It is requested that the Mayor and Common Council adopt a formal resolution
establishing compensation for members of the Community Development Commission
as recommended by Senior Assistant City Attorney Dennis A. Barlow in the
attached memorandum.

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO ESTABLISHING COMPENSATION OF COMMUNITY DEVELOPMENT
COMMISSION MEMBERS AT $75 PER MEETING.

4 WHEREAS, Health and Safety Code Section 34130 provides that
5 the legislative body shall establish compensation for the
6 Commissioners of the Community Development Commission, and
7 WHEREAS, such compensation has been established at $75 per
8 meeting by motion and by the annual adoption of the Budget, and
9 WHEREAS, it is appropriate to formalize the establishment
10 of such compensation,
12 Commissioners of the Community Development Commission shall be
11 NOW THEREFORE BE IT RESOLVED that the compensation for
13 established at $75 per meeting or adjourned meeting for each
14 Commissioner, provided, that the compensated meetings shall not
15
exceed four (4) in any calendar month, and that a Commissioner to
16 be compensated must be present during some part of the
17 consideration and/or action on a Commission Agenda item.
18 I HEREBY CERTIFY that the foregoing resolution was duly
19 adopted by the Mayor and Common Council of the City of San
20 Bernardino at a meeting thereof, held on the

Resolution establishing compensation for members of the
Community Development COmmission
From time to time, questions have arisen relative to the
appropriate compensation for the members of the Community
Development Commission. In attempting to answer these questions,
it has become apparent that the formal authorization for such
compensation has, in fact, been rather informal. Apparently the
original authorization was by motion and then has been annually
authorized with the budget. It would be beneficial to adopt a
formal resolution clearly establishing the compensation which
both staff and outside auditors can point to for authority.
The proposed resolution contains two provisos for the
payment to be authorized:
1. There may only be 4 compensated meetings in any
calendar month. This mirrors the State statute
relative to redevelopment agency governing bodies
apparently to assure that the governing body of the
agency does not call numerous meetings in order to
provide itself increased compensation. This issue
would most often arise where the City Council and the
agency board are separate bodies, but it seems
appropriate to retain the restriction here.
2. The second proviso is that in order to be
compensated a Commissioner must be present during
some part of the Commission agenda. This is the
result of the practice of the Commission in not
formally adjourning the Commission meeting until
the conclusion of all the City Council business.

Memo to Redevelopment Committee
Re: Resolution establishing compensation for members
of the Community Development Commission
This presents the possibility that a Commissioner could
be in attendance in the afternoon, technically before
the Commission had adjourned, but not during any of the
Commission business. When this situation actually
arose, staff questioned whether legally the
Commissioner could be paid. The issue was resolved
when the Commissioner declined payment, but the
question should be formally answered by the Council.
As a final note, this is a Council resolution rather than a
Commission one, because Health and Safety Code Section 34130
requires that the compensation be set by the legislative body,
which is the Council.
