Synopsis of Previous Council action:
On June 29, 1989 the Development Review Committee unanimously recommended
approval of Conditional Use Permit No. 89~25 to the Planning Commission.
On July 5, 1989, the Mayor and Council adopted the Disposition and Develop-
ment Agreement (DDA) with Rock Enterprises for the sale of the subject,
Agency owned property. The Mayor and Council also designated the sub-
ject house (Miles House) as a qualified historical building of importance
to the City of San Bernardino.
On July 18, 1989 the Plan'ning Commission unanimously reco~ended approval
of Conditional Use Permit No. 89-25 to the Mayor and Common Council, sub-
ject to the Findings of Fact and Conditions attached to the staff report.
Recommended motion:
That the Mayor and Council approve ConditioQal Use Permit No. 89-25,
subject to the attached Findings of Fact, standard requirements and
conditions of approval.

STAFF REPORT
Subject: Conditional Use Permit No. 89-25
Mayor and Council Meeting of August 7, 1989
REOUEST
The applicant, Jim Rock, Rock Enterprises, is requesting
. approval of a Conditional Use Permit to allow the relocation
and commercial conversion of the historically designated
Miles House. The applicant proposed moving the structure to
an 18,687 square foot lot located on the west side of "D"
Street immediately south of the Heritage House.
BACKGROUND
On June 29, 1989 the Development Review Committee unanimously
recommended that the Planning commission recommend approval
of Conditional Use Permit No. 8925 to the City Council.
On July 5, 1989 the City Council approved a Disposition and
Development Agreement (DDA) with Rock Enterprises for the
sale of the subject property adjacent to the Heritage House.
The purpose of the DDA is to allow for the relocation'and
restoration of the Miles House, the last remaining two-story
Queen Anne style victorian house in the City. The City Coun-
cil also designated the Miles House as a qualified historical
building of importance.
On July 18, 1989 the Planning Commission unanimously recom-
mended approval of Conditional Use Permit No. 89-25, subject
to the ,Findings, standard requirements and conditions con-
tained in the staff report to the Mayor and Common Council.
ANALYSIS

The Miles House is currently located at 439 West Eighth
Street. The applicant proposes to move the structure to the
lot located immediately south and adjacent to the Heritage
House. The structure will be moved entirely on private
property.
The proposed site plan indicates fifteen (15) parking spaces
are provided as the required parking easement for the
Heritage House. The remaining parking exceeds Code
requirements for the proposed use. All other Codes relative
to landscaping, setbacks and building height have been met.

completed within 120 days from the date of issuance of the

General Plan. Historic buildings require more care to assure

2. SITE LOCATION
The subject property is located on the west side of North "0"
street approximately 82.5 feet south of 8th Street on a lot
itnme,liately south of the Heritage House. The lot is
currently developed as a parking lot for use by the adjacent
Heritage House. (See Attachment F, Location Map.)
:1. MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed project is proposed to be located on a site with
" (cI".,ral Plan Land Use Designation of CR-2, Commercial
Heolondl, Downtown. This designation permits professional
otr,u~es, the proposed use of the structure. The propoSed
s.U:e plan meets the density, height, design and development
guidelines of the General Plan. (See Attachment A).

structure is the last two-story Queen Anne style, victorian
house remaining in San Bernardino. It is most commonly known
as the Miles House. On July 5, 1989, the City Council
designated the Miles House as a qualified historical building
of importance to the city of San Bernardino and approved a
Disposition and Development Agreement (DDA) with Rock
Enterprises for the sale of the subject, agency owned
property. The DDA calls for a facad easement on the Miles
House and requires an easement for 14 parking spaces for the
Heritage House. (See Attachment E, Redevelopment Agency Staff
report) .
6. ANALYSIS

The proposed site plan indicates that the structure will be
located 8.5 feet from the south property line, 25 feet west
of "0" Street. These setbacks meet the requirements of Title
19 and the General Plan. A total of 31 parking spaces are
proposed. Fifteen (15) of the spaces are required parking
easement for the Heritage House. There will be an excess of
five (5) parking spaces for both proposed uses. The site
plan proposes landscaping that greatly exceeds the minimum
req'1ired. The applicant has indicated that the site and
stnlct.ure will be renovated to reflect the year in which it
",1:: originally built. The structure will be converted to a
nrofessional office uses in conformance with Title 24,
ifj :;t;oric Building Code. The exterior of the structure will
,let be modified to reflect a commercial use, it will be
rt$tored to its original design. The structure will be in
harmony with the predominant architectural style of the area
in ,,!hich it is to be located adj,acent to the Heritage House.
!~c General Plan, adopted by the Mayor and Council on June 2,
1989, provides many pOlicies addressing historic
preser~ation. In particular, there are policies that call
for the allowance of flexibility in building code
requirements and waivers of building permit fees for owners
of small properties with historic resources. Because the
Gen~ral Plan is newly adopted these policies have yet to be
implemented and we don't have codes that address these
policies.

