STAFF REPORT
On June 3, the Mayor and Council accepted the bid of the Loewen
Group International, Inc., for the sale of Pioneer Memorial
Cemetery. Escrow was opened on July 3, and the bid specifications
stated that the sale must close 60 days from that date.
In August, the Council authorized the extension of escrow through
October 18. This extension was granted to allow time for the Lowen
Group to obtain the certificate of Authority from the state
Cemetery Board to operate the cemetery, and to finish negotiations
related to the sales agreement.
The sales agreement is now in the final stages of development. It
is anticipated that this will be brought forward for Council
approval on October 21. However, the Lowen Group has still not
been issued its certificate of Authority from the state. Since the
sale cannot close until that certificate is issued, it is necessary
to extend the escrow period.
The attached resolution will grant the Mayor the authority to
extend the close of escrow for another sixty days. It is
anticipated that this will allow sufficient time for all actions
necessary to close the sale.
