CITY OF SAN BERN~iDINO -REQUEST ~R COUNCIL ACTION y STAFF REPORT Subject: Final determination for Tentative Tract No. 15228, a request to establish an 18-lot single family subdivision. Mayor and Common Council Meeting of June 15, 1992 REQUEST Pursuant to Development Code Section 19.66.070, the applicants request approval of Tentative Tract No. 15228, to subdivide a parcel into 18 single-family residential lots. The request is before the Mayor and Common Council because a motion by the Planning Commission to deny the project failed by a tie vote. The subject property consists of 5.71 acres located at the southwest corner of Magnolia Avenue and Ohio Avenue in the RL, Residential Low, land use district. BACKGROUND November 19, 1991 The Planning Commission held a properly noticed public hearing on Tentative Tract No. 15228 (See Exhibit 1, Certificate of Mailing and Proof of Publication). After staff's presentation of the staff report, the Commission was advised that Staff received comments by telephone from Ms. Pat Smith, 3288 Meyers Road, on the day of the hearing. Ms. Smith stated that her property abuts the subject property and expressed concerns regarding the removal of trees, the lack of sewers and asked if it would still be legal to stable her stallions if the proposed subdivision is approved and occupied. After the opening of the public hearing, Donald and Jean Hanson, 180 W. Fiesta Green, Port Hueneme, spoke in favor of the application. Mr. Hanson stated that he and his wife own approximately 10 acres across the street from the subject property and they feel that the proposed subdivision would have a positive effect. Gary Smith, 3288 Meyers Road, then spoke in opposition to the request. He stated that the proposed lot sizes and density are incompatible with the existing development in the area, citing his and three other one-acre residential properties abutting the subject property to the south, which are the result of a four-lot subdivision approved in 1980. According to Mr. Smith, the recently approved smaller lot, higher density developments are destroying the quiet, low density character of the area. June Reeves, 3414 Belmont Avenue, spoke in opposition to the proposed subdivision, citing a lack of sewer service on Belmont Avenue and drainage concerns on Magnolia Avenue. Steven Levy, 1398 Meyers Road expressed opposition to the application, also citing drainage concerns. Sam Zayed, 3308 Meyers Road, spoke in opposition to proposal. He stated that he recently moved into the area and has invested in improvements to his property under the impression that the area would continue to be comprised of one-acre lots. Eugene Ehe, civil engineer for the project, then responded to the drainage and sewer issues. He stated that proper drainage could be carried to Belmont Avenue; however, due to the lay of the land, a drainage easement would be required along the neighboring property to the east (A.P.N. 261-071-2, 3, 9). The proposed conditions of approval require that the subdivider obtain the easement prior to recordation of the final map, but the neighboring property owner is unwilling to negotiate at this time. He also stated that all trees removed as a result of the development of the subdivision shall be replaced at a 2:1 ratio, as indicated in the proposed conditions of approval. A motion then carried to continue the hearing to December 10, 1991 so that a representative from the Engineering Division of the Public Works Department could be present to answer questions regarding drainage issues, the proposed street design, and policies and procedures for the filing of final maps. December 10, 1991 A quorum of the Planning Commissioners who originally heard the item on November 19, 1991 was not present, and the item was continued to January 7, 1992. January 7, 1992 The Planning Commission continued the item to March 3, 1992 at the request of the Planning Director. The purpose of the continuance request was to allow the applicant to make a final attempt to negotiate for an off-site drainage easement through the neighboring property to the east prior to taking action on the tentative map. This request was made because, pursuant to Section 66462.5 of the Subdivision Map Act, if the City imposes a condition of approval Tentative Tract No. 15228 requiring the subdivider to obtain an ~ o Tentative Tract No. 15228 Request for Final Determination Mayor and Common Council Meeting of June 15, 1992 Page 3 easement for offsite improvements, and the subdivider is unable to obtain the drainage easement by the time that the final map is filed, the City will be compelled to acquire the easement through eminent domain; in turn, the City would require the subdivider to pay the cost of acquiring the easement. March 3, 1992 Staff advised the Planning Commission that the owners of the neighboring property are still unwilling to grant off-site drainage easement rights to the applicant, so the proposed conditions of approval will require the subdivider to obtain the easement prior to recordation of the final map (Standard Requirement No. 18, Exhibit 4, Attachment D), potentially compelling the City to condemn the property. Commissioner Stone then asked staff if the proposed temporary dead