Synopsis of Previous Council action:
Previous Planning Commission action:
At the meeting of the Planning Commission on March 17, 1987, the
following recommendation was made:
The application for Change of Zone No. 87-2 was recommended for
approval. The Negative Declaration for environmental impact was
also recommended for approval.
Vote: 6-1
Recommended motion:
To approve, modify or reject the findings and the recommendation
of the Planning Commission and to direct the City Attorney to
prepare the necessary amendments to the Zoning Code.
To approve the responses to comments and to adopt the Negative
Declaration for environmental impact which has been reviewed and
considered.

Dear ~~yor Wilcox and Council Members,
Two hundred and nine (20Q) residents and I, that sign~d the petition,
wish to appeal the decision made by the Planning Commission on Tuesday
March 17, reI to change the land use zoning district from R-l, single
family residential to R-3-l800, multiple residential. lazar plan triplex.
The size of the lot is only suitable for a single family dwelling,and
too small for more residences which would affect the neighborhood. FQr
example, off street parking is bad enough, now, even though the lot is
vacant. Parking in front of the homes and driveway on 28th Street would
only be compounded wi th multiple residences. '
"E" Street is a very busy street,and 28th Street is also very b~y as
it is a thru street. Accidents are common on the 4 corners at 28th &
"E" Streets. Only recently on the southeast corner of 28th and E, a
car trying to negotiate a right turn,jumped the curb,hit the fire hyd-
rant which the City had to repair.
Most of the residents living in this area are elderly,spent 30,40,and
50 years in the vicinity,and feel comfortable, knowing their neighbors.
True, conditions have changed, and additional locks,bars, have to put
on doors and windows, and one feels like a prisoner in his own home.
In spite of the locks, there is great fear to those especially Who
have experienced break-ins into their homes, being frightened a~ost
to death, with rape,burglarized of their cherished possession.,and
family heirlooms, even during daylight hours. '

So---is it any wonder that we look to you as our Mayor and Common Council
to help us keep this R-l single family residence? To maintain indep-
endence without fear and stress of assaults as stated above, and thus,
preserve the health and quality of life, and continue the lifes~le of
cohesiveness in the neighborhood that we are accustomed to lead.

True, we heard Mr. Richard lazar state at the Planning Commissiort meet-
ing that the vacant land adjoining his lot, purchased from Dennis Merrett,
who also owns most of the vacant land on 28th Street to 29th St~eet,that
the plans are to build single dwellings, which is already R-l zeining,
and we do not want the corner lot R-3 as proposed,but have it remain R-l.

We sincerely hope that the single dwellings will begin construc~ion
very soon, to settle this matter once and for all. PLEASE HELP ~S.

1. The applicant requests approval to change the land use zoning designation
from R-l, Single Family Residential, to R-3-1800, Multiple Family
Residential. The subject site is a square-shaped parcel consisting of
approximately .20 acres located on the northwest corner of 28th Street and
"E" Street.
2. The proposed change of zone would conform with the San Bernardino General
Plan, which designates the site and surrounding properties along "E" Street
for medium to high density residential uses at 15-36 dwelling units per
acre.
3. Surrounding zoning and land use include: Single family residential zoned
R-3 to the north and east, a triplex zoned R-3 to the south and a vacant
lot zoned R-l to the west.
4. The site is the only parcel on "E" Street, south of Kendall Drive that is
zoned R-l. Additionally, R-3 is the primary zoning on "E" Street between
Highland Avenue and the Crosstown Freeway. Therefore, changing the zone
on the site would bring it into compliance with prevalent zoning along
"E" Street. It is unlikely that a single family residence would ever be
built on the site as "E" Street is heavily traveled and not a desirable
location for a single family home.
5. The proposed site meets all the minimum standards for R-3 development
relative to lot depth, width, and area. The existing R-I-7200 zone
abutting the site along its westerly boundary would limit building height
to one story within 75 feet of the R-l zone boundary. The parcel has
frontage on both "E" Street and 28th Street.
6; The proposed zone change would not adversely impact existing traffic cir-
culation.
7. At their regularly scheduled meeting on February 19, 1987, the Environ-
mental Review Committee recommended a negative declaration be adopted for
Change of Zone No. 87-2.
