RESOLUTION NO. 86-244
2 RESOLUTION OF THE CITY OF SAN BERNARDINO GRANTING A
QUITCLAIM DEED TO ACACIA CONSTRUCTION, INC., FOR A TEN FOOT STRIP
3 OF LAND FROM WESTERN AVENUE TO SUN VALLEY DRIVE AND RESERVING AN
EASEMENT IN LOTS 18 AND 19 OF TRACT 13188 FROM LITTLE MOUNTAIN
4 DRIVE TO THE FLOOD CONTROL CHANNEL FOR WATER LINE PURPOSES,
ADJACENT TO A STORM DRAIN EASEMENT, AND DETERMINING THAT THE
5 PROPERTY TO BE EXCHANGED HAS A VALUE OF LESS THAN $2,000.00.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

8 SECTION 1. Recitals.

A. Acacia Construction, Inc., is desirous of acquiring
10 a ten foot strip of land from Western Avenue to Sun Valley Drive
11 presently used for Water Department purposes in exchange for
12 Acacia paying the cost of relocating the water main from Little
13 Mountain Drive to Sun Valley Drive.

B. Acacia Construction, Inc., has made payment of the
15 estimated cost for such relocation.

C. The City would reserve an ease~ent in Lots 18 and
17 19 of Tract 13188 from Little Mountain Drive to the flood control
18 channel for water line purposes.
19 SECTION 2. Findings.

A. The Mayor and Common Council hereby find and
21 determine that the grant of a Quitclaim Deed would: (1) benefit
22 the City of San Bernardino by eliminating a difficult area to
23 maintain, (2) increase the City's water line by an additional 300
24 feet, and (3) serve domestic water users on both sides of a
25 dedicated street.

B. The Mayor and Common Council further find and
27 determine that the consideration received in enhancing the Water

I Department's domestic water system is greater than the property
2 rights the Department is giving up.

C. The Mayor and Common Council further find and
4 determine that the property being exchanged has a value of less
5 than $2,000.00.
6 SECTION 3. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute a Quitclaim Deed on
8 behalf of the City of San Bernardino to Acacia Construction,
9 Inc., for a ten foot strip of land from Western Avenue to Sun
10 Valley Drive, reserving an easement in Lots 18 and 19 of Tract
11 13188 from Little Mountain Drive to the flood control channel for
12 water line purposes, adjacent to a storm drain easement. A copy
13 of said Quitclaim Deed is attached hereto as Exhibit A and
14 incorporated herein by reference as though fully set forth at
15 length.

EXHIBIT "A"
That portion of a 10-foot strip of land described in the deed
to the City of San Bernardino recorded in Book 860, Page 374
of Deeds, in the office of the County Recorder of San
Bernardino County, State of California, bounded on the East
by a line that is parallel with and distant Westerly, 40.00
feet, measured at right angles, from the East line of Section
17, unsurveyed, Township 1 North, Range 8 West, San
Bernardino Base and Meridian, being a portion of the
Muscupiabe Rancho defined by extending United States
Sectional lines across said Rancho as per plat recorded in
Book 7 of maps, Page 23, records of said County, and lying
Easterly of the following described line:
Beginning at the intersection of the Southwesterly line of
said land described in deed recorded in Book 860, Page 374 of
Deeds, said South 1 ine having a bearing of N 55000'38" W,
with the West line of Sun Valley Drive, 60 feet wide, as
\ shown on Tract No. 11745, as per map recorded in Book 175,

Recorder of said County, said point of intersection being the
beginning of a non tangent curve, concave Easterly and having
a radius of 130.00 feet, a radial to said point of intersec-
tion bears S 89026'45" W; thence Northerly along said curve
through a central angle of 50 15'08" an arc length of 11.92
feet to the Northeasterly line of said land described in deed
recorded in Book 860, Page 374 of deeds, a radial bearing to
said last mentioned point bears N 85018'07" W.
RESERVING unto the grantors herein, an easement for water
line purposes, over, under and across that portion of the
above described land, lying Easterly of the East line of
Little Mountain Drive, 100 feet wide, as shown on Record of
Survey recorded in Book 39, Pages 82 and 83 of Records of
Surveys, in the office of said County Recorder.
