STAFF REPORT
On October 16, 1978, the Mayor and Common Council originally
approved Tentative Tract No. 10459 and 10460.
Since that time, the applicant has received one one-year
extension of time (April 16, 1980 to April 16, 1981) in which
to record the final map.
The Council adopted Resol utions in March 25, 1981, authori zing
recordation, accepting the offers of dedication, and author-
izing the extension of Subdivision Security Agreements.
Some time thereafter, the subdivider submitted a final map
which did not substantially conform to the tentative map
because an easement was shown on the final map which had not
been shown on the tentative, and this easement had the effect
of rendering approximately 15 lots unbuildable. The developer
then requested the refund of hi s fees and the di scharge of hi s
bonds. This was done, at the request of the developer, on
August 27 and August 31, 1981. There has been no activity on
either tentative map since that time.
According to advise from the City Attorney's Office, previous
approval (March 25, 1981) lapsed because the developer does not
maintain the bonds, fees, and can not fulfill the term
condition of his Subdivision Security Agreement with the City
within two (2) years.
New Tentative Tract Nos. 10459 and 10460 was approved by the
Planning Commission on September 2, 1986.
New Tentative Tract No. 10459 is a 32-10t, single-family
subdivision. New Tentative Tract No. 10460 is a 45-lot,
single-family subdivision.
The subdivider has indicated that they will bring in a Bond,
Certificate of Insurance, and fee will be paid prior to Council
meeting. Also. the improvement and grading plans have been
prepared and are approved.
The final map has been reviewed and found to be substantially
in compliance with the tentative map and the Subdivision Map
Act. Therefore, we recommend that the final map be approved.

RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
2 FINAL MAP FOR SUBDIVISION TRACT NOS. 10459 AND 10460, LOCATED
SOUTH OF OHIO AVENUE, WEST OF PINE AVENUE AND NORTH OF BELMONT
3 AVENUE. ACCEPTING THE PUBLIC DEDICATIONS AS SET FORTH ON SAID
MAP; AND AUTHORIZING EXECUTION OF THE STANDARD FORM OF AGREE-
4 MENT FOR THE IMPROVEMENTS IN SAID SUBDIVISION, WITH TIME FOR
PERFORMANCE SPECIFIED.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1:
The Mayor and Common Council find that
8 proposed Subdivision Tract Nos. 10459 and 10460, located South
9 of Ohio Avenue, West of Pine Avenue and North of Belmont
10 Avenue, together with the provisions for its design and
11 improvements, is consistent with the General Plan of the City
12 of San Bernardino.

SECTION 2:
The Mayor of the City of San Bernardino
14 is authorized on behalf of said City to execute the standard
15 form of agreement adopted by Resolution No. 84-8 with The Jenel
16 Company, for the improvements in said subdivi sion tract as are
17 required by Title 18 of the San Bernardino Municipal Code and
18 the California Subdivision Map.Act. The time for performance
19 is specified at 24 months. Said improvements are specifically
20 described and shown on Drawings No. 5842 and 5841, approved
21 and on file in the Office of the City Engineer of the City of
22 San Bernardino.

SECTION 3: The Final Map of said subdivision tract is
24 hereby approved and the Ci ty of San Bernardino hereby accepts
25 as public property all dedications within the subdivision as
26 shown on said Final Map for streets, alleys, (including access

precedent to approval of the Final Map, the Subdivider shall
first execute the agreement referenced in Section 2 hereof for
the improvements within said subdivision. The City Clerk shall
certify the approval and acceptance of the Mayor and Common
Council as set forth in this resolution.
I HEREBY CERTIFY that the foregoing resolution was
duly adopted by the Mayor and Common Council of the City of San
Bernardino at a meeting thereof, held on the
