2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
3 RELATING TO THE RESURFACING OF PUMALO AVENUE FROM GOLDEN AVENUE
TO DEL ROSA AVENUE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Mayor of the City of San Bernardino is hereby
7 authorized and directed to execute on behalf of said City an
8 Agreement with the County of San Bernardino relating to the
9 resurfacing of pumalo Avenue from Golden Avenue to Del Rosa
10 Avenue, a copy of which is attached hereto, marked Exhibit nAn and
11 incorporated herein by reference as fully as though set forth at
12 length.

IT IS HEREBY AGREED AS FOllOWS:
(Use space below and additional bond sheets. Set forth service to be rendered, amount to be paid, manner of payment, time
for performance or completion, determination of satisfactory performance and cause for termination, other terms and
conditions, and attach plans, specifications, and addenda, if any.)
WHEREAS, COUNTY and CITY desire to cooperate and jointly participate in
a project for the heater scarifing and resurfacing of Pumulo Avenue from
Golden Avenue to Del Rosa Avenue hereinafter referred to as PROJECT; and
WHEREAS, PROJECT is partially in the unincorporated area of the COUNTY
and partiall y wi thin the incorporated area of the CITY, and will be of
mutual benefit to the COUNTY and CITY; and
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each agency in relation to the performance of the proposed
resurfacing.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
CITY SHALL:
1.
Act as the Lead Agency in the design and construction of the PROJECT.
2.
Bear responsibility for the cost of the portions of the PROJECT
lying with the incorporated area of CITY. Said cost is currently
estimated to be $12,788.
3.
Provide specifications and estimates to County and obtain a no
cost permit from County prior to construction.

4. Upon completion of PROJECT, provide a cost analysis showing a
breakdown of the PROJECT costs in the incorporated area of the
CITY and in the unincorporated area of the COUNTY.
COUNTY SHALL:
1. Bear responsibility for the cost of the portions of the PROJECT
within the unincorporated area of the COUNTY. Said cost is currently
estimated to be $19,200 and shall not exceed $21,000 unless approved
by the COUNTY in writing.
2. Pay the COUNTY'S share of the costs within 30 days after submittal
of the cost analysis and hilling by the CITY.
IT IS MUTUALLY AGREED AS FOLLOWS:
1. Neither party to this Agreement nor officers nor employees thereof
shall be responsible for any damage or liability occurring by
reason of anything done or omitted to be done by the other party
to the Agreement under or in connecti on with any work, author i ty
or jurisdiction not delegated to the parties under this Agreement.
It is also agreed that, pursuant to Government Code Section 895.4,
each party shall fully indemnify and hold the other party harmless
from any liability imposed for injury (as defined by Government
Code Section 810.8) occurring by reason of anything done or omitted
to be done under or in connection with any work authori ty of
jurisdiction under this Agreement
2. Upon completion of the PROJECT, the CITY and COUNTY will maintain
the portions of the work under their respecti ve areas of jurisdiction.
3. PROJECT costs shall include construction costs, any utility relocation
costs which are the responsibili ty of the public agency and preliminary
and construction engineering costs which shall be prorated between
the CITY and COUNTY based on each agency's share of the total
contract costs.