end at the eastern end of the subject property would obligate the owner of the neighboring property to the east to continue the street if the adjacent parcels are ever developed. Staff responded that the neighboring property owner would be obligated to continue the street. Commissioner Stone then expressed concern that the neighboring, larger property would be "held hostage" by the subject property. A motion to deny Tentative Tract No. 15228 then failed by a tied 3- 3 vote. As a result of the failed motion, the application was forwarded to the Mayor and Common Council for final determination. April 20, 1992 The item was continued by the Mayor and Common Council to May 4, 1992. May 4, 1992 The Mayor and Common Council continued this item to June 1, 1992 to enable the applicant to redesign the subdivision to eliminate the need for a drainage easement. May 14, 1992 The Director of Public Works/City Engineer submitted a memorandum to the Planning Division which evaluates the revised plan. The memorandum indicates that the modified drainage design "eliminates the need for any off-site easements and is acceptable to the Director of Public Works/City Engineer." The memorandum also contains amended language to Standard Requirements nos. 9 and 18 so that they correspond to the revised subdivision map. The proposed map is consistent with the General Plan, in that the purpose of the map is to provide for the development of single-family homes at a density of 3.1 dwelling units per acre, as permitted within the RL, Residential Low, General Plan land use district. 2. The design of the proposed subdivision is consistent with the General Plan in that the minimum proposed lot size is 10,800 square feet, as required in the RL land use district. 3. The site is physically suitable for the type of development proposed: the tentative map conforms to the subdivision design standards of the Development Code; the proposed street complies with the minimum standards of the Public Works Department; the two routes of access can be improved to meet City standards; water and sewer service can connected to the existing system in Magnolia Avenue; drainage can be directed to an approved public drainage facility via Magnolia Avenue. 4. The site is physically suitable for the proposed density of development in that the subdivision design complies with all lot area and dimensional standards, as well as required public improvements standards. 5. The design of the subdivision and proposed improvements are not likely to cause substantial environmental damage or substantially or avoidably injure fish or wildlife or their habitat, in that mitigation measures have been incorporated into the project design and conditions of approval to protect, relocate and replace the existing trees on site. 6. The design of the subdivision or type of improvements is not likely to cause serious public health problems in that environmental health concerns are addressed and mitigated through the design and construction standards of all public services and public and private structures. 7. No tree shall be removed, replaced or relocated prior to the issuance of a Tree Removal Permit. The removal, replacement or relocation of any tree shall be subject to the provisions established by the mitigation measures contained in the Initial Study for Tentative Tract No. 15228. 2• Walls and Fences: a. The perimeter walls adjacent to Ohio Avenue and Magnolia Avenue shall be constructed of either slumpstone, split- faced block or stuccoed block with decorative caps. The walls shall have articulated planes, by providing at a minimum for every 100 feet of continuous wall, an 18- inch deep by 8-foot long landscaped recession. Pilasters shall be provided at every change in direction, every 5- foot difference in elevation and at a minimum of every 25 feet of continuous wall. b. All wood fences used within the tract shall be treated with heavy body stains or paints. 3. The final map shall show easements or other mapped provisions for the placement of centralized mail delivery units. The review authority shall ensure that the project complies with all current Development Code provisions. 8. In the event tAat this approval is legally challenged, the City will promptly notify the applicant of any claim or action and will cooperate fully in the defense of the natter. Once notified, the applicant agrees to defend, indemnify, and hold harmless the City. its officers, agents and employees from any claim, action or proceeding against the City of San Bernardino. The applicant further agrees to reimburse the City of any costs and attorneys' fees which the City may be required • by a court to Day as a result of such action, but such participation shall not relieve applicant of his or her obligation under this condition. They may be submitted prior to submittal of Building Plans. Drainage and Flood Control All necessary drainage and flood control measures shall be subject to requirements of the City Engineer, which may be based in part on the recommendations of the San Bernardino Flood Control District. The developer's Engineer shall furnish all necessary data relating to drainage and flood control. 