2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A MONTH TO MONTH RENTAL AGREEMENT AT A COST OF
3 $225.00 PER MONTH WITH WILLIE CLARK RELATING TO PREMISES
LOCATED AT 2656 WEST FOOTHILL BOULEVARD.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said
8 City a month to month rental agreement at a cost of $225.00
9 per month with Willie Clark relating to premises located at
10 2656 West Foothill Boulevard, a copy of which is attached
11 hereto, marked Exhibit "A" and incorporated herein by
12 reference as fully as though set forth at length.

AGREEMENT
(Community Police Center)
THIS AGREEMENT is made and entered into this () day

, 1986, by and between the CITY OF SAN
BERNARDINO, a municipal corporation, hereinafter called
"Tenant", and WILLIE CLARK, hereinafter called "Landlord".
Landlord and Tenant agree as follows:
1. Recitals.
(a) Landlord is the owner of the premises described as
2656 West Foothill Boulevard, in the City of San Bernardino,
and desires to rent said premises to City for use as a
community service office by the Police Department of the City
of San Bernardino.
(b) Tenant desires to rent the premises from Landlord
pursuant to the provisions stated herein.
2. Description of Premises.
Tenant rents the premises located at 2656 West Foothill
Boulevard, City of San Bernardino, County of San Bernardino,
State of California, and the pertinent rights. City shall
have full and unimpaired access to the premises at all times
and the nonexclusive right to use common areas including
parking areas.
3. Term.
The rental agreement shall be for a month to month
tenancy commencing on July 1, 1986 and continuing thereafter
on a month to month basis until terminated by either of the
parties.
4 . Rental.

1 The rental for said premises hereinabove described shall
2 be at the rate of $225.00 per month payable in advance or
3 before the 15th day of each month.
4 5. Use of Premises.
5 Tenant shall use said premises as and for a community
6 police center or for any other lawful public purpose.
7 6. PaYment of utilities.
8 Tenant shall pay for all utilities for use of the
9 premises for the term hereof, including electricity, gas,
10 water, refuse removal and telephone service.
11 7. Dutv to Maintain and Repair Premises.
12 Tenant shall maintain all internal portions of the
13 premises in good condition and shall keep windows and doors in
14 good repair. Landlord shall be responsible for the exterior
15 of the building, except windows and doors. Tenant shall be
16 liable for any damage to windows and doors and for any damage
17 above ordinary wear and tear to the exterior of the premises
18 resulting from the act or omission of Tenant, or its
19 authorized representatives, but not from other persons.
20 8. Fixtures.
21 Tenant shall have the right to install such fixtures as
22 are necessary for the proposed use of the premises and such
23 fixtures shall not become part of the real property.
24 9. Alterations of Premises.
25 Tenant may make such repairs and improvements as are
26 required to fit the premises for the proposed use.
27 10. Fire Insurance.
28 Landlord agrees to procure and maintain in force during

1 the term of this agreement, at its expense, fire insurance on
2 the real property in an amount sufficient to protect
3 Landlord's interests.

11. Sians.
5 Tenant may erect or display any sign or advertising
6 matter depicting the public use of the premises.

12. Hold Harmless.
8 Tenant shall hold Landlord harmless from all damages
9 arising out of any injury to any person or property occurring
10 in, on, or about the premises, except the Landlord shall be
11 liable to Tenant for damage resulting from the acts or
12 omissions of Landlord or his authorized representatives, and
13 Landlord shall hold Tenant harmless from all claims and
14 expenses arising out of any such damage.

13. Amendment.
16 This agreement may be amended or modified only by written
17 agreement signed by both parties and failure on the part of
18 either party to enforce any provision of this agreement shall
19 not be construed as a waiver of the right to compel
20 enforcement of such provision or provisions, nor act to
21 release any surety from its obligations under this agreement.

14. Notices.
23 All notices herein required shall be in writing and
24 delivered in person or sent by certified mail, postage
25 prepaid, return receipt requested, addressed as follows:
