back-up and/or emergencies to assure prompt scheduling
of medical examinations.

11. In addition to the Pre-Employment Screening and Depart-
ment of Motor Vehicles licensing examinations, the City
may require the services of medical doctors and spe-
cialists from time to time for a variety of purposes,
including the following:
a. BP~~ial Evaluation and Follow-up: In some cases
the City may require the availability of special-
ists in various fields, particularly orthopedics,
to assist in the special evaluation of candidates
and to provide information beyond that normally
obtained in routine examinations.
b. Appeal~: Applicants have the right to appeal a
rejection for employment to the City's Civil
Service Commission. The City, therefore, occa-
sionally requires the examining physician to re-
examine and re-evaluate a candidate who has
appealed his/her disqualification (including the
review of prior medical records) and to provide
information, in person or by comprehensive
narrative report, to the Civil Service Commission
about the applicant's medical limitations and
risks of employment.
c. Modifying guidelines: The City may require expert
medical advice and consultation (including re-
search results and recommendations) on occasion

for determining new, or rev~s~ng existing, medical
guidelines or changes in medical procedures and
examinations for future specific needs.
d. ~~~lQ~~~~: The city will need a physician
to examine current city employees with problematic
medical symptoms or conditions to determine if the
employees are physically able to safety perform
their duties.
In the instances outlined above, the examining
physician will work closely with the Personnel
Department to assure that medical determinations are
based on a firm understanding of the specific job
duties for which the applicant is being considered.
12. The City will accept charges only for those services
first requested by the City.
13. Any resultant contract agreement from this RFP will
contain the following clauses:
Conflict 2f-~nt~~: Any City employee whose position
in the City enables him/her to influence the award of
this contract or any competing contract, and no spouse
or economic dependent of such employee, shall be
employed in any capacity by the consultant herein, or
have any of the direct or indirect financial interest
in this contact.

applicable items to be reviewed/examined have been
reviewed/examined and there were no significant find-
ings.
PROPOSAL REQUIREMENTS
A. Criteria for Proposal Acc~t~
All responses to this Request for Proposal become the
exclusive property of the City of San Bernardino. Upon
receipt of said proposals specified on the next page,
the City will select the physician/clinic from among
those submitting proposals. Such selection shall be
based' on the evalua-tion criteria set forth in the

selected by the City, the City will negotiate a contract

consideration and approval. If a satisfactory

discretion, begin contract negotiations

ence, and understanding of industrial medicine.

3. Identification of phYSicians on staff and other
medical personnel who would be involved in pro-
viding services to the City, with a description of
their pertinent qualifications.

1. All reports shall be the sole property of the City
of San Bernardino and may not be used or reproduced
in any form without the explicit permission of the
City.
2. This request for proposal does not commit the City
of San Bernardino to award a contract, to pay any
costs incurred in the preparation of a proposal to
this request or to procure or contact for services.
All proposals submitted in response to this request
for proposal become the property of the City of San
Bernardino. The City of San Bernardino reserves
the right to accept or reject any or all proposals
received as a result of this request, to negotiate
with qualified Providers, or to cancel in part or

in its entirety the requ:st for proposal. The
Personnel Director may requ1re the proposer select-
ed to participate in negotiations concerning
contract price or the nature and extent of

Rpursuant to the Request for proposals, conditions on the
following pages, and subject to all provisions of the Charter
and Ordinances of the City of San Bernardino, the undersigned
hereby proposes to furnish to the City of San Bernardino,
complete at the prices stated herein, the items or services
hereinafter mentioned; and the undersigned further warrants
that this bid is genuine and not sham or collusive, or made
in the interest or on behalf of any person, firm or corpora-
tion not therein named; that the bidder has not directly or
indirectly induced or solicited any other bidder to put in a
sham bid, or any other person, firm or corporation to refrain
from bidding, and that the bidder has not in any manner

In submitting this proposal, the bidder agrees that:
(a) He/she has, or they have, carefully examined the speci-
fications, and all provisions relating to the items to
be furnished or the work to be done attached herewith
and made a part of this proposal, and understand the
Gleaning, intent and requirements of and agree to the
same.
(b) He/she or they, will enter into a written contract and
furnish the item(s) or complete the work in the time
specified, and in strict conformity with the City of San
Bernardino specifications therefor, for the prices
quoted.

2. Alternate Bids:

sals, the City reserves the right to reject statements
or communications accompanying bids which serve to
qualify such bids.
3. Brand Names:
The reference to commercial brands or brand names is
used for illustrative purposes only, other brands may be
considered when they are similar or equal.
4. Verify Quotations:
Verify your quotations before submission.
5. Delivery:
(a) Bidder shall state delivery on the Proposal Form
unless already specified, in which case delivery
shall be made within the time set forth. Delivery

is part of the consideration and must be adhered to
as specified.
(b) Provider will not be held liable for failure-to
make delivery because of strikes, conscription of
property, governmental regulations, acts of God or
any other causes beyond his control, provided a
written extension of time is obtained from the City
Administrator.
6. Firm Prices:
Prices on Bid shall be firm prices for the minimum
period of 7-1-85 through 7-1-86 and firm prices for a
longer period of time and are encouraged not subject to
escalation. In the event the specifications provide for
escalation the maximum limit shall be shown. If no
limit is set to this escalation, the bid shall not be
considered. In the event of a decline in market price(s)
below the price(s) bid the City of San Bernardino shall
receive the benefit of such decline.
7. Royalties and Patents:
The Provider shall pay all royalties and patent fees.
He/she shall defend all suits and claims for
infringements of any patent rights and shall save the
City of San Bernardino harmless from loss on account
thereof, except that the City of San Bernardino shall be
responsible for all such loss when a particular process
or the product of a particular manufacturer or
manufacturers is specified. If, however, the Provider
has information that the procedures or articles
specified is an infringement of a patent he shall be
responsible for any loss unless he promptly gives said
information to the City of San Bernardino.
8. Signature:
All quotations must be signed with the firm name as
indicated. A bid by corporation must be signed by a
duly authorized officer, employee or agent.

10. Addenda:
The effect of all addenda to the contract documents
shall be considered in the bid, and said addenda shall
be made a part of the contract documents and shall be
returned with them. Before submitting his bid, each
bidder shall inform himself as to whether or not any
addenda have been issued, and failure to cover in this
bid any such addenda issued, may render his bid informal
and result in its rejection.
11. Specifications to Prevail:
The detailed requirements of the specifications shall
supersede any requirement of these General Provisions
which are in conflict therewith.
12. Compliance to Industrial Safety Codes:
All equipment furnished shall, where applicable, conform
with the Safety Orders of the California Division of
Industrial Safety.
13. Affirmative Action Policy
The City of San Bernardino will not discriminate with
regard to race, religious creed, color, national origin,
ancestry, physical handicap, marital status, sex or age
in the award of contracts.

Police and Fire classifications. These employees are expect-
ed to encounter the most physically-demanding job duties.
Not only may they be called upon to perform at maximum
physical capacity at anytime, but they must do so under
circumstances where physical breakdown could be life
threatening to themselves or others because of the hazardous
nature of their work assignments. Considerable mental stress
may also be part of these jobs.
Of special concern are cardiovascular and lumbar spinal
abnormalities. Since the State Labor Code provides that
police officers that develop heart disease and firefighters
that develop heart disease or cancer during their employment
are presumed to have developed these conditions as a result
of their employment, such candidates must be thoroughly
scrutinized for these conditions.

THIS AGREEMENT is made and entered into at San Bernar-
3 dino, California, this day of 1987, by and
4 between the CITY OF SAN BERNARDINO, a municipal corporation
5 hereinafter c~lled "CITY", and ARNOLD M. STEIN, M.D.,
6 hereinafter called "Physician".
7 The parties hereto agree as follows:
8 1. Services. Upon request and referral by City,
9 Physician shall conduct pre-employment physicals and evalua-
10 tions and provide other medical services for City. Such
11 services shall include, but not be limited to, the following:
12 (a) providing central coordination of medical data
13 and information related to pre-employment physicals and eval-
14 uations for City;
15 (b) obtaining

