RESOLUTION NO. Rh-?10
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH
IN-N-OUT BURGER INC. FOR THE WIDENING OF SECOND STREET, WEST OF
IIHII STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOllOWS:
SECTION ONE: That the City of San Bernardino execute an
Agreement wi th In-N-Out Burger, Inc. for the widening of Second
Street, West of IIHII Street, and in consideration of the
execution and conveyance of an easement document the City will
construct, improve, and do other work within such portion at
its own expen se.
SECTION TWO:
That the said Agreement referred to
herein, a copy of which is attached hereto, marked Exhibit IIAII,
and is hereby referred to and made a part hereof as fully as
though set out at length herein, is hereby approved.
SECTION THREE:
Tha t the Mayor of the Ci ty of San
Bernardino is hereby authorized and direeted to execute said
Agreement on behalf of the City of San Bernardino.
I HEREBY CERTIFY that the foregoing Resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a

EXHIBIT -A-
AGREEMENT
r
This Agreement is made and entered into this ::..t ~

, 1986, by and between the Ci ty of San
Bernardino, a Municipal Corporation, hereinafter called "City"
and In-N-Out Burger Inc., the owners of that certain real
property located at the Southwest corner of Second Street and
tlHtl Street, also known as Assessor Parcel No. 134-332-15,
hereinafter called "Owner".
THE PARTIES HERETO AGREE as follows:
(I) The Owner has executed, or simultaneously with and
a t t he t i m e 0 f t he e x e cut i on 0 f t his a g r e e men t will e x e cute a n
easement for street and highway purposes to the City of a
portion of Owners property for the widening of Second Street,
West of IlHIl Street as described in the attached easement
document.
(2) After and upon acceptance and dedication of said
portion of Owner's property for a street, the City agrees in
consideration of the granting of said easement to construct:
a) Curb, gutter, sidewalk and paving,
b) Relocate the sign presently located on the
South side of Second Street, Vlest of IlH"
Street to a mutually agreed site on said
Owner1s property,
c) Do the necessary landscaping after the
widening of said Second Street.
d) The construction and improvements are to be

done at the expense and in accordance wi th the
Standards. requirements and scheduling of said
City.
The work to be done is shown on Plan No. 6890 on file
in the Department of Public Works. office of the Director of
Public Works/City Engineer.
There are no covenants or warranties other than those
expressed herein.
IN WITNESS WHEREOF. the parties have executed this
Agreement to day and year first above written.
