Finding made that encroachment of private facilities within the street
easements are violations of City Codes, and direction is given to notify
property owners to remove said encroachments.
05-15-89 -- City Engineer and the City Clerk directed to proceed with the vacation of
the parkways on Meyers Road and Meyers Court within Tract No. 11118.

STAFF REPORT
This request was City initiated on 05-15-89 when Authorization to Proceed was
granted by the Mayor and Common Council. The proposed vacation is relative to
the many encroachments by the property owners along said streets. On 06-19-89,
Plan No. 7809 was approved.
All of the interested City Departments and Utility Companies were notified
of the proposal on 06-30-89, with a reply due by 07-28-89. The responses are
attached for your information. Easements were reserved for City waterlines and
hydrants, pedestrian access, sidewalks, street signs and lights, control and
maintenance of vision obstructions, Southern California Edison, General
Telephone, Southern California Gas, along with an easement reserved for public
utility purposes, as set forth in the attached Resolution of Intention.
On 08-24-89, a Notice of Exemption under Section 15301 of the California
Environmental Quality Act was issued for the proposed vacation of the parkways
along Meyers Road and Meyers Court.
The Resolution of Intention, whiCh sets a protest date of 10-16-89 has been
attached hereto for your action.
Upon the approval of said Resolution, all adjacent property owners will be
notified by mail of the hearing date.

A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF PARKWAYS ALONG MEYERS ROAD AND MEYERS COURT,
NORTHERLY OF LITTLE LEAGUE ORIVE, AND RESERVING EASEMENTS THEREIN.
BE IT RESoLvED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1.
Tha t the Mayor and Common Council of the City of
San

declares
its i ntenti on to order the vacati on
of the
parkways along Meyers Road and Meyers Court, Northerly of li ttle League
Drive, described as follows:

That portion of Tract No. 11118, recorded in Book 162 of
Maps, Page 59/60,Records of the County of San Bernardino,
State of California, described as follows:
Parcell: The Westerly 11.50 feet of Meyers Road lying
within the boundaries of said Tract, and the Easterly
11.50 feet of Meyers Road lying between the Southeasterly
corner of Lot 20 and the most Northerly corner of Lot 34.
Parcel 2: The Southeasterly and Southerly 6.50 feet and
the Northwesterly and Northerly 6.50 feet of Meyers Court
lying within the boundaries of said Tract.

SECTION 2.
That the Mayor
and Common Council of the City of San
in vacating the above described portion of said parkways,
18 elects to proceed under and in accordance with the provisions of
19 Chapter 3 of the .Public Streets, Highways and Service Easements Vacation
20 Law", being Division 9, Part 3, of the Streets and Highways Code of the
21 State of California.
22 SECTION 3. That the hour of 10:00 A.M, on the 16th of October,
23 1989, in the Council Chamber of the City Hall, San Bernardino, California,
24 be, and the same hereby is fixed as the time and place when and where all
25 persons interested in or objecting to the proposed vacation may appear
26 before the said Mayor and Common Council and offer evidence in
27 relation thereto. For further particulars as to the proposed vacation of
28 the hereinbefore described portion of said parkways, reference is made to

1 that map marked "Plan No. 7809" approved June 19, 1989, on file in the
2 office of the City Clerk of said City.
3 SECTION 4. Nothing in this Resolution shall in any way affect or
4 disturb any existing easements for public utility purposes belonging either
5 to the Ci ty of San Bernardi no or to any pub 11 c util i ty, and there is hereby
6 reserved for .future general pUblic utility purposes and for this City, an
7 easement reasonably necessary to locate such public utility facilities in,
8 over, under or across the real property hereinabove described and to use,
9 maintain, repair, replace or renew such facilities. There is also
10 specifically reserved for the City of San Bernardino, an easement and right
11 at any time, or from time to time to construct, maintain, operate, replace
12 and renew one or more pi pe li nes, fi re hydrant 1 a tera 15 and appurtenances
13 thereto, for the transportation of water, and for incidental purposes,
14 including the right of ingress and egress thereto. There is specifically
15 reserved for the City of San Bernardino, an easement in, over, under and
16 across the entire area of the proposed vacation, for pedestrian access,
17 sidewalks, street li9hts, street name signs, street signals and all
18 appurtenant facilities, and for their use, maintenance, repair, replacement
19 or renewal, also, there is hereby reserved for the City of San Bernardino,
20 an easement for the control and maintenance of vision obstructions and
21 appurtenant facilities. There is specifically reserved, an easement for
22 Genera 1 Telephone Company and Southern Ca liforni a Edison to construct,
23 place, operate, inspect, maintain, repair, replace and remove such aerial
24 and underground telephone, telegraph and communication structures and
25 electrical transmission structures, respectively, as the companies may from
26 time to time require, consisting of poles, anchors, wires, cables, conduits,
Z1 manholes, markers and necessary fixtures and appurtenances. SpeCifically
28 reserved for Southern California Gas Company is an easement and right at any

1 time, or from time to time to construct, mainta;n, operate, replace and
2 renew one or more pi peli nes and appurtenances thereto, for the
3 transportat;on of natural gas, and for ;nc;dental purposes, ;ncluding the
4 ri ght of ingress and egress thereto.
5 SECTION 5. That the City Engineer of the CHy of San Bernardino
6. hereby is directed to cause Notices of Street Vacation to be posted as
7 required by the Public Streets, Highways and Services Vacation Law.
8 SECTION 6. That the City Clerk shall certify to the adoption of
9 this Resolution of Intention and shall cause the same to be published once a
10 week for two successive weeks in The Sun, a newspaper published and
11 circulated ;n the C;ty of San Bernardino, prior to the date of the above
12 public hearing.