1. _y_ A local drainage study will be required for the project. Any drainage improvements, structures or storm drains needed to miti- gate downstream impacts or protect the development shall be designed and constructed at the developer's expense, and right- ~ of-way dedicated as necessary. The development is located within Zone A on the Federal Insurance Rate Maps; therefore, a Special Flood Hazard Area Permit issued by the City Engineer shall be required. The development is located within Zone B on the Federal Insurance Rate Maps; therefore, all building pads shall be raised above the surrounding area as approved by the City Engineer. Erosion Control 4. ~ An Erosion Control Plan shall be approved by the City Engineer prior to grading plan approval. The plan shall be designed to control erosion due to water and wind, including blowing dust, during all phases of construction, including graded areas which are not proposed to be immediately built upon. . The grading plan shall be prepared in strict accordance with the City's "Grading Policies and Procedures" and the City's "Standard Drawings", unless otherwise approved by the City Engineer in advance. 5, X If more than 5,000 cubic yards of earthwork is proposed, a grading bond will be required and the grading shall be supervised in accordance with Section 7012 (c) of the Uniform Building Code. A liquefaction report is required for the site. This report must be submitted and approved prior to issuance of a grading permit. Any grading requirements recommended by the approved liquefaction report shall be incorporated in the grading plan. 7, X An on-site Improvement Plan is required for this project. PJhere feasible, this plan shall be incorporated with the grading plan and shall conform to all requirements of Section 15.04-167 of the Municipal Code (See "Grading Policies and Procedures"). The on-site Improvement Plan shall be approved by the City Engineer. Sewers within private streets or private parking lots will not be maintained by the City but shall be designed and constructed to City Standards and inspected under a City On-Site Construction Permit. A privata sewer plan designed by the Developer's Engin- eer and approved by the City Engineer will be required. This plan can be incorporated in the grading plan, where practical. 17, A communication Conduit shall be installed in all streets with- in and adjacent to this project. The conduit shall be dedicated to the City and its primary use shall be for Cable TV installed by the Cable TV Company under permit from the City of San Bernar- dino. 18. SITE LOCATION The subject property is a rectangular parcel consisting of approximately 5.7 acres located at the southeast corner of Magnolia and Ohio Avenues (Please see Attachment F, Tentative Map and Attachment G, Location Map). DEVELOPMENT CODE AND GENERAL PLAN CONSISTENCY Tentative Tract No. 15228 is consistent with the standards and guidelines of the Development Code and is consistent with the goals, objectives and policies of the General Plan, as shown in Attachment A. SUBDIVISION MAP ACT Tentative Tract No. 15228 was submitted in compliance with Section 66426 of the Subdivision Map Act. The subdivider has agreed to comply with the provisions imposed by the City under the authority of Chapter 4 of the Map Act. CEOA STATUS An Initial Study was prepared by Staff and presented to the Environmental Review Committee (ERC) on September 26, 1991. The ERC determined that no significant impacts would result from the project and recommended a Negative Declaration. The proposed Negative Declaration was advertised and available for public review and comment from October 3, 1991 to October 23, 1991. As of this writing, no comments have been received from the public. BACKGROUND The application for Tentative Tract No. 15228 was submitted on February 19, 1991. The application was deemed incomplete on March 18, 1991 pending the submittal of an arborist report, a biological report and an archaeological review fee. The property slopes slightly Prom north to south at an approximate natural grade of 8.5&. A row of eucalyptus trees is located adjacent to the north property frontage along Ohio Avenue and a row of olive trees is located to adjacent to the Magnolia Avenue frontage on the west. The surrounding area is characterized by vacant residential properties Project Characteristics Lot Design The proposed 18 lots range in size from 10,800 square feet to 12,250 square feet. The design of the lots are essentially rectangular in shape. The southward natural gradation of the property has resulted in the southern tract boundary to be located at the toe of a slope. The presence of a downward slope within a rear yard, depending on the steepness. may lead to maintence and usability problems. The elimination of the slope would require the construction of a 10- foot retaining wall facing the exterior of the tract, which could be visually imposing and obstruct scenic views currently enjoyed by adjacent properties. Based on the circumstances, it is Staff's recommendation that a maximum 3:1 slope be allowed, which would reduce maintenance problems and eliminate the need for a retaining wall. Access and Circu~at+on Access to all parcels will be from Magnolia Avenue by means of a new 767-foot street which will terminate at a temporary cul-de- sac. A standard route is a road which is dedicated to the City and has a minimum paved width of 24 feet. The two standard means of access for the subject property shall be provided by Magnolia and Ohio Avenues. As a condition of approval, the subdivider shall be required to improve Magnolia and Ohio so that they become standard routes; that is, they shall be required to be widened and paved from the tract entry to the point where they tie into a standard street system. 