STAFF REPORT
Assessment No.1.
A complaint was received on July 17, 1989 regarding abandoned vehicles
located at 2426 E. 5th. Street, San Bernardino.
The owner was given a five (5) day courtesy, no volunteer action was
taken, and a formal legal ten (10) day notice was issued on July 26, 1989.
Legal notice was mailed to land and registered owners, no action was taken
by either party and no appeal was filed. Vehicles were abated August 15,
1989.
There were three (3) vehicles towed for a total of $415.50.

WHBREAS, the City of San Bernardino, pursuant to its authority
under Chapter 8.36 of the San Bernardino Municipal Code, did lawfully give
notice of and thereafter abate public nuisances found to exist on the
properties described in Exhibit "A" attached hereto and incorporated in this
resolution; and
WHBREAS. pursuant to the San Bernardino Municipal Code, the
Superintendent of Public Buildings served notice to all property owners of
the abatement costs for removing abandoned, wrecked, dismantled, and/or
inoperative vehicles or parts thereof from the property; and
WHBREAS. opportunity for a hearing before the Board of Building
Commissioners to protest the abatement costs was afforded the property
owners, with no response forthcoming;
NOW THBREFORE, BB IT RBSOLVED BY THB MAYOR AND COMMON
COUNCIL OF THB CITY OF SAN BBRNARDlNO AS FOLLOWS:
SBCTION 1. The Mayor and Common Council confirm and adopt as
special assessments, the following abatement costs which have been incurred
by the City for the abatement of public nuisances found to exist on the
following properties:

1 SECTION 2. The above assessments shall be paid to Public Buildings'
2 Parking Control, basement of City Hall, 300 N. "D" Street, San Bernardino,
3 CA. 92418, within thirty (30) days after notice of this resolution is mailed to
4 all parties with an interest in the above properties. all assessments not
5 fully paid in thirty (30) days shall become a lien on the property pursuant
6 0 the San Bernardino. Municipal Code and shall be collected as a special
7 ssessment thereon.
8 SECTION 3. If the above assessment is not paid as hereinabove
9 rovided, the City Clerk is directed to file a certified copy of this resolution
10 ith the Auditor of the County of San Bernardino, State of California,
n directing that said assessment be entered as a lien against the property as it
12 ppears on the current assessment rolls. The assessment shall be collected
13 t the same time and in the same manner as the general property taxes for
14 he City of San Bernardino including penalties and interest for delinquent
15 ayments.
16 The City Clerk shall also present for recording appropriate notices of
17 he imposition of these liens with the County Recorder.
18 I HEREBY CERTIFY that the foregoing resolution was duly adopted by
19 he Mayor and Common Council of the City of San Bernardino.
