HomeMy WebLinkAbout2008-165 1 2 RESOLUTION NO. 2008-165 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE 3 AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND 4 AMONG THE CITY OF SAN BERNARDINO AND THE CITY OF HIGHLAND RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 3096 5 FOR THE AREA GENERALLY LOCATED AT THE NORTHERLY TERMINUS OF APPLEWOOD STREET IN THE CITY OF SAN BERNARDINO. 6 7 8 9 10 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby find and determine that: 11 A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the 12 issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer, 13 the governing bodies of all local agencies whose service area or service responsibilities will be 14 15 altered by a proposed jurisdictional change shall negotiate and determine by resolution the 16 amount of property tax revenues to be exchanged between and among such local agencies. 17 B. The Mayor and Common Council of the City of San Bernardino and the 18 Mayor and Council of the City of Highland have determined the amount of property tax revenues 19 to be exchanged as a result of jurisdictional change described by LAFCO 3096, reorganization 20 between the City of San Bernardino and the City of Highland, generally located at the northern 21 terminus of Applewood Street and Church Street. 22 23 24 25 26 27 28 SECTION 2. The amount of tax revenue to be exchanged between the City of San Bernardino and the City of Highland resulting from the above jurisdictional change is shown on Exhibit "A", attached hereto and incorporated herein by reference and is hereby approved and accepted. 05/07/08 2008-165 RESOLUTION DETERMINING THE EXCHANGE OF PROPERTY TAX REVENUES BETWEEN THE 1 CITY OF SAN BERNARDINO AND THE CITY OF HIGHLAND RESULTING FROM A CHANGE OF JURISDICTIONAL BOUNDARIES DESCRIBED BY LAFCO 3096. 2 3 4 SECTION 3. The annual tax increment generated in the areas subject to the jurisdictional change and attributable to the local agencies whose service area or service responsibilities will be 5 6 altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the 7 8 9 10 provisions of Section 98 of the Revenue and Taxation Code. SECTION 4.
