That the Mayor and Common Council direct the Planning Department
to initiate a General Plan Amendment for the northwest corner of
Fifth Street and Flores Street, contingent upon submittal of required
information from the property owner, and that the Mayor qnd Common
Council ,waive processing and environmental review fees.

During the land use hearings for the adoption of the General
Plan, the northwest corner of Fifth and Flores Streets
(Assessor Parcel No. 138-08l, 18, 19) was designated RS,
Residential Suburban, which permits single-family dwelling
units at a density of 4.5 units per gross acre. The site
contains a vacant office building and a car wash which are
now nonconforming uses. The General Plan permits the con-
tinuance and minor expansion of existing nonconforming uses,
but the property owner, Charles Parker, requests a designa-
tion consistent with the existing uses.
The Urgency Ordinance does not permit General Plan Amendments
for six months after Plan adoption (June 2, 1989), unless
initiated by the Mayor and Common Council. Although a
General Plan Amendment doesn't guarantee that the designation
will be changed, it gives the Planning Commission and Mayor
and Common Council the opportunity to review the site.
The General Plan/Development Code Task Force reviewed options
for General Plan Amendments and directed the Planning Depart-
ment to develop a resolution that outlines a procedure for
processing amendments and waiving fees where the land use
designation has created a nonconforming use. This resolution
should be before the Mayor and Common Council for review and
approval in the near future.
RECOMMENDATION
I recommend that the Mayor and Common Council direct the
Planning Department to initiate a General Plan Amendment for
the northwest corner of Fifth and Flores streets. In order
to start the process, the applicant will be required to
submit the full application package and any special studies
that may be necessary. I also recommend that processing and
environmental review fees be waived for this project.
