BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City an agreement with the San Bernardino County Flood Control District and City of Colton relating to the preparation of a Regional Drainage Study for the Pepper, Mill and Randall Basins, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length, but such award will be effective only upon the contract being fully signed. SECTION 2. Execution and Amendments. This contract and any amendments or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, I amendments, modifications or waivers are intended o~authorized and shall not I be implied from any act or course of conduct of any party. Set forth service to be rendered, amount to be paid, manner of payment, time for performance or completion, determination of satisfactory performance and cause for termination, other terms and conditions, and attach plans, specifications, and addenda, if any.) WITNESSETH WHEREAS, the DISTRICT has three facilities, Pepper, Mill and Randall Basins without an adequate outlet or downstream facility; and WHEREAS, the downstream facility is a poorly defined natural drainage course between Pepper and Meridian Avenues north of the Interstate 10 freeway; and WHEREAS, flood and debris deposition has caused damage and poses the threat of potential damage and inconvenience to be incurred by public and to private properties within the CITY OF COLTON; and WHEREAS, there is not an adequate cuI vert to conduct the flows from this watercourse under the Interstate 10 freeway; and WHEREAS, the San Bernardino County Comprehensive Storm Drain Plan #3, Project 3-5, completed in 1973, addressed the problem and proposed the construction of downstream outlet facilities including extremely costly double box culverts under the freeway and railroad without investigtaing the possibility of flow attenuation; and EXHIBIT "A" 02-12459-69/ Rev. 11/80 1 3 Page_ 01_ WHEREAS, the upper portions of the watershed located in the CITY OF SAN BERNARDINO have experienced recent development and proposed future development; and WHEREAS, this development will contribute additional flows downstream which may adversely affect the downstream areas; and HHEREAS, the lower portions of the watershed located in the CITY OF COLTON are undeveloped, but will soon be under pressure to develop; and WHEREAS, the CITY OF SAN BERNARDINO and the CITY OF COLTON desire to cooperate with the DISTRICT in a regional study of the drainage problem and thereby seek solutions which could promote the orderly growth of development within the area; and WHEREAS, by using Pepper, Mill and Randall Basins for flow attenuation purposes, the necessary downstream facility sizes will be reduced and the system cost may be reduced; and WHEREAS, it will be mutually beneficial to the parties hereto to participate in a regional drainage study: NOW, THEREFORE, it is mutually agreed as follows: A. CITY OF SAN BERNARDINO shall participate in the amount of $2,500.00. B. CITY OF COLTON shall participate in the amount of $2,500.00. C. DISTRICT shall participate in the amount of $2,500.00. Page 2 of 3 IT IS FURTHER UNDERSTOOD AND MUTUALLY AGREED: The study is to be accomplished by the DISTRICT at a cost of $7,500.00 and shall: A. Revise San Bernardino County Comprehensive Storm Drain Plan Project 3-5 hydrology and hydraulics to include flow attenuation in the reach below the existing 'basins to Interstate 10 freeway. B. Revise the cost estimate for this reach. C. Investigate the possibility of using the existing three basins as detention basins, thereby reducing their water conservation ability. THIS AGREEMENT shall inure to the benefit of and be binding upon the successors and assigns of all parties. WALKER, Director Transportation/Flood Control/Airports /''-.. ....f. - t\j /' , AGREEMENT WITH THE CITIES OF SAN BERNARDINO AN OR REVISING COMPREHENSIVE STORM DRAIN PLAN NO.3, PROJECT 3-5 TO INCLUDE FLOW ATTENUATION IN PEPPER, MILL AND RANDALL BASINS BETWEEN RANDALL BASIN AND INTERSTATE 10 ZONE 2 (100) SUBJECT: RECOMMENDATION: Approve Agreement with the Cities of San Bernardino and Colton for revising Comprehensive Storm Drain Plan No.3, Project 3-5 to include flow attenuation in Pepper, Mill and Randall Basins between Randall Basin and Interstate 10. BACKGROUND: There presently does not exist an adequate outlet from the District's Randall Basin. Both cities have proposed developments which wi 11 increase flows to this inadequate system. The existing proposed Project 3-5 does not include flow attenuation. With flow attenuation the Proj ect 3-5 costs could be greatly reduced. Both cities, recognizing these facts have agreed to share in the costs of restudying this project in order to reduce the system costs and to possibly establishing a development fee for the future construction of this system. REASON" FOR RECOMMENDATION: Preliminary studies have shown that by including flow attenuation in the design of the project, construction costs could be substantially reduced. If the construction costs are reduced to a reasonable level, the cities may be willing to establish a development fee for the future construction of this facility. REVIEW BY OTHER DEPARTMENTS: On June 19, 1986, the Agreement was reviewed by Deputy County Counsel Ed Robinson as to legal form. FINANCIAL DATA: $2,500.00 has been budgeted in the District's Zone 2 budget for the District's fair share of .the study costs. PRESENTER: MICHAEL G. WALKER Director 1986 File: 2-800/1.00 2-900/1 .00 Attention: Mr. Roger Hardgrave Re: Zone 2, Comprehensive Storm Drain Plan #3, Project 3-5 Gentlemen: On September 22, 1986, the San Bernardino County Board of Supervisors approved the agreement between the Ci ties of San Bernardino and Col ton for revising Comprehensive Storm Drain Plan No.3, Project 3-5 to include flow attenuation in the District's Pepper, Mill and Randall Basins. Attached is a signed copy of the agreement. It is anticipated the study will be started by mid-November. The exact start date is dependent on the completion of a study being prepared for the U.S. Army Corps of Engineers. The target completion for the study is July, 1987. As the study progresses to a point where al ternative storm drain locations have been determined, you will be contacted for comment.