8etrera aad Draiaage The site is currently isolated from development, and sewer service does not reach the subject property. The nearest sewer line is located in Chestnut Avenue, and terminates south of Belmont Avenue --approximately 1,200 feet south of the subject property. The sewer cannot be extended north along Chestnut due to a large dip in Belmont. Hence, until contiguous development reaches the adjoinq parcels, the only way to provide sewer service to this subdivision would be through securing an easement from the adjoining property to the south or east. Additionally, the property drains to the east and a drainage easement will be required. At this time, the property owners to the east are not willing to negotiate for easement rights. Therefore, conditions of approval shall make final recordation of the map contingent upon the acquisition of an easement for sewer and drainage purposes from the easterly terminus of the subject property southerly to Belmont Avenue. The easement shall be 15 feet wide. Sewer and drainage improvements shall be installed in the easement to serve the development as approved by the City Engineer. Additional sewer and/or drainage improvements may be required to reach an adequate outlet. Traffic Impacts The City Traffic Engineer has determined that additional trips from the proposed project are not sufficient to cause a significant impact on the adjacent street system. Total traffic volume will be less than the street design capacity. A biological assessment was conducted by John Wear and Timothy J. Wade of the Lilburn Corporation on April 19, 1991. The consultants concluded that no significant biological resources occur on the site; thus, no mitigation was recommended. Trees on site There are currently 48 standing trees on the subject property, primarily consisting of a wind row of 34 eucalyptus trees along Ohio Avenue and a row of 13 olive trees adjacent to Magnolia Avenue. The subdivision has been designed to preserve these trees as much as possible; however, construction of the new street (Blackhawk Road) and right-of-way dedications will displace several of the olive trees. A California Certified Arborist report was prepared on April 26, 1991 by James F. Bridges (I.S.A. Certificate No. 386). The trees were identified and catalogued in the report and plotted on a map, which is on file with the Planning Division. The report concluded that only 14 of the 48 trees were sufficiently viable to be saved in place or transplanted. The report identified the remaining trees as diseased or dead and recommended their removal. The report and recommendations have been reviewed by Planning and Parks and Recreation staff. Additionally, Parks and Recreation staff physically inspected the trees on site and concluded that of the trees on site are sufficiently viable to be retained in place, relocated or replaced. Based upon these analyses, if the project is approved, Staff recommends the following mitigation measures: 1. All trees not affected by construction shall be retained in place; and 2. All trees affected by construction shall be transplanted or replaced with 36-inch box native trees at a two-to-one replacement ratio. Cultural Resources The subject property is located within an area of concern for archaeological resources, as identified in the Historical Element of the City's General Plan (Section 3.0, Figure 8). A preliminary cultural resources review was conducted by Lester Ross, coordinator at the Archaeological Information Center of the San Bernardino County Museum. Mr. Ross determined that the potential for the presence of cultural resources within the project area is low. As a result of the negative findings, a field reconnaisance for cultural resources was not undertaken. Tentative Tract No. 15228 is in compliance with the Subdivision Map Act. To address potential environmental impacts and infrastructure deficiencies, mitigation measures have been incorporated into the project design and conditions of approval. It is the conclusion of Staff that, based upon the project design and proposed conditions of approval, the project will not pose a detriment to the peace, health, safety and general welfare of the citizens of San Bernardino. RECOMMENDATION It is recommended that the Planning Commission: 1. Adopt the Negative Declaration; and 2. Mayor and Common Council Meeting of April 20, 1992 REQUEST Pursuant to Development Code Section 19.66.070, the applicants request approval of Tentative Tract No. 15228, to subdivide a parcel into 18 single-family residential lots. The request is before the Mayor and Common Council because a motion by the Planning Commission to deny the project failed by a tie vote. The subject property consists of 5.71 