SHD:GH:sm:2191H 3 o c o o o Redevelopment Agency S T A F F R E P 0 R T Recommended motion "A" would authorIze the transfer of $27.058 from the Patton Park Development Fund to pay for Change Order No. Three to the contract with Marina Contractor's Inc. which provides for the Installation of electrical service for picnic areas at Seccombe Lake Park. and which was approved by the Mayor and Common Council on July 17. 1989. The motion Is based upon Information presented at the Redevelopment Committee meeting of July 20, 1989. whIch showed that previously borrowed funds had been repaId. additional funds have been added In the current budget. and that the $27,058 would be replaced next fiscal year. An alternatIve action Is outlined below. BACKGROUND The attached agenda Item (previously submitted to the Mayor and Common Council) outlines the approved Change Order and recommends that the Patton Park Development Fund be used as the source of payment. The fund has been In place for several years and over that tIme, as other projects have been Identified as having a higher priority, funds have been borrowed to be replaced In the next fIscal year. At the end of 19B8-B9 fiscal year the fund had $559.971. however. $68.270 had been transferred out during the year, The current budget places $140.000 Into the Patton fund. so the $6B.270 has been repaid. The Seccombe Lake project amendment Is 'or an additional $27.058 and It has prevIously been recommended that the Patton Park fund would be the source of those monies. The Patton Park Fund would then be reimbursed In that amount next fiscal year. ALTERNATIVE ACTION As an alternative to the use of the Patton Park Development Fund, It would be possible to use Agency funds from the Central CIty East Project Area reserves If the Community Development Commission adopts the necessary benefit resolution. In adopting the resolution, the Commission must find that: a) .....the Improvements are of benefit to the Project Area and the Invnedlate neIghborhood In whlch the Project Area 15 located... n. and b) 00... that no other reasonable means of financing such Improvements are available to the convnunlty..... . The Improvements will Improve safety and reduce blight by provIding electrical power for events In the picnic area at the park. The Commission members must decide If there Is any other reasonable means of financing the Improvements. Recreation and Community Services, and the Executive Director of the Redevelopment Agency. Based on the information above, it is suggested that recommended motion "A" be approved by the Mayor and Common Council. COUNCIL ACTION c STAFF REPORT The addition of underground electrical services and a restroom building to the contract for construction of Phase I-B of Seccombe Lake Park, was approved in principle at the Council meeting of 5-15-89. The electrical services were to provide power for different groups that want to use the park for some function. These services were not included in the original design since this type of facility is not provided as a part of normal park design. A restroom building was shown on the conceptual design, but was not included in the contract plans and specifications due to a shortage of funds. Plans for installation of electrical services have been prepared by the Engineering Division. The Contractor has provided a price quote of $27,057.60 to install two electrical service pedestals, underground conduit and conductors, trans- formers and weatherproof lockable plug enclosures. These services will be installed along the sidewalk in the picnic area. We have reviewed the price quote and determined that it is fair and reasonable for the amount of work involved. c The approximate balance of $400,000 for Patton Park North was identified in the Staff Report for approval, in principle, as a possible funding source. Form Motion No. 1 will approve the transfer of $27,058 from Patton Park North to Seccombe Lake. Plans have also been prepared for the restroom building, and a price quote has been requested from the Contractor. We recommend that the transfer of funds and Change Order No. Three be approved. URGENCY CLAUSE: The Contractor's schedule for this project indicates that elec- trical underground work will be completed before the next Council meeting of 8-7-89. RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXPENDITURE OF CENTRAL CITY EAST PROJECT AREA FUNDS FOR PUBLIC IMPROVEMENTS (INSTALLATION OF UNDERGROUND ELECTRICAL SERVICES AT SECCOMBE LAKE PARK). WHEREAS. by Ordinance No. 3571 adopted on May 3. 1976. and amended by Ordinance No. MC - 563 adopted on December 9, 1986, the Mayor and Common Council of the City of San Bernardino adopted and approved a certaIn amended Redevelopment Plan (the "Redevelopment Plan") for the Central City East Project (the "Project"); and WHEREAS. pursuant to the Community Redevelopment Law of the State of California (Health and Safety Code Section 3300, et sea.). the Redevelopment Agency of the City of San Bernardino (the "Agency") is ~ carrying out the Redevelopment Plan for the Project in the redevelopment project area (the "Project Area"); and ,0 WHEREAS, in furtherance of the Project. the City of San Bernardino and the Agency entered into an agreement with Marina Contractors. Inc.. ("Contractor") for the construction of See combe Lake Park. Phase l-B at a cost of $2,048.180.32. in accordance with Plan N. 7444; and the City of San Bernardino has approved Change Order Number Three to the contract with Marina Contractor's Inc.. to authorize Contractor to install underground electrical services in Seccombe Lake Park at an additional cost of $27.057.60. Pursuant to the Change Order, Contractor. will install two electric service pedestals, underground conduIt and conductors. transformers and weatherproof lockable plug enclosures along the sidewalk in the Seccombe Lake Park Picnic Area. - 1 - - . o o o To fund these improvements.,the Agency desires approval of the use of funds from the Central City East Project Area account. WHEREAS. the Improvements are of benefit to the Project Area and the immediate neighborhood of the Project Area in that they will provide electrical power for events at the Picnic Area In Seccombe Lake Park, improve safety, and contribute to the elimination of blight; and WHEREAS, no other reasonable means of financing such Improvements are available to the community; and NOW. THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO DOES HEREBY RESOLVE AS FOLLOWS: Section 1: The Agency hereby determines that the Improvements are of benefit to ~ the Project Area and the immediate neighborhood in which the Project Area is located. and that no other reasonable means of financing. such Improvements are available to the community, and the Agency hereby consents to the Project Area paying for the Improvments. The determination that the Improvements will benefit the Project Area is based upon the fact that the Improvements will provide electrical power for events at the Picnic Area in See combe Lake Park, improve safety, and contribute to elimination of blight.
