It is requested that the Commission authorize the Executive Director to pledge
Agency assets to the Planning Department guaranteeing Jim Rock's performance
under MC 19,68,100 which requires financial guarantees of performance prior to
issuance of a building permit and completion of the work "within 120 days.
BACKGROUND
On July 5, 1989 a DDA was executed with Jim Rock which provided for the
relocation and restoration of the Miles House, the last two story Queen Anne
style Victorian house remaining in San Bernardino, onto Agency-owned property
immediately adjacent to and south of the San Bernardino Historical Society's
property located at the southwest corner of 8th and "D" Street, The Miles
House is currently located immediately adjacent to and west of the Historical
Society's property.
While applying for a Conditional Use Permit to move the house, the Developer
became aware of MC Sec, 19,68.100 which requires that financial guarantees be
provided to secure performance and that the work be completed within 120 days
of issuance of the building permits, It is estimated that the financial
guarantees will not exceed $216,000.

At its July 18, 1989 meeting, the Planning Commission recommended to the
and Common Council that the 120 day requirement be modified to provide
completion on or before July I, 1990 to conform to the DDA,

As the financial guarantee requirement cannot be waived, the Planning
Commission imposed a condition specifying an approved instrument of credit
must be deposited before a building permit is issued. The instrument of
credit would have to guarantee the Developer's performance up to approximately
$216,000. Given the tight nature of the project's overall economics, it is
staff's opinion that the project cannot bear the extra expense of obtaining
the bond required by MC 19,68,100 and still remain economically viable,
Agency assistance in providing this financial guarantee is therefore
appropriate,
RECOMMENDATION
It is, therefore, recommended that the Executive Director be authorized to
execute such guarantee securing the Developer's performance under MC Sec.
19,68,100,
