Subsequent to publication of the June 15, 1992 Commission agenda the
staff and Shopping Center Developer (Rew Frontier Commercial
Properties, Inc.) determined that Alpha-Beta Market would not be
legally allowed to erect the store wall sign it desired. That sign
generally approximates the size and assurances given to the developer
by the City through the Development and Disposition Agreement in the
Fall of 1990. The inability to have the sign constructed, in
dimensions originally contemplated, is both a surprise and hardship
from Alpha-Beta and the developers perspective, especially in view of
the Alpha-Beta Grand Opening ceremony scheduled for June 24, 1992.
Because the absolute certainty of the sign's legal size was not
concluded until 12:00 noon, June 12, 1992, and after distribution and
posting of the Commission agenda, it was not possible to address this
issue earlier.
The developer has filed for a Sign Permit to install a wall sign for
Alpha-Beta that is five (5) feet high and thirty-seven (37) feet long.
It does not meet the City of San Bernardino Development Code
requirements. However, aiven the approval of a variance by the
Planning Commission, its installation could be allowed. Because
Alpha-Beta must have a lighted sign erected by its opening on June 24,
1992, an agreement satisfactory to all parties and consistant with City
codes has been reached, subject to Co_ission approval, by the Economic
Development Agency, DeVeloper, Alpha-Beta, the Mayor's Office and
Planning Department representatives. Resolution of the impasse has
been accomplished by agreement to the following:
1. Alpha Beta will install a temporary sign that meets the
Development Code, a sign that is three (3) feet high and
twentY-five (25) feet long totalling seventy-five (75) square feet.
2. The Economic Development Agency - Development Department will pay
for the construction and installation of the temporary sign for
approximately $9,750 or an amount not to exceed $10,000. This
will enable a legal sign to be erected on-site on or before June
24, 1992.

3. Alpha-Beta, or the Developer representing it, will file for a
variance to allow installation of the size sign it actually
desires.
4. If the variance is approved by the Planning CODIDission, the
temporary sign will become the property of the Agency 1Dlless it
can be subsequently sold to Alpha-Beta under separate agreement.
5. If the variance is not issued, the temporary sign will remain and
Alpha-Beta will reimburse the Development Department for the full
construction and installation cost.
6. The IconOlllic Development Agency - Development Department, in
accordance with its lead responsibility to coordinste and complete
the project, will pursue approval of the variance with the
Developer/Alpha-Beta in harmony with City requirements and
assertively demonstrate measurable, good faith efforts evidencing
this endeavor.
7. Assurances to the above stipulations will be memorialized in
writing upon CODIDission approval.
Staff has concluded that the above proposal meets the needs of all
parties while not compromising City laws, the developers schedule or
tenant's needs.
