STAFF REPORT
This action is the result of a request of the developer of
Tentative Tract No. 13329 in response to the requirements of
the City to establish an assessment district for the
maintenance of landscaping along portions of the South side of
Piedmont Drive, generally between Cactus Circle and Lynwood
Drive, and along portions of the North side of Citrus Street,
generally between Pinon Court and Oleta Lane.
The purpose of the action is to preliminarily determine that
the public convenience and necessity require the formation of a
lands~aping maintenance district; declaring the intention to
proceed to order work within the district to be known as the
"Piedmont Drive Area Landscaping M,intenance District".
Pursuant to Chapter 12.90.040C{51 of the San Bernardino City
Municipal Code, notice and hearing will not be required as 100%
of the owners of the property to be assessed have requested the
district.
A copy of the Engineer's Report is attached herewith for your
convenience.

ASSESSMENT DISTR~CT NO. 982
PETITION -- On October 27,1986. this office received a petition from The Hill
Williams Development Corporation for the establishment of an asses-
sment district for the maintenance of landscaping for Tentative Tract
No. 13329 as delineated on the attached vicinity map. This petition
was the result of a requirement placed upon this Tract by the City
to relieve the Department of Parks and Recreation from having to
maintain the areas.
AUTHORIZATION TO PROCEED -- On December 8,1986. notification of this petition
was presented to your Honorable Body by this office and the City
Engineer and City Clerk were authorized to initiate proceedings under
the provisions of Chapter 12.90 of the San Bernardino Municipal Code
and the City Engineer was directed to prepare this report.
ADVANCE OF ESTIMATED COSTS -- On December 9. 1986 and pursuant to Chapter
12.90 of the Municipal Code. the developer was requested to up front
the estimated cost of $3.000.00 to cover the cost of the proceedings.
The deposit was received on February 18. 1987 and was deposited into
the proper account from which to draw the actual costs of proceed-
ings. If the actual costs are less than the deposit. then
the remainder will be returned to the developer and if the actual
costs are more than the deposit, then the remainder can either be paid
in a lump sum by the developer or assessed against the properties
involved.
EASEMENTS -- Although the property is presently undeveloped. when the Tract is
recorded. certain easements will be granted on the Tract Map to the
City to allow the district to maintain the areas which are outside of
the dedicated rights of way as the district cannot function on private
property.
DESCRIPTION OF IMPROVEMENTS -- The improvements to be maintained includes a
strip of ground cover on the South side of the Piedmont Drive between
the East and West boundaries of Tentative Tract No. 13329 .and on the
North side of Citrus Street. between the East and West boundaries of
Tentative Tract No. 13329.

PLANS AND SPECIFICATIONS -- Plans and Specifications for the landscaping are
being prepared by the developer and must be approved by the Department
of Parks and Recreation and must provide for separate watering systems.
electric and water meters which can be monitored and billed directly to
the assessment district for inclusion into the annual assessment rolls
after a one year plant guarantee period by the developer.
DESCRIPTION OF BOUNDARIES -- On February 18. 1986. the boundaries of the
proposed district were determined and are delineated on the attached
Proposed Boundary Map of Assessment District No. 982. The property
involved is bounded on the north by the centerline of Piedmont Drive.
on the south by the center1 i ne of Ci trus Street. on the east by the
east line of Tentative Tract No. 13329 .and on the west by the west
line of Tentative Tract No. 13329 .
VICINITY MAP -- The vicinity map is attached as Exhibit 1.
DISTRICT BOUNDARY MAP -- A reduced copy of the District Boundary Map is attached
as Exhibit 2.
METHOD OF ASSESSMENT -- Landscaping and its proper maintenance enhances the
esthetics of any given area and the benefit received by the owners of
properties in the area is determined to be equal to the number of
households who utilize the landscaped areas either as ingress and
egress to the households or by actual physical use of the land as in
the case of "open areas". The boundaries of the proposed district are
drawn with this in mind and the Resolution of Intention delineates the
specific areas of maintenance which will benefit all of the properties
within the boundaries.
Hence. each residential unit. be it a single family residence. a
condominium or an appartment will be assessed an equal share in the
cost of maintenance (1 residential unit - 1 assessment). Under a
cituation where vacant land is included within the district. the
property will be arbitrarily divided into 7.200 square foot lots minus
25: of the area for anticipated future streets and will be assessed
accordingly. When the property actually subdivides. it will be
assessed on the 1 residential unit - 1 assessment basis.

METHOD

OF FINANCING -- When the ~ndscaping is actually in place and has been
maintained in good order by the developer for the one (1) year plant
guarantee period, the assessment district will take over the
maintenance and will let contracts therefor on a fiscal year basis.
The fiscal year basis is for assessment purposes as the County Tax
Rolls are prepared on the same basis. The City will upfront the costs
of the annual contract and will be reimbursed each year through
assessments, plus interest, and collected on the annual County Tax
bills. Eventually,. these costs will come from the City's Assessment
District Reserve Fund, presently they come from the General Fund.

ASSESSMENT ROLL -- Presently there are 3 vacant parcels liable to be assessed
which constitutes 58 family units according to formula. When the
Tract is complete, there will be 53 assessments. The proposed
assesssment roll has been prepared to reflect the first assessment
(cost of proceedings only), attached as Exhibit 3 and prepared to
reflect the estimated maintenance and administration cost for one
year, attached as Exhibit 4. Although the assessment roll as attached
represents the vacant land, when built out each assessment would be
estimated at $ 78.96 each for subsequent years.
BONDS -- No bonds are to be sold on this proposed assessment district. The
costs will be up-fronted by the City and the assessments will be
collected on the County Tax bill annually based on actual annual costs
incurred for the maintenance and administration of the district plus
i nteres t.

RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY
DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
FORMATION OF A LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT:
DECLARING ITS INTENTION TO PROCEED TO ORDER WORK WITHIN THE
DISTRICT; TO BE KNOWN AS "ASSESSMENT DISTRICT NO. 982, AND
WAIVING NOTICE AND HEARING.
WHEREAS, the City of San Bernardino hereafter called
6 ("City") as an exercise of its municipal affairs powers has
7 enacted an Assessment District Ordinance (Municipal Code Chapter
8 12.90) to provide for the procedure for the formation of
9 assessment districts within the City; and
10
WHEREAS, it has now become necessary to consider the
11 formation of a landscaping maintenance assessment district
12 within the City, to be known as "Assessment District No. 982";
13
NOW THEREFORE, BE, IT RESOLVED BY THE MAYOR AND COMMON
14 COUNCIL OF THE CITY OF SAN BERNARDINO THAT:

SECTION 1.
Pursuant to Chapter 12.90 of the San
16 Bernardino Municipal Code, the Mayor and Common Council of said
17 City, hereby preliminarily find and determine that the public
18 convenience and necessity require and it is the intention of the
19 Mayor and Common Council to form Assessment District No. 982,
20 the boundaries of which are generally, as follows: Bounded on
21 the North, by the centerline of Piedmont Drive, between the East
22 and West lines of Tentative Tract No. 13329; bounded on the
23 South, by the centerline of Citrus Street, between the East and
24 West lines of Tentative Tract No. 13329; bounded on the East by
25 the East line of Tentative Tract No. 13329, and bounded on the
26 West by the West line of Tentative Tract No. 13329, said East

SECTION 2.

SECTION 3. Said contemplated work and improvements is of
more than local or ordinary pUblic benefit, and that said Mayor
and Common Council do hereby make the expense of such work and
improvement chargeable upon the district, which district is
hereby declared to be the district benefited by said proposed
work and improvement, and to be assessed to pay the cost and
expense thereof.
All public streets or alleys, or portions
thereof, hereby are excepted from said assessment.
SECTION 4.
The assessment benefit procedure to be fol-
lowed and the amount to be assessed against each particular
parcel will be an assessed portion of the total sum of the cost

1 of the maintenance and indicentals within the area in relation
2 to the number of residential units within the district.
3 Reference is hereby made to said Engineer's Report on file in
4 the office of the City Clerk for a detailed estimated individual
5 assessment.
6 SECTION 5. The assessment financing alternative to be
7 followed shall be as follows, to-wit:
8 The cost of the maintenance shall be pre-funded by the
9 City and the assessment levied, collected and enforced in the
10 same manner, at the same time, and with the same penalties and
11 interest as in the case of taxes levied for the City for the
12 repayment to the City of said pre-funding.
13 The Ci ty shall recover interest on each year's
14 pre-funding of cost maintenance of landscaping. Said interest
15 shall be at the average rate as the City is receiving on other
16 City funds during the period of expenditure.
17 The assessment for said district shall be made and
18 collected as follows: The costs of the maintenance' contract
19 and incidentals will be collected in perpituity unless otherwise
20 terminated by the City.
21. SECTION 6. That the City elects to proceed without
22 Notice and Hearing pursuant to Section 12.90.040C(5) of the
23 Municipal Code.
24 SECTION 7. A copy of this resolution and a map showing
25 the exterior boundaries of the proposed improvement district
26 with relation to the territory immediately contiguous thereto
27 and to the proposed improvement will be on file wi th the City

Clerk and will be available for inspection by any person or
persons interested. This map shall govern for all details as to
the extent of the proposed improvement district.

This item was continued, at the Council Meeting of 3-23-87, in order to
allow time to review the status of the drainage easement along the westerly
boundary of Tract No. 13329.
A neighborhood meeting was held at 5:00 p.m. on 3-27-87, in the home of
Mr. Robert Dudley, 3059 Pinon Court. About 8 residences were represented
at this meeting. Councilman Maudsley was also present.
Those in attendance expressed concerns about the maintenance of the approxi-
mate 11 foot area, including the existing concrete flume. Also, they
questioned the need to retain the flume.
Mr. Richard Genzel, Engineering Project Manager for the Hill Williams
Company, explained that the flume was needed to serve as an amergency
overflow for the sump condition at the catch basins on Piedmont Drive.
Mr. Genzel also indicated that the Hill Williams Company would be willing
to gunite the approximate 2 feet wide strip between the east wall of the
flume and the block wall they will be installing along their rear property
1 ines.
Councilman Maudsley indicated that the City would attempt to locate funds to
finance placing gunte in the approximate 4 feet wide strip between the west
wall of the flume and the existing walls along the rear property lines of
lots abutting Pinon Court.
Manuel Moreno, Director of Public Services, has agreed to do the necessary
excavation for the 4-foot strip. Richard Genzel will obtain a price from
the Contractor for placing the gunite. We are presently out to bid for the
extension of the storm drain, (to be installed by Tract No. 13329) south of
Citrus Street. Funds allocated for the extension of this storm drain could
be used to finance the guniting cost, since it is the same master plan
facil ity.
Maintenance of this drainage easement will be minimal, due to the gunite
placed to control weeds. Therefore, we recommend that the resolution, re-