cu:cr:ently, Code section 19.68.070 requires that the work be
cfJmpleted within 120 days from the date of issuance of the
building permit for the building moving; because this is not
'" normal building moving, in the sense that the structure is
historic, more care and time is necessary to renovate the
structure. The DDA requires the work to be completed by
July, 1990. Since we do not have a code that addresses
historic buildings, staff recommends that the time frame
established by the DDA to complete the work be adhered to.
(See Attachment F.)
The Code 'also requires an approved instrument of credit or
other security from a financial institution to guarantee the
faithful performance and completion of the terms and
conditions of the permit in an amount equal to the estimated
cost necessary to cover such faithful performance, but in no
case less than the sum of ten thousand dollars. A condition
indi;:atingthis requirement has been attached.
Finally, the Code requires as a Condition of Approval for all
building movings that the applicant, upon ,such building or
structure being moved off a lot, shall clear the site from
which the building or structure is being moved within a
period of thirty days after removal of the building or
stru~'ture. This condition has also been attached. (See
',c.~' J~llment C, Conditions).
CONCLUSION
The proposed location and renovation of the subject structure
will be in harmony with the predominant architectural style
\ at tche area in which it is to be located and will meet all

1. The proposed use conforms to the objectives of the
city's General Plan elements in that the designation is
for commercial regional which allows professional
offices. The proposed preservation of an historic
structure implements many of the policies outlined in
the Historical and Archaeological Resources element of
the General Plan.
2. The proposed use will not adversely affect the adjoining
land uses and growth and development of the area in
which it is proposed to bel located in that it is a
commercial use located within an historic structure that
has been renovated. This proposal blends well with the
surrounding development in architecture and size.

3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed
use in a manner not detrimental to the particular area
nor to the peace, health, safety and general welfare in
that the particular land use designation has no minimum
lot size and the proposal meets all required development
standards including parking, setbacks and landscaping.
The traffic generated by the proposed use will not pose
an undue burden upon the streets and highways designed
and improved to carry the traffic in the area in that
North "D" street, a secondary arterial, is adequate for
commercial traffic.

Granting of the Conditional Use Permit under the condi-
tions imposed if any, will not be detrimental to the
peace, health, safety and general welfare of the
citizens of the CIty of San Bernardino in that there is
no change in land Use. The streets are designed to
carry any increased traffic and the proposed renovated
structure is similar in architectural style and size of
the adjoining building.

Conditional Use Permit 82-25 shall be in effect for a
period of 12 months from the date of approval. However, if no
development has been initiated at the end of the 12 month
period, the application shall expire. Additional time may be
approved upon request of the applicant prior to expiration of
the 12-month period. Expiration Date: July 18, 1990.
PARKING:
a. This development shall be required to maintain a minimum of
31 standard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two
inches of AC over a suitable base or equivalent as approved
by the City Engineer. Parking spaces shall be striped and
have wheel stops installed at least three feet from any
building, wall, fence, property line, or walkway.
c. Whenever an off-street parking area is adjacent to or
across an alley from property zoned residential, a solid
decorative wall six feet in height shall be erected and
maintained along the property line so as to separate the
parking area physically from the residentially zoned
property provided such wall shall be three feet in height
when located within the required front or street side yard
setback. Where no front or street side yard is required,
such wall shall be three feet in height when located within
ten feet of the street line.
d.' Whenever an off-street parking area is located across the
street from property zoned for residential uses, a solid
decorative wall or equivalent landscape berm not less than
three feet in height shall be erected and maintained along
the street side of the lot not closer to the street than
the required depth of the yard in the adjoining residential
area. No fence or wall located in the front setback shall
obscure the required front setback landscaping.

Lighting levels on the exterior of building is to provide a minimum of one
(l) foot candle of "maintained" illumination on the parking surface from

All exterior doors to building shall be equipped with an illumination
device capable of providing a minimum of one (I) foot candle of maintained
illumination at ground level during hours of darkness.
All exterior lighting devices are to be inaccessible to common reach or
climbing shall be protected by weather and vandalism-resistant and be
valdal resistant. All exterior lighting shall be projected so as not to
cast light onto adjoining properties.
All roof openings giving access to the building shall be secured with
either iron bars, metal gates, stamped metal or shall be alarmed and meet
with approval of the Police Department.

The question has been raised whether the movement and
renovation of the Miles House must be completed in 120 days in
accordance with San Bernardino Municipal Code Section 19.68.070.

The Miles House is the last remaining two-story Queen Anne
Style Victorian house remaining in San Bernardino. The developer
proposes to move the house from 8th Street through the block to
"D" street, to be located adjacent to and west of the Heritage
House. The structure will be restored to its original design and
will be landscaped and developed to be in harmony with the
predominant architectural style of the area. Although the
outside appearance will remain residential, the use will be
converted to professional office uses. The Mayor and Common
Council have designated the Miles House as a qualified historical
building of importance to the City of San Bernardino and, sitting
as the Community Development Commission, have approved a
Disposition and Development Agreement which provides for
completion by July, 1990.
Chapter 19.68 of the San Bernardino Municipal Code
purportedly regulates the movement of "any building or
structure," however, the chapter is silent as to the movement and
restoration of historical buildings. Such buildings naturally
require more care in all aspects of the development to assure the
preservation of the structure, and more time is required in the
completion of the entire project due to the numerous additional
steps required in restoration. Chapter 19.68 was not directed to

these issues and clearly did not contemplate the movement of
historical buildings. However, the protection and preservation
of the history and culture of San Bernardino is provided for in
the recently adopted General Plan. Specific ordinances must be
developed to carry out the requirements of that document. In the
meantime, it would be contrary to the purpose, intent and
language of the General Plan to adhere so specifically to the
language of the outdated ordinances that the ability to protect
the remaining historical structures of the City is lost forever.
It is the recommendation of this office that, from a legal
standpoint, the provisions of Chapter 19.68 should be used in
this instance as a guide and the Commission should impose a
reasonable time limit on the completion of the move and
restoration of this historic structure.