acres located at the southwest corner of Magnolia Avenue and Ohio Avenue in the RL, Residential Low, land use district. SACItGROUND lTovember 19, 1991 The Planning Commission held a properly noticed public hearing on Tentative Tract No. 15228 (See Exhibit 1, Certificate of Mailing and Proof of Publication). After staff's presentation of the staff report, the Commission was advised that Staff received comments by telephone from Ms. Pat Smith, 3288 Meyers Road, on the day of the hearing. Ms. Smith stated that her property abuts the subject property and expressed concerns regarding the removal of trees, the lack of sewers and asked if it would still be legal to stable her stallions if the proposed subdivision is approved and occupied. After the opening of the public hearing, Donald and Jean Hanson, 180 W. Fiesta Green, Port Hueneme, spoke in Pavor of the application. Mr. Hanson stated that he and his wife own approximately 10 acres across the street from the subject property and they feel that the proposed subdivision would have a positive effect. Gary Smith, 3288 Meyers Road, then spoke in opposition to the request. He stated that the proposed lot sizes and density are incompatible with the existing development in the area, citing his and three other one-acre residential properties abutting the subject property to the south, which are the result of a four-lot subdivision approved in 1980. According to Mr. Smith, the recently approved smaller lot, higher density developments are destroying the quiet, low density character of the area. June Reeves, 3414 Belmont Avenue, spoke in opposition to the proposed subdivision, citing a lack of sewer service on Belmont Avenue and drainage concerns on Magnolia Avenue. Steven bevy, 1398 Meyers Road expressed opposition to the application, also citing drainage concerns. Sam Zayed, 3308 Meyers Road, spoke in opposition to proposal. He stated that he recently moved into the area and has invested in improvements to his property under the impression that the area would continue to be comprised of one-acre lots. Eugene Ehe, civil engineer for the project, then responded to the drainage and sewer issues. He stated that proper drainage could be ' carried to Belmont Avenue; however, due to the lay of the land, a drainage easement would be required along the neighboring property to the east (A.P.N. 261-071-2, 3, 9). The proposed conditions of approval require that the subdivider obtain the easement prior to recordation of the final map, but the neighboring property owner is unwilling to negotiate at this time. He also stated that all trees removed as a result of the development of the subdivision shall be replaced at a 2:1 ratio, as indicated in the proposed conditions of approval. A motion then carried to continue the hearing to December 10, 1991 so that a representative from the Engineering Division of the Public Works Department could be present to answer questions regarding drainage issues, the proposed street design, and policies and procedures for the filing of final maps. Deaember 10, 1991 A quorum of the Planning Commissioners who originally heard the item on November 19, 1991 was not present, and the item was continued to January 7, 1992. January 7, 1992 The Planning Commission continued the item to March 3, 1992 at the request of the Planning Director. The purpose of the continuance request was to allow the applicant to make a final attempt to negotiate for an off-site drainage easement through the neighboring property to the east prior to taking action on the tentative map. This request was made because, pursuant to Section 66462.5 of the Subdivision Map Act, if the City imposes a condition of approval _ p 4 Tentative Tract No. 15228 Request for Final Determination Mayor and Common Council Meeting of April 20, 1992 Page 3 requiring the subdivider to obtain an easement for offsite improvements, and the subdivider is unable to obtain the drainage easement by the time that the final map is filed, the City will be compelled to acquire the easement through eminent domain; in turn, the City would require the subdivider to pay the cost of acquiring the easement. xarah 3, 1994 Staff advised the Planning Commission that the owners of the neighboring property are still unwilling to grant off-site drainage easement rights to the applicant, so the proposed conditions of approval will require the subdivider to obtain the easement prior to recordation of the final map (Standard Requirement No. 18, Exhibit 4, Attachment D), potentially compelling the City to condemn the property. Commissioner Stone then asked staff if the proposed temporary dead end at the eastern end of the subject property would obligate the owner of the neighboring property to the east to continue the street if the adjacent parcels are ever developed. Staff responded that the neighboring property owner would be obligated to continue the street. Commissioner Stone then expressed concern that the neighboring, larger property would be "held hostage" by the subject property. A motion to deny Tentative Tract No. 15228 then failed by a tied 3- 3 vote. As a result of the failed motion, the application was forwarded to the Mayor and Common Council for final determination. The hearing