persons referred by City in accordance with the specifics set

8 exam, $28.00, or $15.00 in addition to regular physical exam
9 fee if both exams are conducted, two view back x-ray, $55.00;
10 chest x-ray, $33.00, lipid test panel, $19.00; flexibility
11 and mobility tests, $27.00; hemoglobin study, $6.00; tuber-
12 culin sk in test, $5.00, electrocardiogram, $35.00; drug
13 screening for general abuse drugs $22.00.
14 3. Report and Recommendation. A written report and
15 recommendation including signif icant findings and limitations
16 on each physical examination hereunder shall be prepared by
17 Physician on the form provided by City's Director of Person-
18 nel and shall be forwarded to City within three days of
19 completion of the examination. When the form reflects
20 "normal" in an area of examination, the statement shall mean
21 that all applicable items to be reviewed or examined have
22 been so reviewed or examined and that no such significant
23 findings and limitations were determined.
24 4. Additional Duties and Responsibilities. Physician
25 shall specifically assume the following additional duties and

such services by the parties.
(a) Appeals. In the event an unsuccessful applicant
appeals his or her rejection to the Civil Service Board,
Physician shall re-examine and re-evaluate the appellant and
provide information, in person or by comprehensive narrative
report, to the Civil Service Board about the appellant's med-
ical limitations and potential risks involved with the em-
ployment of the appellant.
(b) Modifying guidelines. City may require expert
medical advice and consultation (including research results
and recommendations) on occasion for determining new, or
revising existing, medical guidelines or changes in medical
procedures and examinations for future specific needs.
(c) Current employees. Physician shall examine
current City employees with problematic medical symptoms or
conditions at City referral to determine if the employees are
physically able to safely perform their duties.
5. Billing. Physician shall bill City monthly and said
statement shall include the names of the persons examined and
the dates of the examinations. City will accept charges only
for those services first requested by City.
6. Equipment and Personnel. Physician must have
equipment and personnel for back-up and emergencies to assure
prompt scheduling of medical examinations. Physician shall
conduct any examinations or testing within five (5) working
days of City's request for scheduling the exams or test. Phy-
sician shall designate a competent physician or group of

4 7. Assignment. This agreement may not be assigned by

6 8. Hold harmless. Physician hereby agrees to, and
7 shall, hold City, its elective and appointive boards, com-
8 missions, officers, agents and employees harmless from any
9 liability for damage or claims for damage for personal
10 injury, including death, as well as for claims for property
11 damage which may arise from Physician's operations and
12 activities under this agreement, whether such operations and
13 activities be by Physician or by anyone or more persons
14 directly or indirectly employed by or acting as agent for
15 Physician. Physician agrees to and shall defend City and its
16 elective and appointive boards, commissions, officers, agents
17 and employees from any suits or actions at law or in equity
18 for damages caused, or alleged to have been caused, by reason
19 of any of Physician's operations or acts or omissions and
20 activities hereunder.

STAFF REPORT
The Civil Service Board require~, through their Rules &
Regulations as approved by Mayor & Common Council, certain
Medical examinations to ensure the applicant's/employee's
ability to perform the physical demands of the job. This
particular requirement has been contracted to the East Valley
Medical Clinic and Dr. Fowler for over 8 years, as the City
does not possess the in-house capability. Dr. Fowler's
services have been very satisfactory, however, Dr~ Fowler has
chosen to re-locate to Oregon and close his clinic here.
When the Personnel Office was notified of his decision in May
1985, we issued a "Request for Proposals. to local clinics
and physicians. A temporary interim contract, essentially
the same as we had with Dr. Fowler, was approved by the
Con~on Council in June of 1985 with Dr. Arnold Stein. Dr.
Stein was recommended by the City's Risk Management Division
as an interim provider.
The proposals were received and reviewed by a committee
consisting of Deputy City Administrator Ray Schweitzer, Fire
Chief Gerald Newcombe, Acting Assistant Police Chief Paul
Bonano, Director of Emergency Services/Risk Management Ronald
Solheim, Personnel Director M.J. Perlick, Assistant Personnel
Director Roger DeFratis (Committee Chairman), Director of
Public Services Manuel Moreno and City Nurse Jan Lewis.
After careful consideration of all factors, the comnlittee
recommends that Dr. Stein become the Examination Provider for
an initial contract period of 1 year.
The basic costs will remain comparable to the previous
contract with Dr. Fowler with no increased cost for fiscal
year 1985-86 and within present budgeted amounts. Also, the
quality of Dr. Stein's services have been found to be very
acceptable during the interim contract.
