That the City Manager is hereby authorized to execute Amendment No.2 to Contract 05/06-747-0056 RD with the San Bernardino City Unified School District for the Creative Before and After School Program for Success (CAPS) for FY 08/09. A copy of said 10 11 document is attached hereto and marked Attachment "A". 12 SECTION 2. Morris, Mayor Ity of San Bernardino ^-'"' U1f1 ~un e1 2008-246 Contract No.: 05/06-747-0056 RD Amendment No.2 SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT 777 North F Street San Bernardino, CA 92410 AMENDMENT NO. 2 TO THE AGREEMENT FOR THE CREATIVE BEFORE AND AFTER SCHOOL PROGRAM FOR SUCCESS (CAPS) THIS AGREEMENT is made and entered into this 1st day of July 2008, by and between the SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT, hereinafter referred to as the "DISTRICT", and CITY OF SAN BERNARDINO PARKS, RECREATION & COMMUNITY SERVICES DEPARTMENT, hereinafter referred to as the "CITY". RECITALS WHEREAS, the DISTRICT is authorized by Section 53060 of the California Government Code to contract with and employ any persons for the furnishing of special services and advice in financial, economic, accounting, engineering, legal, or administrative matters, if such persons are specially trained and experienced and competent to perform the special services required; and, WHEREAS, the CITY itself is, or those hired by the CITY are, specially trained, experienced and competent to render the special services requiredbylhe DISTRICT, and such services are needed on a limited basis; and, NOW, THEREFORE, the DISTRICT and the CITY mutually agree to amend the Master Agreement as follows: I. TERM OF AGREEMENT A. This Agreement shall be for a period beginoing July 1, 2008, through June 30, 2009 with three anoual options to renew at the discretion of the DISTRICT. IV. CITY'S FEE AND PAYMENT THEREOF A. The DISTRICT agrees to compensate the CITY for services rendered in a total amount not to exceed $266,000.00 (two hundred sixty six thousand dollars) based on the 2008-09 PARKS and RECREATION ESTIMATED COST, dated April 29, 2008, and attached hereto as Exhibit I which details the DISTRICT school sites participating under the Master Agreement, the number of YMCA NCLB qualified employees and YMCA Grandfathered employees for each site and their respective rates of pay. This Amendment is effective upon execution. In the event of any conflict or inconsistency between the provisions of this Amendment and the original Agreement, the provisions of this Amendment shall control. All other terms and conditions of the original Agreement shall remain the same.