was continued to December 10, 1991 so that a representative from the Engineering Division of the Public Works Department could be present to answer questions regarding drainage issues, the proposed street design, and policies and procedures for the filing of final maps. At the Planning Commission meeting of December 10, 1991, a quorum of the Planning Commissioners who originally heard the item on November 19, 1991 was not present, and the item was continued to January 7, 1992. At the Planning Commission meeting of January 7, 1992, the Planning Commission continued the item to March 3, 1992 at the request of i the Director of Planning & Building Services. The purpose of the continuance request was to allow the applicant to make a final attempt to negotiate for an off-site drainage easement through the neighboring property to the east prior to approval of the tentative map. The owners of neighboring property are still unwilling to grant the easement, so conditions of approval will require that the developer obtain the easement prior to recordation of the final map (see Standard Requirement No. 18, Attachment D). Pursuant to Section 66462.5 of the Subdivision Map Act, if the subdivider is unable to obtain the drainage easement by the time that the final map is Piled, the City will be compelled to acquire the easement through eminent domain. In turn, the City shall require the subdivider to pay the cost of acquiring the easement. SITE LOCATION The subject property is a rectangular parcel consisting of approximately 5.7 acres located at the southeast corner of Magnolia and Ohio Avenues (Please see Attachment F, Tentative Map and Attachment G, Location Map). DEVELOPMENT CODE AND GENERAL P CONSISTENCY Tentative Tract No. 15228 is consistent with the standards and guidelines of the Development Code and is consistent with the goals, objectives and policies of the General Plan, as shown in Attachment A. SUBDIVISION ItLaP ACT Tentative Tract No. 15228 was submitted in compliance with Section 66426 of the Subdivision Map Act. The subdivider has agreed to comply with the provisions imposed by the City under the authority of Chapter 4 of the Map Act. CEOA STATUS An Initial Study was prepared by Staff and presented to the Environmental Review Committee (ERC) on September 26, 1991. The ERC determined that no significant impacts would result from the project and recommended a Negative Declaration. The proposed Negative Declaration was advertised and available for public review and comment from October 3, 1991 to October 23, 1991. As of this writing, no comments have been received from the public. BACKGROUND The application for Tentative Tract No. 15228 was submitted on February 19, 1991. The application was deemed incomplete on March 18, 1991 pending the submittal of an arborist report, a biological report and an archaeological review fee. On May 22, 1991, all of the requested information was received and the application was deemed complete on June 18, 1991. The property slopes slightly from north to south at an approximate natural grade of 8.53. A row of eucalyptus trees is located adjacent to the north property frontage along Ohio Avenue and a row of olive trees is located to adjacent to the Magnolia Avenue frontage on the west. The surrounding area is characterized by vacant residential properties Project Charaateristias Lot Design The proposed 18 lots range in size Prom 10,800 square feet to 12,250 square feet. The design of the lots are essentially rectangular in shape. The southward natural gradation of the property has resulted in the southern tract boundary to be located at the toe of a slope. The presence of a downward slope within a rear yard, depending on the steepness, may lead to maintence and usability problems. The elimination of the slope would require the construction of a 10- foot retaining wall facing the exterior of the tract, which could be visually imposing and obstruct scenic views currently enjoyed by adjacent properties. Based on the circumstances, it is Staffs recommendation that a maximum 3:1 slope be allowed, which would reduce maintenance problems and eliminate the need for a retaining wall. Access and Circulation Access to all parcels will be Prom Magnolia Avenue by means of a new 767-foot street which will terminate at a temporary cul-de- sac. The intent of the temporary turnaround is to allow the subdivider to maximize the number of lots while facilitating the future extension of the street if the adjacent parcel to the east is ever developed. .w PLAlLOD9 PAGE 1 OF 1 14 W1 CITY OF SAN BERNARDINO PLANNING CASE TT 15228 AND BUILDING SERVICES DEPARTMENT AGENDA ITEM OBSERVATIONS _ HEARING DATE 11-19-91 PAGE 3 Section 19.30.200(6) of the Development Code requires a tentative tract map to provide for at least two different standard routes !or ingress and egress. A standard route is a road which is dedicated to the City and has a minimum paved width of 24 feet. The two standard means of access for the subject property shall be provided by Magnolia and Ohio Avenues. As a condition of approval, the subdivider shall be required to improve Magnolia and Ohio so that they become standard routes; that is, they shall be required to ba widened and paved from the