HomeMy WebLinkAbout1986-303 -, 1 RESOLUTION NO. 86-303 2 RESOLUTION OF THE CITY OF SAN BERNARDINO URGING THE SOUTH COAST AIR QUALITY MANAGEMENT DISTRICT TO MODIFY ITS POLICIES 3 CONCERNING POLLUTION CREDITS AND SUBSEQUENT ENVIRONMENTAL IMPACT ASSESSMENTS FOR POLLUTING INDUSTRIES AND TO DO SO ON A LOCAL AREA 4 AS WELL AS A REGIONAL MANAGEMENT BASIS; URGING THE STATE LEGISLATURE TO ENACT LEGISLATION REQUIRING SUCH POLICIES AND 5 NOTICE TO LOCAL PUBLIC ENTITIES WHICH ARE AFFECTED BY APPROVALS OF PERMITS FOR POLLUTING INDUSTRIES; AND JOINING THE COUNTY OF SAN 6 BERNARDINO IN EFFORTS TO INTERVENE IN THE PROCEEDINGS OF SAID DISTRICT RELATING THERETO. 7 8 WHEREAS, on January 8, 1985, the City of Rialto issued a 9 notice of determination, pursuant to Section 21108 of the Public 10 Resources Code (CEQA), that a proposed tire burning plant in 11 Rialto would have no significant effect on the environment, and, 12 therefore, issued a negative declaration; and 13 WHEREAS, a recent study has shown that a similar plant in 14 Oregon utilizing like technology to that proposed in Rialto emits 15 carcinogens which could pose a substantial health hazard to the 16 populace of the Inland Empire; and . . 17 WHEREAS, current laws of the State of California and rules 18 and regulations of the South Coast Air Quality Management District 19 limit the City's ability to remedy or produce evidence relating to 20 proposed projects which may affect the air quality of the Inland 21 Empire, 22 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 23 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 24 SECTION 1. The legislative body of the City of San 25 Bernardino urges the South Coast Air Quality Management District 26 to modify its policies to require comprehensive environmental 27 impact assessments on a local area basis in addition to the 28 regional or basin management basis and to require subsequent 1 assessments based upon information and studies not known when 2 original assessments are made and, specifically, not to grant any 3 permit to the Rialto Power Corporation before requiring a 4 subsequent environmental impact report and all air pollution 5 offset credits and requirements with regard to the proposed Rialto 6 tire burning plant; and to modify its policies to mandate the 7 obtaining of total offset air pollution credits by proposed 8 polluting projects in the Inland Empire. 9 SECTION 2. The State Legislature is urged to enact 10 legislation requiring the implementation of the policies set forth 11 in Sections 1 and 2 hereof and providing for notice to the 12 governing bodies of local public entities whose residents are 13 affected by approvals of permits and applications for polluting 14 industries and development projects by the South Coast Air Quality 15 Management District and other local public entities. 16 SECTION 3. The Mayor and Common Counc~l of the City of San 17 Bernardino support the action undertaken recently by the County of 18 San Bernardino to intervene in the South Coast Air Quality 19 Management District proceedings regarding the issuance of permits 20 to the Rialto Power Corporation (Garb Oil and Power Corporation) 21 and to require the preparation of a subsequent environmental 22 impact report. Staff is directed to provide assistance to further 23 the efforts of the County of San Bernardino and to join with the 24 County in pursuing said intervention. 25 SECTION 4. The City Clerk of the City of San Bernardino is 26 directed to forward a copy of this resolution to Assemblymen 27 William Leonard and Jerry Eaves of the State Assembly and Senator 28 Ruben Ayala urging their support of appropriate legislation -2- 1 consonant with the goals of Sections land 2 hereof. 2 I HEREBY CERTIFY that the foregoing resolution was duly 3 adopted by the Mayor and Common Council of the City of San 4 Bernardino at a regular 5 the 21st day of 6 to wit: July 7 8 9 10 11 12 13 AYES: Council Members Strickler NAYS: None ABSENT: Council Members Estrada.
