Previous Planning Commission action:
At the meeting of the Planning Commission on February 17, 1987,
the following action was taken:
The request to modify condition #1, to permit a private street
rather than the required public dedicated street and improvements,
for previously approved Parcel Map No. 6324 (Revised), was unani-
mously denied.
Racommended motion:
That the hearing on the appeal be closed and the decision of the
Planning Commission be affirmed, modified or rejected.

Re: Appealing Planning co_ission decision on Proposed Private
Drive of February 17, 1987, Parcel Map No. 6324
Dear Mayor Wilcox and Co_on Council:
The Planning Co_ission, On Auqust 19, 1986 approved Tentative
Parcel Map No. 6324, and at the request of the Planning
Department added a condition requiring that the proposed short
private drive be improved to public street standards (36 foot
wide street section, curb-to-curb) and dedicated to the City of
San Bernardino for maintenance. We respectfully request this
condition be amended to allow a private drive.
At the initial hearing we were not aware to what extent such a
condi tion would have on the proposal. We then requested that
condition number 1 be amended to allow a private drive. The
request was denied by the Planning co_ission on February 17,
1987. At this time we would like to appeal that decision in
writing to the Mayor and City Council.
In lieu of the public street requirement, we are agreeable to
widening the proposed private drive from 20 feet up to 26 feet.
This will allow for a 24 foot wide street section (private street
standard with parking on one side) and a two foot offset from the
easterly property line. Additionally, the proposed turn-around
radius at the end of the private drive would remain at 32 feet
which is consistent with minimum City standards (according to
engineering).
We feel our request is justified because the street will never
serve aore than three parcels. The ea~terly edge of the street
is adjacent to a County of San Bernardino Flood Control Channel
right-of-way. Full improvements are not needed nor warranted in
this situation and if imposed would adversely impact the proposed
parcels.

Other City offices including the City Engineer and Planning staff
have reversed their original recommendation to now support our
proposal for a private drive.

The request for modification to condition 11, to permit a
private street rather than the required public dedicated
street and improvements, for previously approved Parcel Map
No. 6324 (Revised), which permitted the creation of three
parcels in the R-1-7200 Single-Family Residential zone on
approximately 1.03 acres located at 1672 Echo Drive, was
denied.
According to the San Bernardino Municipal Code, Section
18.28.120., the following applies to the filing of a lot line
adjustment or parcel map:

provisions of the San Bernardino Municipal Code, the action
of the Commission shall be final.

The applicant is requesting to amend Condition No. 1 of
previously approved Parcel Map No. 6324 to permit a 3 lot
subdivision which consists of approximately 1.03 acres in the
R-1-1200, Single Family Residential zoning district. Subject
property is located at 1672 Echo Drive, 830 feet east of the
centerline of Del Rosa Avenue.
At the Planning Commission meeting of August 19, 1986,
Tentative Parcel Map No. 6324 was approved. At that meeting,
Condition No. 1 was modified to read:

The condition was originally modified so that perpetual
maintenance would be maintained by the City by virtue of it
being a dedicated street. In order for a private street to
be maintained in much the same manner, either an assessment
district or a homeowner's association to continually maintain
said private street would be required. A condition has been
added to assure maintenance of the street.

The applicant has requested in a letter dated December 1,
1986, to modify Condition No.1, as amended by the Planning'
Commission. The applicant's proposal is for the Planning
Commission to reconsider the requirement for a dedicated
street in order to permit a private drive-way. Rather than
the originally designed 20 foot wide private drive, it is now
proposed as a 26 foot drive. The turn around radius at the
end of the private drive is to remain at 32 feet, meeting the
City standards.