tract entry to the point where they tie into a standard street system. Sellers and Drainage The site is currently isolated from development, and sewer service does not reach the subject property. The nearest sewer line is located in Chestnut Avenue, and terminates south of Belmont Avenue --approximately 1,200 feet south of the subject property. The sewer cannot be extended north along Chestnut due to a large dip in Belmont. Hence, until contiguous development reaches the adjoinq parcels, the only way to provide sewer service to this subdivision would be through securing an easement from the adjoining property to the south or east. Additionally, the property drains to the east and a drainage easement will be required. At this time, the property owners to the east are not willing to negotiate for easement rights. Therefore, conditions of approval shall make final recordation of the map contingent upon the acquisition of an easement for sewer and drainage purposes from the easterly terminus of the subject property southerly to Belmont Avenue. The easement shall be 15 feet wide. Sewer and drainage improvements shall be installed in the easement to serve the development as approved by the City Engineer. Additional sewer and/or drainage improvements may be required to reach an adequate outlet. Traffic impacts The City Traffic Engineer has determined that additional trips from the proposed project are not sufficient to cause a significant impact on the adjacent street system. Total traffic volume will be less than the street design capacity. However, a traffic systems fee, estimated in the amount o! A biological assessment was conducted by John Wear and Timothy J. Wade of the Lilburn Corporation on April 19, 1991. The consultants concluded that no significant biological resources occur on the site; thus, no mitigation was recommended. Trsas oa sits There are currently 48 standing trees on the subject property, primarily consisting of a wind row of 34 eucalyptus trees along Ohio Avenue and a row of 13 olive trees adjacent to Magnolia Avenue. The subdivision has been designed to preserve these trees as much as possible; however, construction of the new street (Blackhawk Road) and right-of-way dedications will displace several of the olive trees. A California Certified Arborist report was prepared on April 26, 1991 by James F. Bridges (T.S.A. Certificate No. 386). The trees were identified and catalogued in the report and plotted on a map, which is on file with the Planning Division. The report concluded that only 14 of the 48 trees were sufficiently viable to be saved in place or transplanted. The report identified the remaining trees as diseased or dead and recommended their removal. The report and recommendations have bean reviewed by Planning and Parks and Recreation staff. Additionally, Parks and Recreation staff physically inspected the trees on site and concluded that All of the trees on site are sufficiently viable to be retained in place, relocated or replaced. Based upon these analyses, if the project is approved, Staff recommends the following mitigation measures: 1. All trees not affected by construction shall be retained in place; and 2. All trees affected by construction shall be transplanted or replaced with 36-inch box native trees at a two-to-one replacement ratio. These trees shall be planted on-site or on public lands in accordance with the recommendations and requirements of the Parka and Recreation Department. Cultural Resources The subject property is located within an area of concern for archaeological resources, as identified in the Historical Element of the City's General Plan (Section 3.0, Figure 8). A preliminary cultural resources review was conducted by Lester Ross, coordinator at the Archaeological Information Center o! the San Bernardino County Museum. Mr. Ross determined that the potential for the presence of cultural resources within the project area is low. ]1s a result of the negative findings, a field reconnaisance for cultural resources was not undertaken. COMMENTS RECEIVED Area Residents No comments have been received as of the writing of this staff report. Councilman Tom ![inor (hard 5) In comments submitted to Staff, Councilman Minor stated that his support is strictly contingent upon the project making adequate provisions for infrastructure. It is the opinion of Staff that the conditions of approval and standard requirements fully address these issues. San Bernardino Onified 8ahool District The project will be subject to school impact fees in effect at the time of building permit issuance. IIaited States Postal Service The Postal Service requests that the final map shall show easements or other mapped provisions for the placement of centrals-zed mail delivery units. A condition of approval has been proposed for the inclusion of such easements. To address potential environmental impacts and infrastructure deficiencies, mitigation measures have been incorporated into the project design and conditions of approval. It is the conclusion of Staff that, based upon the project design and proposed conditions of approval, the project will not pose a detriment to the peace, health, safety and general welfare of the citizens of San Bernardino.
