RESOLUTION NO. 86-448
2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
APPLICATION FOR 1986 STATE GRANT FUNDS FOR DEVELOPMENT AND
3 REFURBISHMENT OF PARK AND PLAYGROUND FACILITIES AT PATTON,
NUNEZ, NINTH STREET, PERRIS HILL, BLAIR, LYTLE CREEK AND
4 MEADOWBROOK PARKS UNDER THE PROVISION OF THE COMMUNITY
PARKLANDS ACT OF 1986 AND AUTHORIZING THE DIRECTOR OF PARKS,
5 RECREATION AND COMMUNITY SERVICES TO EXECUTE AND SUBMIT ALL
DOCUMENTS NECESSARY TO COMPLETE THE AFORESAID PROJECTS.

WHEREAS, the people of the State of California have
enacted the Community Parklands Act of 1986, which provides
funds to the State of California and its political
subdivisions for acquiring lands and for developing facilities
for public recreation and historical purposes; and
WHEREAS, the State Department of Parks and Recreation has
been delegated the responsibility for the administration of
the program within the state, setting up necessary procedures
governing application by local agencies under the program; and
WHEREAS, said procedures established by the State
Department of Parks and Recreation require the applicant to
certify by resolution the approval of applications prior to
submission of said applications to the state; and
WHEREAS, said applications contain assurances that the
applicant must comply with; and
WHEREAS, the applicant agency will enter into an
agreement with the State of California for the acquisition,
development, rehabilitation or restoration of the projects;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION .1. The Mayor and Common Council approve the
filing of applications for 1986 state grant assistance for:

SECTION 2. The Mayor and Common Council certify that the
City understands the assurances and certification in the
application;
SECTION 3. The Mayor and Common Council certify that the
City has or will have sufficient funds to operate and maintain
the projects;
SECTION 4. The Mayor and Common Council certify that the
City will complete the projects within three years from date
of approval by the state;
SECTION 5. The Mayor and Common Council certify that the
city has reviewed and understands the General provisions
contained in the state/local agreement; and appoints the
Director of Parks, Recreation and Community Services as agent
of the City to conduct all negotiations, execute and submit
all documents, including but not limited to applications,
agreements, amendments, payment requests, and so on, which may
be necessary for the completion of the aforementioned
projects.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

1. The grant recipi~nt hereby glves assurance and cErtlfl€S wlth r~spect to tht
grant that:
1t possessps legal authority to apply for thE grarlt, and to flnanCE., ae-gt.'lre
and construct the proposed project; that a refo}utloD, motlon or siml1ar aellor,
has been duly adopted as an official act of the appllcant's governIng body,
authorizing the flling of the applicatlon, includlng all understandings and
assurances contained therein, and dlrectlng and authoriZIng the person 16ent]-
fied as the official representative of the applicant to act in connection
with the application and to provIde such additional informatIon as may be requlred.
2. 1t understands that grant funds must be appropriated by the State Legislature
before costs can be incurred against the grant.
3. It will cause work on the project to be commenced within three years of appro-
priation and agrees to make the property to be acquired Of developed opeT,
to use by the public by the DATE SPECIFIED IN THE AGREEMENT ~HICH WILL NOT
BE MORE THAN THREE YEARS AFTER THE DATE UPON WHICH THE PROJECT WAS APPROVED
BY THE STATE.
4. It wlll provide and maIntain competent ane adequate arc[-,J.tectul-al/englnEEflng
supervlsion and inspection at the constructIon SIte to Insure that the complEted
work conforms with the plans and specifications; that it WIll furnisr) progress
reports and such other information as the StatE may require.
s. It WIll give the State's authorized representative access to and the rIght
to examine all records, books, papers or documents related to the grant.
6. It will not dispose of or encumber its title or other interests in the site
and facilities without permission from the State Legislature.
7. For each individual project listed on the front of thIS form, it will submit
appropriate California Environmental QualIty Act documents, a p~oject lnfor-
mation form, cost estimates for development projects, an acquisitIon schedule
for acquisition projects, site and location mar and appropriate engineerIng
and/or acquisitio~ certifications. [ThIS information must be submitted before

8. In cases lnvolving leased property, it a~rees to maintaIn and opErate the
prapprty and/or facilities acquired or developEd for an agreed to perloci com-
