STAFF REPORT
Assessment NO.1.
A complaint was received on July 27, 1989 in regard to abandoned vehicles
located in the area of Waterman & Central Avenues.
The owner was given a five (5) day courtesy notice, no volunteer action was
taken and a formal legal ten (10) day notice was issued on July 31, 1989. Legal
notice was mailed to land ad registered owners. No action was taken by either and
no appeal was filed. Vehicles were abated August 11, 1989.
There was one (1) vehicle towed for a total of $38.50 per vehicle, plus $100.00
administrative fee, total $138.50.

WHEREAS. the City of San Bernardino, pursuant to its authority
6 Chapter 8.36 of the San Bernardino Municipal Code, did lawfully give
7 otice of and thereafter abate public nuisances found to exist on the
8 roperties described in Exhibit "A" attached .hereto and incorporated in this
9 esolution; and
10 WHEREAS, pursuant to the San Bernardino Municipal Code, the
11 uperintendentof Public Buildings served notice to all property owners of
12 he abatement costs for removing abandoned" wrecked, dismantled, and/or
13 noperative vehicles or parts thereof from the property; and
14 WHEREAS, opportunity for a hearing. before the Board of Building
15 ommissioners to protest the .abatement costs was afforded the property
16 wners, with no response forthcoming;

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
18 OUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
19 SECTION 1. The Mayor and Common Council confirm and adopt as
20 pecial assessments, the following abatement costs which have been incurred
21 y the City for the abatement of public nuisances found to exist on the
22 ollowing properties:

SECTION 2. The above assessments shall be paid to Public Buildingsl
2 Parking Control, basement of City Hall, 300 N. "0" Street, San Bernardino,
3. CA. 92418, within thirty (30) days after notice of tbis resolution is mailed to

parties With an interest in the above properties. aU ~ses8DIents not
5 fully paid in thirty (30) days shall become a lien on the property pursuant
6 0 the San Bernardino Municipal Code and shall be collected as a special
7 assessment thereon.

SECTION 3.
If the
above assessment is not paid as hereinabove
rovided, the City Clerk is direc~ed to file a certified copy of this resolution
10 with the Auditor of the County of San Bernardino, State of California,
11

directing that said assessment be entered as a lien against the property as it
appears on the current assessment rolls. The assessment shall be collected
13 at the same time and in the same manner as the general property taxes for
14 the City of San Bernardino including penalties and interest for delinquent
15 payments.
16 The City Clerk shall also present for recording appropriate notices of
17 the imposition of these liens with the County Recorder.
18 I HEREBY OBRTIFY that the foregoing resolution was duly adopted by
19 the Mayor and Common Council of the City of San Bernardino.
