HomeMy WebLinkAbout1986-459 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 86-459 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE SALE OF THAT CERTAIN PROPERTY IDENTIFIED AS A PORTION OF LOT 31, TRACT NO. 12034, LOCATED ON VANDERBILT WAY, NORTHWESTERLY FROM CARNEGIE DRIVE, WITHIN THE TRI-CITY PROJECT AREA, AND A COMPUTER AIDED DISPATCH SYSTEM AND A CITY HALL TELEPHONE SYSTEM BY THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO TO THE CITY OF SAN BERNARDINO (HEALTH AND SAFETY CODE SECTION 33433). BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. A. The Community Development Commission of the City of San Bernardino (hereinafter "Commission"), proposes to lease and sell to the City of San Bernardino (hereinafter "Developer"), that certain parcel of property identified as a portion of Lot 31, Tract No. 12034, the exact legal description of which is annexed hereto as Exhibit "A" and is incorporated herein by reference. The Commission also intends to lease/sell to Developer a computer aided dispatch system and a City Hall telephone system. The lease/sale price will be the payment over a period of time in an amount sufficient to pay the principal of $2,875,000, plus interest, as required by Certificates of Participation to be issued. B. Notice of the time and place of hearing has been given as required by law. C. The Commission has made available for public inspection and copying a Summary of Financial Aspects of the proposed sale. D. The Summary of Financial Aspects represents that the fair market value of the interests to be conveyed by the Commission, determined at the highest use permitted for such property, is $3,250,000, and the sum of the lease payments which 1 :D will be made pursuant to the lease will produce a total sum 1 2 greater than $3,250,000. 3 E. All hearings have been held as required by Health and 4 Safety Code Section 33433. 5 SECTION 2. Determination. Based upon the representations 6 of the Commission, it is found and declared that the 7 consideration for the lease/sale of the real property described 8 above and the personal property, in accordance with covenants and 9 conditions governing the lease and sale, is not less than the 10 fair market value of the property determined at the highest use 11 permitted under the Plan for the Tri-City Redevelopment Project 12 Area. 13 SECTION 3. Approval. The Mayor and Common Council of the 14 City of San Bernardino hereby approves this lease/sale of said 15 property upon the terms and conditions set forth in this 16 resolution and the Summary of Financial Aspects. 17 I HEREBY CERTIFY that the foregoing resolution was duly 18 adopted by the Mayor and Common Council of the City of San 19 Bernardino at a reoular meeting thereof, held on the 20 3rd day of November , 1986, by the following vote, to 21 wit: 22 23 24 25 26 27 28 AYES: Council Members Estrada. '.-'0 City Attorney 3 LEGAL DESCRIPTION FIRE STATION SITE Being a portion of Lot 31, Tract No. 12034, per map on file in Book 168 of Maps, Pages 75-87, Records of San Bernardino County, State of California, more particularly described as; BEGINNING at the Southwest corner of Lot 31, thence Northerly along the West line of said lot, a dfstance of 290.00 feet; THENCE South 890 58' 58" East, a distance of 225.00 feet; THENCE South 000 01' 02" West, a distance of 190.00 feet; THENCE South 210 15' 19" 'West, a distance of 143.18 feet; to a point on a non-tangent curve through which a radial line bears North 210 15' 19" East with a radius of 493.00 feet; said point being on the North right of way of Vanderbilt Way; THENCE Northwesterly along said curve through a central angle of 200 36' '16", a distance of 177.29 feet to the TRUE POINT OF",BEGINNING.
